COMMENT
Recommendation:
It is recommended that the City Council of the City of Port Arthur adopt Proposed Resolution No.24682,which authorizes the
City Manager to Execute A Contract with Argus Talent for Temporary Employees effective December 17,2025,through April
30,2025. In addition to ratifying the expenditure of$485,619 for the months of October 2025 and November 2025.
Background:
The City of Port Arthur is a full-service municipality with several services being offered outside of regular business hours or
on a twenty-four(24)hour basis. To meet this service requirement for citizens, it is necessary to augment or supplement the
existing regular staff with temporary employees.The majority of temporary employees are hired through a temporary agency.
This method accrues several advantages, including greater flexibility and responsiveness, as well as decreased direct City
liability.
The last contract with Argus Talent was dated to expire on September 30, 2025. The Departments of Human Resources and
Finance, respectively, with this previous contract, planned to revise the specifications to capture elements desired by City
Council and Administration, such as recognition of Port Arthur-based companies, ability to hire residents, provision of
temporaries across the full spectrum of City needs, time responsiveness; essentially an analysis considering qualifications in
addition to price.Regrettably,the contract expiration date was missed,and the contract has now expired.
Once the omission was discovered,the City began working on a resolution to present to the City Council,which would authorize
a new contract.However,the work for which the temporary workers were required continued;therefore,these individuals were
engaged in being responsive to the citizens'needs as determined by the departments.For example,as previously reported,the
City's water infrastructure is in serious need of repair; therefore, the City must continue to respond to ongoing water breaks,
which often occur or extend outside regular work hours.Additionally,water reconnection needs usually extend beyond regular
work hours.There has been an increased emphasis on addressing trash issues within the City,both for trash routes and right-
of-way, as well as parks. This has led to additional hours being worked in both the Solid Waste and Parks and Recreation
departments.This work has had a profoundly positive impact on the city and its residents'quality of life.

Currently, the City employs forty-nine(49) temporaries through Argus Talent. The temporaries'work during the period from
October 1, 2025,to the present has incurred the following costs: October 2025 - $278,922;November 2025 - $206,697.This
equates to a total of$485,619,including$108,646.35 overtime cost due to the reasons previously mentioned.
This resolution requests a new contract with Argus Talent,effective December 17,2025,through April 30,2025,which allows
time to finalize an RFQ (Request for Qualifications) that clearly includes the City Council/Administration priorities noted
previously. It also requests ratification of the City Council regarding payment for the work done after the prior contract
expiration.
Addressing the needs of citizens remains a key priority for the City;therefore,the requested staffing is necessary to continue
this work.Furthermore,we continue to review the City's staffing needs,balancing flexibility,cost,responsiveness,and liability
in making staffing decisions.Each department will advise the Department of Human Resources and the City Manager regarding
its ongoing temporary staffing needs.
Budgetary:
Funding is available in the various departmental accounts. The estimated impact is $ 1,500,000.00, which includes ratifying
the expenditure of$485,619 for the months of October 2025 and November 2025.
Staffing/Employee Effect:
Various departments will be provided supplemental staff as needed.
Summary:
It is recommended that the City Council of the City of Port Arthur adopt Proposed Resolution No. 24682,which
authorizes the City Manager to Execute A Contract with Argus Talent for Temporary Employees. In addition to
ratifying the expenditure of$485,619 for the months of October 2025 and November 2025.

