Introduction: P.R.No. 24719 authorizes the City Manager or his designee to negotiate a contract with PBK of Houston, Texas for the Design of a NatureNisitor Center on Pleasure Island. Background: Pursuant to Resolution 24-353, City Council authorized the City Manager to accept a donation from the Cheniere Foundation in the amount of $50,000.00 to support Pleasure Island engineering and design for a NatureNisitors Center. City staff advertised an RFQ, reviewed, evaluated and scored fifteen (15) responses. The RFQ evaluation committee, after reviewing the submitted responses and applying the published evaluation criteria, recommends PBK, of Houston, Texas to provide these services. Budget Impact: None Recommendation: It is recommended that the City Council approve P.R. No. 24719, authorizing the City Manager or his designee to negotiate a contract with PBK of Houston, Texas for the Design of a NatureNisitor Center on Pleasure Island. The negotiated contract will be presented to City Council for final approval. A RESOLUTION AUTHORIZING THE CITY MANAGER TO NEGOTIATE A CONTRACT WITH PBK, OF HOUSTON, TEXAS, FOR THE DESIGN OF A NATURE/VISITOR CENTER ON PLEASURE ISLAND. WHEREAS, the City of Port Arthur published a Request for Qualifications (RFQ) in the Port Arthur News on May 14, 2025 and May 21, 2025, for the design of a Nature/Visitor Center on Pleasure Island as delineated in Exhibit"A"; and WHEREAS, the City of Port Arthur received qualifications statements from fifteen (15) firms on July 9, 2025; and WHEREAS, the RFQ evaluation committee, after reviewing the submitted statements and applying the published evaluation criteria, recommends PBK, of Houston, Texas to provide these services as outlined in Exhibit"B"; and WHEREAS, staff recommends that it is in the best interest of the citizens of Port Arthur to authorize the City Manager to negotiate a contract for these services, subject to approval by the City Council. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. Project Overview: This project involves the architectural and interior design services for a 10,000 square foot Nature/Visitor Center. The facility will include a main lobby, gift shop,meeting rooms and restrooms, designed to create a welcoming, functional,and aesthetically pleasing space for visitors. The design will focus on both user experience and efficient space planning while ensuring compliance with local building codes,accessibility standards, and environmental sustainability goals. 2. Project Deliverables: • Design Concept Development: o Collaborate with staff to define the vision, purpose, and primary functions of the Nature/Visitor Center. o Present initial design concepts that reflect the client's needs, site characteristics, and budget constraints. o Develop a comprehensive design narrative that incorporates architectural, functional, and environmental elements into the overall vision of the building. • Site Analysis and Master Planning: o Conduct a thorough site analysis, including environmental considerations, access points, parking, and outdoor landscaping. o Provide a master plan that integrates the building design with surrounding features,ensuring accessibility, flow, and alignment with the overall site development plan. o Address outdoor spaces, walkways,parking,and landscape features, integrating them into the building design. • Space Planning & Layout: o Develop a functional and efficient floor plan for the 10,000-square-foot facility, ensuring optimal use of space for the following areas: • Main Lobby: Welcoming space for visitors, with clearly marked directions and interactive informational displays. • Gift Shop: Space for retail displays, merchandise storage,check-out counters, and adequate circulation. • Meeting Rooms: Versatile, flexible spaces for different group sizes and types of meetings/events, equipped with necessary technology for presentations. • Restrooms: Separate restrooms for men and women, as well as ADA-compliant, accessible restrooms. Post-Design Services: • Construction Administration: Provide support during the construction phase by answering design- related questions, addressing design changes, and conducting site visits to ensure the design is implemented as planned. • Design Adjustments: If needed, adjust based on feedback during construction or unforeseen site conditions. Page 6 of 21 8. Conclusion: The scope of work outlined above covers all phases of the design process for a 10,000 square foot Nature/Visitor Center. The final design will provide a functional, aesthetically pleasing, and sustainable space that enhances the visitor experience while meeting all necessary regulatory, operational, and budgetary requirements. Page 7 of 21 The City of Port Arthur requires comprehensive responses to every section within this RFQ. To facilitate the review of the responses, Firms shall follow the described qualification format. The intent of the qualification format requirements is to expedite review and evaluation. It is not the intent to constrain Vendors with regard to content, but to assure that the specific requirements set forth in this RFQ are addressed in a uniform manner amenable to review and evaluation. &hi requested that qualification packets be limited to no more than 50 pages. excluding resumes. A. EXPERIENCE 1. Provide a profile of experience for the Engineer and all members of the firm. This section shall include,but not be limited to,the following: a. Experience of team - number of years in field, number of Registered (Texas) Engineers in firm. Include a brief description of responsibilities and summary resumes of key professional personnel. Include any specialty certification, which demonstrates special qualification. State the number of similar projects. Indicate any additional personnel your firm would anticipate needing to hire,as required,to take on the work for which this response is requested. b. Experience of firm — number of years in existence and number of