Re: P. R. NO. 24740 — APPOINTING AND/OR REAPPOINTING SIX (6) REGULAR
MEMBERS TO THE CONSTRUCTION BOARD OF ADJUSTMENTS AND APPEALS.
COMMENT
Nature of the Request:
Staff recommends that the City Council adopt P. R. No. 24740, appointing and/or reappointing six (6)
regular members to the Construction Board of Adjustments and Appeals. Board Members Gerald Hatch,
Lawrence Baker, Tom McDonald, Lloyd Marie Johnson, Brian McZeal, and Clifton Batiste have terms
that expire on February 27, 2026; however, all Board Members desire to remain on the board. The term
for a Construction Board member is two (2) years; therefore, the term for the regular Construction Board
Members will begin on February 27, 2026, and expire on February 27, 2028. This will fill all the
positions on the Construction Board.
Staff Analysis/Considerations:
Not Applicable.
Recommendation:
Staff recommends that the City Council adopt P. R. No. 24740, thereby appointing and/or reappointing
six (6)regular members to the Construction Board of Adjustments and Appeals.
Budget Consideration: Not Applicable.

RESOLUTION NO.
A RESOLUTION APPOINTING AND/OR REAPPOINTING A
MEMBER OR MEMBERS TO THE CONSTRUCTION BOARD OF
ADJUSTMENTS AND APPEALS
WHEREAS,Ordinance No. 98-04 created the Construction Board of Adjustments and Appeals;and
WHEREAS,Ordinance No. 15-25 amended Ordinance No. 98-04;and
WHEREAS,Ordinance No. 17-46 amended Ordinance No. 15-25;and the membership in the Board is comprised of
nine(9)members;and
WHEREAS,Ordinance No. 18-02 amended Ordinance No. 17-46; and the membership in the Board is comprised
of seven(7)regular members;and
WHEREAS,the scope of duties of the Board is delineated in the Building Code, and Section 54.033 Local
Government Code,and in Ordinance No. 18-02;and
WHEREAS,the current makeup of the Board is delineated in Exhibit"A";and
WHEREAS, as shown in the attached Exhibit "A", the term of Board Members Gerald Hatch, Lawrence Baker, Tom
McDonald,Lloyd Marie Johnson,Brian McZeal,and Clifton Batiste have terms that expire on February 27,2026,and they desire to
be reappointed.Council can either reappoint Gerald Hatch,Lawrence Baker,Tom McDonald,Lloyd Marie Johnson,Brian McZeal,
and Clifton Batiste or appoint new members;and
WHEREAS,Councilmember Lewis wishes to appoint/reappoint Gerald Hatch as Board Member for District 1;and
WHEREAS,Councilmember Hamilton wishes to appoint/reappoint Lawrence Baker as Board Member for District 2;and
WHEREAS,Councilmember Beckcom wishes to appoint/reappoint Tom McDonald as Board Member for District 3;and
WHEREAS,Councilmember Doucet&Mayor Pro Tem wishes to appoint/reappoint Lloyd Marie Johnson as Board
Member for District 4;
WHEREAS,Councilmember Kinlaw wishes to appoint/reappoint Brian McZeal as Board Member for Position 5,
At Large;and
WHEREAS,Councilmember Frank, Sr. wishes to appoint/reappoint Clifton Batiste as Board Member for Position 6,
At Large;and

NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR,TEXAS:
Section 1. THAT the facts and opinions in the preamble are true and correct.
Section 2.THAT the City of Port Arthur hereby confirms the appointment reappointment of Gerald Hatch.Lawrence Baker.
Tom McDonald. Lloyd Marie Johnson. Brian McZeal. and Clifton Batiste. as regular members to the Construction Board of
Adjustments and Appeals.
section 3. THAT the term shall be two(2)years.
Sect ion 4, f I IAT in accordance with Resolution No.98-157.this appointee shall immediately contact the City Secretary.be
sworn in.and receive a copy of the Ordinance No. 18-49.
Section 5.THAT this resolution shall become effective on February 27.2026.
Section 6. THAT a copy of the caption of this resolution be spread upon the Minutes of the City Council.
