RE: P.R. 24706—Installation of Sidewalks and Concrete Work
Introduction:
The purpose of this memorandum is to request City Council approval of the first and final one-year renewal
of the annual contract with W and W Construction of Port Arthur,Texas, for the installation of sidewalks and
related concrete work throughout the City of Port Arthur.
Background:
The City of Port Arthur is required to maintain compliance with the Americans with Disabilities Act(ADA),
which includes the installation, repair, and replacement of sidewalks and related pedestrian infrastructure
throughout the City. To address these ongoing needs, the City Council awarded an annual contract to W and
W Construction by Resolution No. 25-014.
Under the terms of the original contract, one renewal period is permitted. This action represents the first and
final renewal of the agreement. Since the award of the contract, W and W Construction has performed the
work in a satisfactory manner and has demonstrated the ability to complete sidewalk and concrete
improvements at multiple locations throughout the City in a timely and cost-effective manner.
Budget Impact:
The projected expenditure for the renewal term is not to exceed$200,000.00.
Funds for the installation of sidewalks and concrete work are provided in account number 307-21-053-8517-
00-10-00, Public Works Street Maintenance - City Streets, and in various other department accounts as
needed.
Recommendation:
Approval of P.R. No. 24706 authorizing the City Manager to renew the contract with W and W Construction
of Port Arthur,Texas,for the annual contract for installation of sidewalks and concrete repairs throughout the
City in various locations.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE FIRST AND FINAL
RENEWAL OF THE CONTRACT BETWEEN THE CITY OF
PORT ARTHUR AND W AND W CONSTRUCTION OF PORT
ARTHUR, TEXAS, FOR THE INSTALLATION OF
SIDEWALKS & CONCRETE WORK WITH A PROJECTED
BUDGETARY IMPACT OF $200,000.00. FUNDING
AVAILABLE IN PUBLIC WORKS STREET MAINTENANCE—
CITY STREETS, ACCOUNT NO. 307-21-053-8517-00-10-000
AND OTHER AVAILABLE DEPARTMENTAL ACCOUNTS.
WHEREAS, the City of Port Arthur is required to comply with the Americans with
Disabilities Act (ADA), including the installation and maintenance of ADA-compliant sidewalks
throughout the City; and
WHEREAS, via Resolution No. 25-014, City Council awarded an annual contract for
sidewalk installation and related concrete work to W and W Construction of Port Arthur, Texas,
and
WHEREAS, W and W Construction has satisfactorily performed under the existing
contract and has demonstrated the capability and capacity to continue providing these services in
various locations throughout the City; and
WHEREAS, the contract provides for one renewal period, which shall constitute the first
and final renewal of the agreement, attached hereto as Exhibit "A"; and
WHEREAS, the City desires to renew the contract for an additional one-year term for the
continued installation of sidewalks and concrete work throughout the City, with a projected
estimated expenditure not to exceed $200,000.00; and
WHEREAS, funding for this work is available in the Public Works Street Maintenance—
City Streets account, Account No. 307-21-053-8517-00-10-00, and, as necessary, from other
authorized departmental accounts requiring concrete work; and
WHEREAS, the City Council finds that this first and final renewal of the contract is in the
best interest of the City and its residents.
NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR, TEXAS:
THAT, the facts and opinions in the preamble are true and correct; and,
THAT, the City Manager is hereby authorized and directed to execute the first and final
one-year renewal of the annual contract between the City of Port Arthur and W and W Construction
of Port Arthur, Texas, for the installation of sidewalks and concrete work throughout the City, in
substantially the same form as the existing agreement, attached hereto as Exhibit"A."; and,
THAT, the total expenditure under the renewed contract shall not exceed $200,000.00,
subject to the availability of funds; and,
THAT, Funding for the contract shall be provided from Public Works Street Maintenance
— City Streets, Account No. 307-21-053-8517-00-10-00, and other legally available departmental
accounts, as applicable; and,
THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City
Council.

ANNUAL CONTRACT RENEWAL FOR INSTALLATION OF
SIDEWALKS & CONCRETE WORK
THIS AGREEMENT, made this day of , 2026, by and between the
City of Port Arthur, a municipal corporation organized under the laws of the State of Texas,
hereinafter called "OWNER" or "CITY" and W and W Construction hereinafter called
"CONTRACTOR".
WITNESSETH: That for and in consideration of the payment terms, conditions, and agreements
set forth herein, OWNER and CONTRACTOR agree as follows:
1. Pursuant to Resolution No. 25-014,the City entered into a one(1)year contract with the option
to renew for one additional one-year period. The parties hereby agree to exercise said option
for the first renewal and final year. The term shall be January 28, 2026, to January 27, 2027.
The City can terminate this contract at its convenience, which includes, but is not limited to,
funding not being available in any budget cycle within thirty (30) days' written notice.
2. During the term of this Contract, the Contractor will furnish at his own expense all of the
materials, supplies, tools, equipment, labor, and other services necessary to connection
therewith, excepting those supplies specifically not required of the Contractor in the
Specifications.
3. The CONTRACTOR agrees to perform all the work described in the specifications and
contract documents and to comply with the terms in the amounts stated in the bid documents.
4. The term "Contract Documents" means and includes the following:

*These items were attached to the original letting contract.
5. This Agreement shall be binding upon all parties hereto and their respective heirs, executors,