employees. Include a brief overview of the accomplishments of the firm. Included the number of municipal procurement jobs and duties. Provide office location where each phase of this work will be accomplished. Include names, titles, work addresses, and work telephone numbers of the responsible corporate officer(s)in the proposed office location. B. PAST PERFORMANCE 1. Identify and describe the proposed Team's past experience for providing services that are most related to the requested services within the past ten (10) years. For each project, provide the following information. a. Project name, location,contract delivery method,and description b. Initial project and projected time for completion c. Final project cost and time for completion d. The nature of material change orders e. The nature of adverse claims or litigation f. The Architect/Engineer's name and representative who served as the day-to-day liaison during each phase of the project(include telephone number) g. Length of business relationship with the Owner 2. Identify and describe the proposed Team's past experience working with municipalities. 3. Identify and describe the proposed Team's past experience working in Port Arthur or surrounding areas. Provide a brief description of the firm's typical plan for accomplishing work and services to be provided to the City on a typical project like this including,but not limited to: a. Description of activities for projects. b. Technical approach to each phase of work. c. Indicate which team member will participate in each area of the work for both the lead firm and any sub-contractors. d. Design ideas or concepts 2. Describe your plan for communicating constructability, phasing, value engineering, and other issues requiring decision-making by the Owner. D. PORT ARTHUR BUSINESSES 1. Page 9 of 21 tr. _ SELECTION PROCESS All applications will be screened by an evaluation committee and those applicants selected for a short list may be invited to attend an interview, at the applicants own expense. The City shall not incur any costs for applicant preparation and/or submittal of qualifications. The City will evaluate all responses based on the qualifications, past performance and project approach. The City reserves the right to negotiate the final fee prior to recommending any Firm for a contract. The City's process is as follows: 1. The evaluation committee shall screen and rate all of the responses that are submitted. Evaluation ratings will be on a 100 point scale and shall be based on the following criteria: a. Experience 40 pts b. Project Approach .30 pts c. Past Performance 25 pts d. Port Arthur Business 5 pts 2. City staff shall recommend the most qualified Engineering firms. 3. This RFQ does not commit the City to pay for any direct and/or indirect costs incurred in the preparation and presentation of a response. All finalist(s) shall pay their own costs incurred in preparing for,traveling to and attending interviews. DELINOUENT PAYMENTS DUE CITY: The City of Port Arthur Code of Ordinances prohibits the City from granting any license, privilege or paying money to any-one owing delinquent taxes, paving assessments or any money to the City until such debts are paid or until satisfactory arrangements for payment has been made. Under the Title VI of the Civil Rights Act of 1964, no person shall, on the grounds of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance. • TERMINATION FOR CAUSE: If, through any cause, the Contractor shall fail to fulfill in a timely and proper manner his obligations under this contract, or if the Contractor shall violate any of the covenants, agreements or stipulations of this contract, the City shall thereupon have the right to terminate this contract by giving written notice to the Contractor of such termination and specifying the effective date thereof, at least fifteen (15) days before the effective date of such termination. Notwithstanding the above, the Contractor shall not be relieved of liability to the City for damages sustained by the City by Page 18 of 21 Pr virtue of any breach of the contract by the Contractor, and the City may withhold any payments to the Contractor for the purpose of set-off until such time as the exact amount of damages due the City from the Contractor is determined. TERMINATION FOR CONVENIENCE: The City may terminate this contract at any time giving at least thirty (30) days notice in writing to the Contractor. If the Contract is terminated by the City as provided herein, the Contractor will be paid for the service that it has performed up to the termination date. If this contract is terminated due to fault of the Contractor, the previous paragraph hereof relative to termination shall apply. RELEASES AND RECEIPTS: The City of Port Arthur before making payments may require the Contractor to furnish releases or receipts for any or all persons performing work and supplying material or service to the Contractor, or any sub-contractors for work under this contract, if this is deemed necessary to protect its interests. CARE OF WORK: The Contractor shall be responsible for all damages to person or property that occurs as a result of his fault or negligence in connection with the work performed until completion and final acceptance by the City. SUB-CONTRACTS: The Contractor shall not execute an agreement with any sub-contractor or permit any sub-contractor to perform any work included in this Contract until he has received from the City of Port Arthur written approval of such agreement. INSURANCE: All insurance must be written by an insurer licensed to conduct business in the State of Texas, unless otherwise permitted by Owner. PROPOSAL EVALUATION AND CONTRACT AWARD: Proposal Evaluation and Contract Award Process: An award of a contract to provide the goods or services specified herein will be made using competitive sealed proposals, in accordance with Chapter 252 of the Texas Local Government Code and with the City's purchasing policy.