RESOLUTION
A RESOLUTION AUTHORIZING THE CITY MANAGER TO
EXECUTE A CONTRACT BETWEEN THE CITY OF PORT
ARTHUR AND ARGUS TALENT THROUGH TIPS
COOPERATIVE CONTRACT NO. 230703 WITH A PROJECTED
BUDGETARY IMPACT OF $1,500,000 FOR THE PROVISION OF
TEMPORARY EMPLOYEE STAFFING, WHICH INCLUDES THE
PAYMENT OF $485,619 FOR TEMPORARY STAFFING
SERVICES RENDERED AFTER EXPIRATION OF THE PRIOR
CONTRACT. FUNDING IS AVAILABLE IN VARIOUS
DEPARTMENTAL ACCOUNTS.
WHEREAS, the City of Port Arthur is a full-service municipal government operating on a
continuous,twenty-four-hour basis to deliver essential services to its residents; and
WHEREAS, the City Council annually adopts a budget requiring each department to maintain
adequate staffing levels to ensure uninterrupted delivery of public services; and
WHEREAS, the use of temporary staffing services is necessary to supplement regular
personnel, provide operational flexibility, and support departments whose service demands exceed
available permanent staffing capacity; and
WHEREAS, Chapter 271 of the Texas Local Government Code allows a city, by resolution of
its governing body, to participate in a cooperative purchasing program such as TIPS, a purchasing
cooperative, as an alternative to the formal bid process; and
WHEREAS, pursuant to Resolution No. 12-008, the City entered into an interlocal agreement
with Region VIII Education Service Center to participate in The Interlocal Purchasing System (TIPS),
thereby authorizing the City to procure goods and services through TIPS-awarded contracts; and
WHEREAS, Argus Talent holds TIPS Cooperative Contract No. 230703 for staffing services
attached hereto as Exhibit "A" and has previously provided temporary personnel to various City
departments under a contract that expired on September 30, 2025, and
WHEREAS, temporary personnel continued to provide necessary services to the City after the
expiration of the prior contract in order to maintain operational continuity in such areas as water and
wastewater operations, street and right-of-way maintenance, solid waste, parks maintenance, and other
critical service functions; and

WHEREAS, suspension would have halted critical operations and would have resulted in
service outages and potential regulatory concerns. The continuation of services resulted in invoiced
costs of$278,922 for October 2025 and $206,697 for November 2025, totaling $485,619, including
overtime incurred due to high service demand as delineated in Exhibit"B"; and
WHEREAS, these expenditures were made in support of essential municipal functions, and it
is in the best interest of the City to ratify the payments to ensure full transparency and fiscal
accountability; and
WHEREAS, the Human Resources Department and Purchasing Division are revising the
specifications for future procurement of temporary staffing services to incorporate Council and
Administration priorities, including local vendor participation, resident employment opportunities,
qualifications-based evaluation, and responsiveness; and
WHEREAS, a new contract with Argus Talent through TIPS Cooperative Contract No.
230703 is necessary to ensure continuity of operations while the revised procurement specifications
and competitive process are completed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PORT ARTHUR,TEXAS:
Section 1. The facts and opinions in the preamble are true and correct.
Section 2. The City Council hereby authorizes the City Manager to execute a contract with Argus
Talent for temporary staffing services through TIPS Cooperative Contract No. 230703, in substantially the
form attached as Exhibit "C," with a projected budgetary impact of approximately $1,500,000, which
includes the payment of$485,619 to be funded through various departmental accounts.
Section 3. The City Council hereby ratifies the expenditure of$485,619 for temporary staffing
services rendered by Argus Talent during October and November 2025, after expiration of the prior
contract.
Section 4. The City Council directs the Department of Human Resources and the Purchasing
Division to complete and implement revised procurement specifications for temporary staffing services
and to initiate the appropriate competitive process thereafter.
Section 5. That a copy of this Resolution be spread upon the Minutes of the City Council.

CONTRACT FOR
TEMPORARY STAFFING SERVICE FOR THE CITY OF PORT ARTHUR
THIS AGREEMENT, made this day of , 2025, by and between the
City of Port Arthur, a municipal corporation organized under the laws of the State of Texas,
hereinafter called"OWNER" or"CITY" and Argus Talent hereinafter called"CONTRACTOR".
WITNESSETH: That for and in consideration of the payment terms, conditions and
agreements set forth herein,OWNER and CONTRACTOR agree as follows:
1. The term of this Contract shall be from the date of execution to
