"Bob"Bowers Civic Center To: The Honorable Mayor and City Council Through: Ron Burton, City Manager From: Adam J Saunders, Civic Center Dir RE: Proposed Resolution No. 24751 BACKGROUND The Civic Center Department, through the Purchasing Division, solicited competitive sealed bids for repairs and enhancements to the Sabine Pass Community Center Spray Pad. The project was structured into four separate and severable sections of work, allowing each section to be evaluated and awarded independently in the City's best interest. The solicitation was properly advertised on November 5 and November 12, 2025. On November 26, 2025, three bids were received and publicly opened. The bids were reviewed by Purchasing in coordination with the Civic Center Department for responsiveness and responsibility. The four sections included: 1. Relocation of equipment into a new above-ground vault/security cabinet 2. Replacement of picnic tables and covers and installation of additional shade covers 3. Repainting of spray pad features and replacement of signage 4. Replacement of two palm tree water features ANALYSIS Section Four—Recommendation to Reject Upon review, staff determined that the specifications for Section Four(replacement of palm tree features) lacked sufficient technical detail to enable the City to make a fully informed determination of product quality, durability, and long-term suitability for the facility. Rejecting this section allows the City to revise specifications to better define its needs before re- advertising. For these reasons,rejection of Section Four is in the City's best interest. Sections One, Two, and Three—Award Recommendation The remaining sections were clearly specified. Staff recommends award as follows: • Sections One and Three: Commercial Chemical Products, Inc. d/b/a Poolsure — $58,696.00 • Section Two: Oasis Waterplaygrounds, Inc. —$59,500.00 Both entities were determined to be the lowest responsible and responsive bidders for their respective sections. The total award amount for these three sections is $118,196.00. DBA Poolsure$13.211.00 o Kraftsman, LP $14.033.33 . o Oasis Waterplaygrounds, Inc. $28.745.00 • Section/Quote 4 (Replace two palm tree features) o Commercial Chemical Products, Inc. Reject all bids received for Section Four(replacement of palm tree features); and 2. Authorize the City Manager to execute contracts for Sections One,Two, and Three with Commercial Chemical Products, Inc. d/b/a Poolsure and Oasis Waterplaygrounds, Inc., in the total amount of$118,196.00. A RESOLUTION AUTHORIZING THE REJECTION OF BIDS FOR SECTION FOUR OF THE SABINE PASS COMMUNITY CENTER SPRAY PAD PROJECT; AWARDING CONTRACTS FOR SECTIONS ONE, TWO, AND THREE; AND AUTHORIZING THE CITY MANAGER TO EXECUTE CONTRACTS WITH COMMERCIAL CHEMICAL PRODUCTS, INC. DB/A POOLSURE AND OASIS WATERPLAYGROUNDS, INC. IN THE TOTAL AMOUNT OF $118,196.00 FUNDS ARE AVAILABLE IN ACCOUNT #307-15-043-8512-00-10-000 PROJECT BU0026. WHEREAS, the City of Port Arthur, through its Civic Center Department and Purchasing Division, solicited competitively sealed bids for repairs and enhancements to the Sabine Pass Community Center Spray Pad, with the work divided into four(4) separate sections to allow independent evaluation and award; and WHEREAS, the Purchasing Division duly advertised on November 5, 2025, and November 12, 2025, attached hereto as Exhibit"A"; and WHEREAS, on November 26, 2025, three (3) bids were timely received, publicly opened, and evaluated by the Purchasing Division in coordination with the Civic Center Department, attached hereto as Exhibit"A"; and WHEREAS, the bid solicitation required unit pricing by section, with each section constituting a distinct and severable portion of the overall project; and WHEREAS, upon review, the specifications for Section Four (replacement of existing palm tree features with new palm tree features) were determined to lack sufficient detail to permit a fully informed determination of the best value and product quality for the City; and WHEREAS, pursuant to the terms of the solicitation, the City reserves the right to reject any and all bids, and it is in the best interest of the City to reject all bids received for Section Four and to revise the specifications for future solicitation; and WHEREAS, for Section One (relocation of equipment into a new above-ground vault/security cabinet) and Section Three (repainting of spray pad features and replacement of signage), the lowest responsible and responsive bidder is Commercial Chemical Products, Inc. d/b/a Poolsure, Houston, Texas, in the combined amount of$58,696.00; and P.R.No. 24751 01/21/2026 AJS-TNR WHEREAS, for Section Two (replacement of picnic tables and covers and installation of additional shade covers), the lowest responsible and responsive bidder is Oasis Waterplaygrounds, Inc., Houston, Texas, in the amount of$59,500.00; and WHEREAS, the total amount for Sections One, Two, and Three is $118,196.00, and sufficient funds are available in Account No. 307-15-043-8512-00-10-000, Project BU0026; and WHEREAS, the City Council finds that rejection of Section Four and award of Sections One, Two, and Three, as set forth herein, are in the best interest of the citizens of the City of Port Arthur. NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR,TEXAS: Section 1. The facts and opinions in the preamble are true and correct. Section 2. The City Council hereby rejects all bids received for Section Four (replacement of existing palm tree features) of the Sabine Pass Community Center Spray Pad project and authorizes the Civic Center Department and Purchasing Division to revise the specifications and re-solicit bids at a later date, as appropriate. Section 3. The City Council hereby awards: (a) Section One and Section Three to Commercial Chemical Products, Inc. d/b/a Poolsure, in the combined amount of$58,696.00; and (b) Section Two to Oasis Waterplaygrounds, Inc., in the amount of$59,500.00. for a total amount not to exceed $118,196.00, in substantially the same form as Exhibit"B" and Exhibit "C„ Section 4. Funding for the contracts authorized herein is available in Account No. 307- 15-043-8512-00-10-000, Project BU0026. Section 5. That a copy of this Resolution shall be spread upon the Minutes of the City Council. The Contractor will perform spray pad repairs (move equipment into an aboveground vault and repaint all features and replace signs) at the Sabine Pass Community Center Spray Pad as stated in the Contract Documents in an amount not to exceed $58,696.00. 3. During the term of this Contract, the Contractor will furnish at his own expense all of the materials, supplies, tools, equipment, labor, and other services necessary to connection therewith, excepting those supplies specifically not required of the Contractor in the Specifications. 4. The CONTRACTOR agrees to perform all the work described in the specifications and contract documents and to comply with the terms therein for the unit prices shown in the original bid attached hereto. 5. The term "Contract Documents" means and includes the following: 1) Agreement 2) General Information 3) Specification 4) Bid 5) Notice of Award 6. This Agreement shall be binding upon all parties hereto and their respective heirs, executors, administrators, successors, and assigns. 7.
