Mills Road, in an amount not to exceed $39,800.00. Background: The Fleet Maintenance Facility located at 101 H.O. Mills Boulevard is a critical municipal operations site used to service and maintain City-owned vehicles and equipment, including units utilized by the Police Department. The roof of the facility has exceeded its useful life and requires replacement to prevent further deterioration and protect City assets housed within the structure. Prior to roof replacement, asbestos-containing materials must be abated in compliance with applicable federal and state environmental regulations. Failure to properly remediate such materials exposes the City to regulatory penalties, health risks, and potential project delays. The City solicited quotes from qualified contractors for asbestos abatement services related to this project. Two (2) quotes were received and evaluated. Inland Environments LTD submitted the lowest responsible and responsive quote, in an amount not to exceed $39,800.00. The proposed contract provides for a performance period of ten (10) working days, to commence upon Council approval and issuance of a Notice to Proceed. Recommendation: It is recommended that the City Council approve P.R. No. 24745, authorizing the City Manager to execute a contract with Inland Environments LTD, for the asbestos abatement of the building's roof at 101 H.O. Mills Road in an amount not to exceed $39,800.00. Budgetary/Fiscal Effect: Funding to pay for the roof replacement is available in Account Fund 307- 13-037-8525-00-10-000 Project BU0029. P.R. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH INLAND ENVIRONMENTS LTD FOR ASBESTOS ABATEMENT SERVICES ASSOCIATED WITH THE ROOF REPLACEMENT OF THE CITY'S FLEET MAINTENANCE FACILITY LOCATED AT 101 H.O. MILLS BOULEVARD, IN AN AMOUNT NOT TO EXCEED $39,800.00; FUNDING IS AVAILABLE IN ACCOUNT NO 307- 13-037-8525-00-10-000 PROJECT BU0029 WHEREAS, the City of Port Arthur's Fleet Maintenance Facility located at 101 H.O. Mills Boulevard serves as a critical operations site for the maintenance and repair of municipal vehicles and equipment, including vehicles utilized by the Police Department; and WHEREAS, the roof of said facility has exceeded its useful life and requires replacement to preserve the structural integrity of the building and protect City assets housed therein; and WHEREAS, prior to roof replacement, asbestos-containing materials must be properly abated in accordance with applicable federal and state environmental regulations; and WHEREAS, the City solicited competitive quotations from qualified vendors for asbestos abatement services associated with the roof replacement project; and WHEREAS, two (2) quotations were received and evaluated, and the proposal submitted by Inland Environments LTD of Beaumont, Texas, was determined to be the lowest responsible and responsive offer, in an amount not to exceed $39,800.00, as reflected in the bid tabulation attached hereto as Exhibit "A"; and WHEREAS, the proposed contract provides for a performance period of ten (10) working days, commencing upon approval of this Resolution and issuance of a Notice to Proceed; and WHEREAS, funding for this project is available in Account No. 307-13-037-8525-00-10-000, Project BU0029; and WHEREAS, the City Council finds that authorizing this contract is necessary to ensure regulatory compliance,protect public health and safety, and preserve a critical municipal facility. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: THAT, the facts and opinions in the preamble are true and correct. THAT, the City Manager is hereby authorized to execute a contract with Inland Environments LTD for asbestos abatement services associated with the roof replacement of the Fleet Maintenance Facility located at 101 H.O. Mills Boulevard, in an amount not to exceed $39,800.00, in substantially the same form as attached hereto as Exhibit "B". Date: 11/11/26 SCOPE OF WORK This asbestos abatement project will include the proper removal, transportation, and disposal of approximately 11,700 square feet of exterior asbestos-containing roofing materials, including all roofing, associated flashing, and lightweight concrete at the City of Port Arthur Service Center located at 101 H.O. Mills Blvd in Port Arthur, Texas. All roofing components are to be removed down to the T-Beam concrete structure. The abatement contractor shall employ wet removal methods throughout the abatement process. The exterior roofing materials are classified as Category I non-friable asbestos- containing materials. Open air abatement is allowed during the removal process; however, visible emissions are strictly prohibited. All abatement work must comply with federal,state and local laws and regulations, including those set forth by OSHA and NESHAP standards. Work area shall be demarcated with a drop cloth placed on the ground below the roof work area. Materials shall be kept wet during removal and promptly bagged for proper disposal. All work shall be conducted to the satisfaction of the Owner and governing authorities. Failure to do so shall not relieve the Contractor of his obligation to furnish all materials and labor necessary to conduct the provisions of the Contract. NESHAP ABATEMENT PROJECT Except as specifically noted, Contractor shall provide and pay for: labor, materials,and equipment and other facilities and services necessary for proper execution and completion of work. Contractor shall comply with codes, ordinances, rules, regulations, orders, and other legal requirements of public authorities(including EPA regulations,AHERA, NESHAP,and OSHA)which bear on performance of work. Where conflicts occur between these specifications and/or the above-mentioned regulations, the more stringent shall govern. If the