AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A
SPECIAL WARRANTY DEED CONVEYING PORTIONS OF LAND ALONG
THE SABINE-NECHES WATERWAY ON PLEASURE ISLAND TO THE
SABINE-NECHES NAVIGATION DISTRICT OF JEFFERSON COUNTY,
TEXAS, FOR THE PURPOSE OF DEEPENING, WIDENING AND
IMPROVING THE SABINE-NECHES WATERWAY.
WHEREAS, pursuant to Resolution 26-089, the City Council approved an Interlocal
Cooperation Agreement between the City of Port Arthur, Texas ("City") and the Sabine-Neches
Navigation District of Jefferson County,Texas("District")relating to the deepening,widening and
improving of the Sabine-Neches Waterway; and
WHEREAS, the City owns certain real property required for the waterway improvement
project,more specifically:
(i)the RV Park formerly known as Waterview RV Resort of Pleasure Island,also known as
Pleasure Island RV Park II,located at 150 Pleasure Pier Boulevard,Port Arthur,Texas(the
"RV Park"); and
(ii)a strip of land located alongside the Sabine-Neches Waterway and the former Palms Golf
Course at Pleasure Island (the "Strip of Land"); and
WHEREAS,the City has agreed to convey fee simple title to certain portions of the RV Park
and the Strip of Land, more particularly described as five (5)tracts in the Special Warranty Deed
attached hereto as Exhibit"A,"in order to permit the District to complete the deepening,widening,
and improvement of the Sabine-Neches Waterway, and
WHEREAS,the consideration for the conveyance is specially described in Resolution 26-
089 and the Interlocal Cooperation Agreement.
NOW THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR,TEXAS:
Section 1. That the facts and opinions in the preamble are true and correct.
Section 2. That the City Council authorizes the City Manager to executed a Special
Warranty Deed,in substantially the same form attached to as Exhibit"A",conveying fee simple title
to the five(5)tracts of land described therein,such tracts being portions of the RV Park and the Strip
of Land, located along the Sabine-Neches Waterway at Pleasure Island, for the consideration set
forth in Resolution 26-089 and the Interlocal Cooperation Agreement.
Section 3. That the Special Warranty Deed shall be recorded in the official public
records of the Jefferson County Clerk following execution.
Section 4. That a copy of the caption of this Ordinance be spread upon the Minutes of the
City Council.
