No. 24787: Community Development Block Grant(CDBG) Interdepartmental Agreements for the Neighborhood Revitalization Division for Program Year 2025 Introduction: This agenda item requests City Council authorization for the City Manager to enter into a Community Development Block Grant (CDBG) Interdepartmental Agreement with the Housing and Neighborhood Revitalization Division for Program Year 2025, with the following funding allocations totaling $692,000.00: • $325,000 for Emergency/Minor Home Repairs; • $217,000 for Housing and Neighborhood Revitalization Administration; and • $150,000 for Down Payment Assistance. Background: The U.S.Department of Housing and Urban Development(HUD)awarded the City of Port Arthur $1,006,776.00 for the 2025 Community Development Block Grant(CDBG)Program. On July 1, 2025, the City Council approved the total funding allocations for each grant recipient through Resolution No. 25-298, as follows: • $114,776.00 to non-profit recipients; • $200,000.00 to the Grants Administration Division; and • $692,000.00 to the Housing and Neighborhood Revitalization Division. These allocations collectively represent the total 2025 CDBG funding award of$1,006,776.00. Budget Impact: The Community Development Block Grant program is the only funding source (FUND 105). Recommendation: This Agenda Item recommends that the City Council's authorize the City Manager to enter into a Community Development Block Interdepartmental Agreement with the Housing and Neighborhood Revitalization Division for Program Year 2025. Essex RESOLUTION NUMBER A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) INTERDEPARTMENTAL AGREEMENT WITH THE HOUSING AND NEIGHBORHOOD REVITALIZATION DIVISION FOR HOUSING ASSISTANCE PROGRAMS THAT BENEFIT LOW AND MODERATE INCOME RESIDENTS, WITH A TOTAL FUNDING ALLOCATION OF $692,000.00 FROM THE 2025 CDBG PROGRAM YEAR(FUND 105). WHEREAS, pursuant to Resolution No. 25-298, the City Council approved and adopted a list of eligible projects for Program Year 2025 to ensure compliance with the Housing and Urban Development Act of 1974, as amended (Public Law 93-383), and further approved the total funding allocations for each grant recipient, as follows, collectively representing the total 2025 CDBG funding award of$1,006,776.00; • $114,776.00 to non-profit recipients; • $200,000.00 to the Grants Administration Division; and • $692,000.00 to the Housing and Neighborhood Revitalization Division. WHEREAS,the City Council,by its adoption of Resolution Number 25-327 (authorizing submission of the 2025 Year Consolidated Plan), has obligated itself to provide financial assistance to non-profit organizations and City divisions as delineated in Exhibit"A"; and WHEREAS, the Interdepartmental Agreement for the Housing and Neighborhood Revitalization Division, attached hereto as Exhibit`B", will allocate $692,000.00 to address the housing needs of low- and moderate-income residents of the City of Port Arthur through various housing assistance programs; and WHEREAS,the City Council is required to designate an official to sign all documents in connection with amendments to the applications and grant agreements. NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: THAT,the facts and preamble in the recitals are true and correct. THAT, the City Council hereby authorizes the City Manager to execute the Interdepartmental Agreement for the Housing and Neighborhood Revitalization Division, in substantially the same form attached hereto as Exhibit B, in the amount of $692,000.00, to be allocated for the following purposes: • $325,000 for Emergency/Minor Home Repairs; • $217,000 for Housing and Neighborhood Revitalization Administration; and • $150,000 for Down Payment Assistance. r THAT a copy of the caption of this Resolution be spread upon the minutes of the City Council. I. PURPOSE This Interdepartmental Agreement provides the Housing Assistance Division with 2025—2026 Community Development Block(CDBG)funds to administer the Housing Assistance Programs. II. TIME OF PERFORMANCE The Time of Performance under this Agreement shall begin on February 10,2026, and end February 9, 2027. III. SERVICES PROVIDED The Housing Assistance Division shall provide housing services to low-and moderate-income families in the City of Port Arthur,Texas. IV. BUDGET A. Three Hundred Twenty-Five Thousand and No/100 Dollars($325,000): a. Assistance will be provided to thirteen (13) families for emergency and minor repairs to their owner-occupied homes. B. One Hundred Fifty Thousand and No/100 Dollars($150,000): a. Assistance will be provided to five (5) families for down payment and closing costs to support the purchase of new construction or existing homes. C. Two Hundred Seventeen Thousand and No/100 Dollars($217,000): a. CDBG funds will be used to cover staff salaries and administrative costs necessary to administer the Housing Assistance Programs. This includes providing emergency and minor home repairs, down payment and closing cost assistance, and other related administrative activities to benefit low-and moderate-income households. V. PROGRAM STANDARDS Projects undertaken must directly benefit low and moderate-income persons/families,or the project must benefit a low and moderate-income area of Port Arthur. VI. PROGRAM REQUIREMENTS The Program receiving funds under this Agreement must comply with the City of Port Arthur Procurement Procedures,24 CFR 570,and 2 CFR Part 200 and the U.S. Department of Housing and Urban Development—Policy Requirements attached hereto as Exhibit"A". VII. PERFORMANCE STANDARDS The Housing Assistance Division shall perform the work specified in this Agreement reasonably and prudently. VIII. REPORTS Monthly reports are due by the 28th day of each month and include the number of persons served by race and income. IX. AMENDMENTS Any amendments to this Agreement must be made in writing and approved by both parties. The Recipient shall not use grant funds to promote"gender ideology,"as defined in Executive Order (E.O.)14168,Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government; 2. The Recipient agrees that its compliance in all respects with all applicable Federal anti- discrimination laws is material to the U.S.Government's payment decisions for purposes of section 3729(b)(4)of title 31,United States Code; 3. The Recipient certifies that it does not operate any programs that violate any applicable Federal anti-discrimination laws,including Title VI of the Civil Rights Act of 1964; 4. The Recipient shall not use any grant funds to fund or promote elective abortions,as required by E.O. 14182,Enforcing the Hyde Amendment;and that, 5. Notwithstanding anything in the NOFO or Application,this Grant shall not be governed by Executive Orders revoked by E.O.14154,including E.O.14008,or NOFO requirements implementing Executive Orders that have been revoked. 6. The Recipient must administer its grant in accordance with all applicable immigration restrictions and requirements,including the eligibility and verification requirements that apply under title IV of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996,as amended(8 L.,S 1601-1646)(PRWORA)and any applicable requirements that HUD,the Attorney General,or the U.S. Citizenship and Immigration Services may establish from time to time to comply with PRWORA, Exe_ciftly2 Order 14218,or other Executive Orders or immigration laws. 7. No state or unit of general local government that receives funding under this grant may use that funding in a manner that by design or effect facilitates the subsidization or promotion of illegal immigration or shields illegal aliens from deportation,including by maintaining policies or practices that materially impede enforcement of federal immigration statutes and regulations. 8. The Recipient must use SAVE,or an equivalent verification system approved by the Federal government,to prevent any Federal public benefit from being provided to an ineligible alien who entered the United States illegally or is otherwise unlawfully present in the United States. 9. Faith-based organizations may be subrecipients for funds on the same basis as any other organization. Recipients may not,in the selection of subrecipients,discriminate against an organization based on the organization's religious character,affiliation,or exercise.
