PO 7403 AUTHORIZING THE CITY MGR TO EXECUTE A QUIT CLAIM DEED FOR 937 MARIAN ANDERSON
P.O. No. 7403 02/26/26 ht ORDINANCE NO. AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A QUIT CLAIM DEED DISCLAIMING ANY INTEREST TO THE PROPERTY LOCATED AT 937 MARIAN ANDERSON AVENUE(PROPERTY ID#95508) TO JEFFERY ALEXANDER NELMS. WHEREAS, on August 25, 1932, the District Court of Jefferson County rendered a judgment authorizing the seizure and sale of the property legally described as Lot 22,Block R12,W. H. SCHMYSER,an Addition to the City of Port Arthur,Jefferson County,Texas,commonly known as 937 Marian Anderson Avenue (PID#95508), due to delinquent taxes; and WHEREAS, pursuant to a Sheriff's Deed recorded on August 27, 1935, in Volume 397, Page 504 of the Jefferson County Deed Records,the property was struck off and sold to the City of Port Arthur as the highest bidder at the delinquent tax sale; and WHEREAS, subsequent deed and file records from 1952 through 2023 reflect that fee simple title to the property remained in the name of the prior record owners and no subsequent action appears of record confirming ownership in the City of Port Arthur; and WHEREAS,property tax records further reflect that,since that time,ad valorem taxes have been assessed to and paid by the private record owners and all taxes are current as confirmed in the attached Exhibit"A"; and WHEREAS, the current owner is in the process of selling the property and the title commitment has identified the 1935 Sheriff's Deed to the City of Port Arthur as a potential cloud on title; and WHEREAS, the title company is requesting that the City execute a Quitclaim Deed disclaiming any interest it may have in the property in order to remove the cloud on the title. NOW THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR,TEXAS: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That the City Council hereby authorizes the City Manager to execute a Quitclaim Deed,in substantially the same form as Exhibit"B",disclaiming any interest the City may have in the above-described property for the purpose of clearing title to Lot 22, Block R12, W. H. SCHMYSER,an Addition to the City of Port Arthur,Jefferson County,Texas,commonly known as 937 Marian Anderson Avenue (PID #95508). Section 3. That the Quit Claim Deed shall be provided to the title company for recording in the official public records of the Jefferson County Clerk following execution. Section 4. That a copy of the caption of this Ordinance be spread upon the Minutes of the City Council.
