"Bob"Bowers Civic Center To: The Honorable Mayor and City Council Through: Ron Burton, City Manager From: Adam J Saunders, Civic Center Dir RE: Proposed Resolution No. P.R. 24699 REQUEST: At Pompeiian Villa, much repair and maintenance are needed. In June 2025, the Council passed Res 25-267 for Phase IV restoration work to Pompeiian Villa to Mike Barnett Construction of Port Neches, Texas. In November 2025, the City Council approved Resolution No. 25-519, authorizing Change Order No. 01. This change was necessitated by unforeseen delays encountered during construction, specifically related to the delayed delivery and limited availability of HVAC mechanical equipment essential for project completion. As a result of these delays, Change Order No. 01 authorized a 36-calendar-day extension, thereby establishing a new completion date of December 29, 2025. Due to the fact that this restoration is subject to approval by the Texas Historical Commission (THC), many steps are required. A small portion of the exterior wall must be repaired due to cracks caused by foundation settlement and holes created by the abandonment of electrical conduits through the exterior walls. THC requires the use of plaster with the same formula as the original building. Since the plaster on this building has never been analyzed, a sample of the original plaster must be sent to a lab for analysis. The requested extension of time is based upon the time needed to analyze the plaster and produce a plaster mixture with the same components and volumes of the original 1900s plaster. Upon the contractor's receipt of the plaster mixture from the manufacturer, the contractor can make repairs to the holes created by foundation settlement and demolition required for the new electrical service. Since there are no prior analyses of the plaster in Pompeii Villa, analysis is required prior to the placement of new plaster in the building's façade. This analysis and manufacturing timeline will add 98 days to the contract. It should be noted that this does not delay the completion of all other aspects of the Phase IV restoration. Once other aspects of the restoration are completed, full access to the building will be available. This delay deals only with a small portion of the exterior. The only contract delay will be the final payment to close out the project and establish a substantial completion date. Otherwise, there will be no interruption in the use of the building beyond the current project completion date. Due to this delay, a change order is requested to add additional days to the Contract Time. The days to be added would be Change Order #2, totaling ninety-eight days. There is no change to the cost of the agreement. ANALYSIS/CONSIDERATION: P.R.No. 24699 12/10/2025 AJS/TNR There are numerous repairs needed at the building. Phase IV of repairs and restoration of the Pompeiian Villa is underway. Change Order#2 to the Phase IV repairs are needed due to delays in exterior plaster testing. RECOMMENDATION A resolution authorizing the City Manager to enter into an agreement with Mike Barnett Construction of Port Neches, Texas for Change Order#2 to Phase IV repairs and maintenance of the Pompeiian Villa in the amount of ninety-eight days added to the Contract Time. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDER NO. 02 TO THE CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND MIKE BARNETT CONSTRUCTION OF PORT NECHES, TEXAS, FOR PHASE IV REPAIRS TO POMPEIIAN VILLA THAT INCREASES THE CONTRACT TERM BY NINETY-EIGHT DAYS TO A NEW COMPLETION DATE OF APRIL 6, 2026, AT NO ADDITIONAL COST. WHEREAS, in June 2025, the City Council adopted Resolution No. 25-267 approving an agreement with Mike Barnett Construction of Port Neches, Texas, for Phase IV repairs and restoration to the Pompeiian Villa in the amount of $415,250.00; and WHEREAS, in November 2025, the City Council approved Resolution No. 25-519, authorizing Change Order No. 01. This change was necessitated by unforeseen delays encountered during construction, specifically related to the delayed delivery and limited availability of HVAC mechanical equipment essential for project completion. As a result of these delays, Change Order No. 01 authorized a 36-calendar-day extension, thereby establishing a new completion date of December 29, 2025; and WHEREAS, the Phase IV restoration work at the Pompeiian Villa is subject to review and approval by the Texas Historical Commission (THC), and compliance with THC requirements is mandatory for the preservation of the historic integrity of the structure; and WHEREAS, a limited portion of the exterior façade requires repair due to cracks caused by historic foundation settlement and openings created by the abandonment and removal of electrical conduits through the exterior walls; and WHEREAS, the THC requires that all exterior plaster repairs utilize a plaster mixture consistent in composition, formulation, and appearance with the original early 1900s plaster used in the construction of the Pompeiian Villa; and P.R.No. 24699 12/10/2025 AJS /TNR WHEREAS, because the original plaster composition has never been previously analyzed, samples of the existing plaster must be extracted and submitted to a laboratory for testing and analysis in order to determine the appropriate formulation, followed by the manufacturing of a matching plaster mixture; and WHEREAS,the time required for laboratory analysis, formulation, and production of the historically compatible plaster mixture necessitates an extension of the Contract Time; and WHEREAS, this testing and manufacturing process will require an additional ninety- eight (98) days, but will not delay or interrupt the completion of the remaining Phase IV restoration work, nor interfere with the use of the building beyond the current project scope, and will affect only the final close-out, final payment, and establishment of the substantial completion date; and WHEREAS, Mike Barnett Construction of Port Neches, Texas, has submitted Change Order No. 02 requesting an extension of the Contract Time by ninety-eight (98) calendar days, establishing a new substantial completion date of April 6, 2026, with no increase in the contract price; and WHEREAS, the City Council finds that approval of Change Order No. 02 is in the best interest of the City and is necessary to ensure compliance with Texas Historical Commission requirements while preserving the historic character of the Pompeiian Villa. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR,TEXAS: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That The City Manager is hereby authorized and directed to execute Change Order No. 02 to the contract with Mike Barnett Construction of Port Neches, Texas, for P.R.No. 24699 12/10/2025 AJS/TNR Phase IV repairs to the Pompeiian Villa, extending the Contract Time by ninety-eight(98) days to a new substantial completion date of April 6, 2026, at no additional cost to the City, in substantially the same form as attached hereto and incorporated herein as Exhibit"A." Section 3. That a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
