Havens, Interim Fire Chief RE: PR 24687 Station 3 Change Order No. 1 Nature of the Request: The intent of this agenda item is to seek the City Council's approval of Proposed Resolution 23855 authorizing the City Manager to execute change order no. 1 to the contract with G&G Enterprises Construction Corporation, of Beaumont, Texas, for the construction of Fire Station 3 to extend the substantially finished date to March 28,2026,at no change in costs. Background: On August 13,2024,the City Council of the City of Port Arthur approved Resolution 24-336 authorizing a contract with G&G Enterprises Construction Corporation,of Beaumont,Texas,for the construction of Fire Station 3 to be located at 2375 61st Street. The original substantially completion date was set at September 24,2025.However,during construction, the contractor encountered several unforeseen conditions,including land acquisition delays,supply chain delays, inclement weather,water and wastewater tie-in delays,and other utility coordination issues that impacted construction activities. These delays include,but are not limited to: • Inadequate water line pressure,which led to water main repair. • Unforeseen need for additional site prep/excavation work stemming from unknown subsurface debris. • Wastewater tie-in delay. • Water&wastewater lines are converging,requiring the rerouting of the water main. • Delays in securing electricity and data service to the site. • Delays in securing gas service to the site. Recommendations: The Port Arthur Fire Department recommends approval of P.R. 24687. Budget Considerations: There are no additional costs associated with this project extension. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDER NO. 1 TO THE CONTRACT WITH G&G ENTERPRISES CONSTRUCTION CORPORATION, OF BEAUMONT, TEXAS, FOR THE CONSTRUCTION OF FIRE STATION 3 TO EXTEND THE SUBSTANTIALLY FINISHED DATE TO MARCH 28, 2026, AT NO CHANGE IN COSTS. WHEREAS, on August 13, 2024, the City Council of the City of Port Arthur approved Resolution 24-336 authorizing a contract with G&G Enterprises Construction Corporation, of Beaumont, Texas, for the construction of Fire Station 3 located at.2375 61st street; and, WHEREAS, during construction, the contractor encountered several unforeseen conditions, including land acquisition delays, supply chain delays, inclement weather, water and wastewater tie-in delays, and other utility coordination issues that impacted construction activities (Exhibit A); and, WHEREAS, the Fire Department met and conferred with G&G Enterprises Construction Corporation and architects from Brown, Reynolds, and Watford, of College Station, Texas, on the status of this construction project; and, WHEREAS, the requested Change Order No. 1 will increase the contract substantially completed date to March 28, 2026, and extend the contract time by 183 calendar days (Exhibit B); and, WHEREAS, there is no change in funding for this change order. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That the City Council hereby authorizes the City Manager to execute Change Order No. 1 to the contract with G&G Enterprises Construction Corporation, of Beaumont, Texas, extending the contract duration by 189 calendar days at no change in costs. Sanitary Sewer Re-Route and Tie-In - Extended duration for plumbing under slab rough-in due to off-sit€ sewer connection location change and encountering buried obstructions during re-route. 7. Additional Entergy Requirements - Entergy required additional disconnects and equipment. 8. City-Related Utility Coordination - Relocation of sanitary connection to the South side of 61st Street (delay ongoing, extent unknown). 9. Gas Piping and Gas Service - Delay awaiting CenterPoint Energy to establish gas service and meter set after City created account (delay ongoing, extent unknown). 10.AT&T Fiber Relocation - Most recent delay caused by unanticipated fiber-optic line requiring relocation prior to completion of storm sewer and driveway paving (delay ongoing, extent unknown). Collectively, the above items represent a cumulative impact extending project completion by approximately 183 calendar days. G&G has diligently continued to prosecute the work and mitigate delays where feasible; however, these conditions, many of which are outside G&G's control, have directly affected the project's schedule. Accordingly, G&G respectfully requests that the City issue a change order extending the Substantial Completion date to March 27, 2026, with Final Completion to follow in accordance with the Contract Documents. G&G will continue to coordinate closely with the City, BRW Architects, and utility providers to advance completion of the remaining work.
