POND AREA: North Pohd - 0.7 Acres South Pond -5.00 Acres EXCAVATION PERIOD: One (1) year FINDINGS: 1. 2. 3. 4 5 Proposed excavation is in compliance with the requirements of the Port Arthur Excavation Ordinance (Chapter 94, Article VII). The two detention ponds will complement an existing detention- pond adjacent to the proposed south pond. Engineering Consultants, Arceneaux & Gates, has determined that the detention ponds are necessary to meet drainage needs for the EDC Business Park. The ponds will be part of a larger storm water drainage project intended to provide for the future development needs for the business park: Earth taken from the proposed pond areas will be collected in a Five acre spoil area immediately north of the south pond. /. 6. Soil from the construction project. will be used to cover an exposed ditch culvert system to promote an aesthetic effective drainage system throughout the business park. 7. The City's Public Works Director :has issued his approval of the proposed ponding plans. 8. On November 16, 2009, the Planning and Zoning Commission held a public hearing and recommended approval of the permit. SUMMARY: Plans shall be submitted to Building Inspection for approval. Applicant(s) shall follow all sections pertaining to Commercial Excavations and detention ponds as laid out in the City's Code of Ordinance (Chapter 94, Article VII) shall be adhered to. AN ORDINANCE GRANTING AN EXCAVATION PERMIT ISSUED PURSUANT TO CHAPTER 94, ARTICLE VII (EXCAVATIONS) OF THE CODE OF ORDINANCES OF THE CITY OF PORT ARTHUR. TO THE PORT ARTHUR ECONOMIC DEVELOPMENT CORPORATION BUSINESS PARK PHASE II LOCATED NORTH OF F.M. HIGWAY 365 AND WEST OF WEST PORT ARTHUR ROAD. WHEREAS, pursuant to Chapter 94, Article VII (Excavations) of the Code of Ordinances of the City of Port Arthur, the Planning and Zoning Commission has recommended approval of issuing a permit to the Port Arthur Economic Development Corporation for excavation of two detention ponds (North Pond - 0.7 Acres; South Pond - 5.00 Acres) (Exhibit "A") in the Port Arthur Economic Development Business Pazk Phase II, which contain earth material in the City of Port Arthur, upon certain conditions and assurances for the public health, welfare and safety and to protect the development of the surrounding area; and, WHEREAS, Engineering Consultants, Arceneaux & Gates, has determined that the detention ponds aze necessary to meet drainage needs for the Port Arthur Economic Development Business Pazk Phase II; and, WHEREAS, the ponds will be part of a lazger storm water drainageproject intended to provide for the future development needs of the business pazk; and, WHEREAS, the earth taken from the proposed pond areas will be collected in a five (5) acre spoil area immediately north of the south pond (Exhibit "A") and be used to cover an exposed ditch culvert system to promote an aesthetic effective drainage system throughout the business park; and, WHEREAS, the City Council hereby concurs in the recommendation and findings of the Planning & Zoning Commission; now, therefore; P.O. No. 6051 11/17/09 CWR BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That an excavation permit is hereby granted to the Port Arthur Economic Development Business Corporation for the excavation of earth material on the following tract of land: A 120.67 TRACT OF LAND OUT OF AND PART OF BLOCK 2 AND BLOCK 10, PORT ARTHUR ECONOMIC DEVELOPMENT BUSINESS PARK CITY OF PORT ARTHUR, JEFFERSON COUNTY, TEXAS LOCATED NORTH OF F.M. HIGWAY 365 AND WEST OF WEST PORT ARTHUR ROAD. Section 2. That this permit is subject to the terms and conditions of Chapter 94, Article VII of the Code of Ordinances of the City of Port Arthur, and Exhibit "A" attached hereto and which are incorporated and made part hereof by reference. Section3. That this permit shall be for a time period of one (1) year. Excavation operations thereafter shall be inspected and evaluated annually for compliance. Section4. That the Port Arthur Economic Development Corporation shall signify acceptance of the Permit by subscription of a certified copy thereof.