Contractor observes that any of the Contract Documents are at variance therewith in any respect, he shall promptly notify Consultant or Owner in writing, and any necessary changes shall be accomplished by appropriate modification. Contractor shall enforce strict discipline and good order among employees. Do not employ unfit persons or persons not skilled in assigned tasks on the project. Contractor shall use the best available technology, procedures, and methods for preparation, execution, cleanup, disposal, and safety. This compliance is the sole responsibility of the abatement contractor. Contractor shall coordinate all work schedules with the Owner and Consultant 10 days prior to the start of the work. Contractor shall assume responsibility for the proper and safe execution of the work. Contractor shall not unreasonably encumber the site with materials/equipment. Confine stockpiling of materials to the areas indicated. If additional storage is necessary, obtain and pay for such storage off site. Contractor's supervisors shall remain on the job site and in immediate contact with those under their supervision during all periods of the abatement activity. The Contractor is responsible for respirator fit testing, personal protection of the workers, safety, security, and control of access at the job site, and shall provide a training program to instruct personnel on proper respirator use, hazards of asbestos exposure and OSHA asbestos regulations in accordance with the requirements of the model accreditation program (MAP)established by the EPA in Appendix C to 40 CFR 763 (E). The Contractor shall provide a training program as often as necessary to train all employees to be utilized on the project. No worker shall be utilized on any portion of the Work until training documentation has been reviewed and accepted by the Consultant or Project Manager. Supervisors shall also require that operations at the asbestos job site cease whenever hazardous or unlawful situations are detected, so as to affect a remedy. Ensure that proper PPE is worn while in the work area. Documents:The following documents shall be posted in a conspicuous spot at the entrance to the regulated area and must not be covered by any other documents: Documents required to be on-site include, but is not limited to, the following: O 40 CFR Part 61, Subpart M,titled "National Emissions Standards for Hazardous Air Pollutants (NESHAP), November 20, 1990"; O 29 CFR 1926.1101, titled, "Occupational Exposure to Asbestos, Tremolite, Anthophyllite, October 11, 1994"; O 29 CFR 1910.134, titled, "Occupational Health Standards for A Respiratory Protection Program, October 11, 1994"; and Asbestos warning signs as required by the EPA shall be placed inside all entrances to the work area. Signs must be placed in locations that prohibit entrance to regulated areas by unauthorized personnel. Contractor's employees shall be restricted to the immediate work area at all times. Contractor's dumpster for disposal of asbestos waste must be kept secured. Location of the dumpster must be coordinated with the Owner. Safety Requirements. At least one fire extinguisher with a minimum National Fire Protection Association rating of 10 BC(dry chemical)shall be placed for every 3,000, or fraction square feet of regulated area. Contractor shall also meet the specific safety requirements mentioned in the pre-construction meeting and comply with all requirements of OSHA. Contractor's supervisors shall also require that operations at the asbestos job site cease whenever hazardous or unlawful situations are detected, so as to affect a remedy. Prior to commencement of work, all workers shall be instructed by the Contractor and shall be knowledgeable in the appropriate procedures for personnel protection and asbestos removal. Contractor acknowledges and agrees that he is solely responsible for enforcing worker protection requirements. Provide general cleanup of work areas concurrently with the removal of all asbestos-containing materials and debris. Do not permit accumulation of debris. After removal of asbestos-containing materials and debris, all surfaces in the work area shall be wet-cleaned to remove residual accumulated material. Continue wet cleaning until all surfaces are free of visible dust, dirt, and debris. AIR MONITORING Throughout the preparation and removal operations, air monitoring shall be conducted by the Consultant retained by the Owner to monitor Contractor's compliance with these specifications,and any applicable state and local regulations. Mills Blvd., Port Arthur, TX Page 4 of 6 NESHAP Roof Abatement Project The abatement contractor shall provide, at his own expense, monitoring of his employees as required by applicable regulations, including 29 CFR 1926.1101(f). The Consultant will conduct area monitoring inside the asbestos control area during the work shift. PCM method will be utilized in accordance with NIOSH 7400. REMOVAL OF ASBESTOS-CONTAINING/CONTAMINATED MATERIALS Restrict access to exterior grounds immediately adjacent to work areas by barrier tape or similar means. Wet removal techniques shall be used at all times. All work will be performed in accordance with EPA, OSHA, and DSHS regulations. The area shall have the appropriate asbestos warning signs and barricade tape demarcating the work area. The non-friable category II asbestos waste materials will be disposed of at an approved landfill with the proper waste manifest. This NESHAP abatement project will be conducted with respiratory protection in full accordance with all regulatory requirements including but not limited to the OSHA regulations found in 29 CFR 1926.1101 and 29 CFR 1910.134. Personnel exposure samples collected by or for the Contractor shall be analyzed in accordance with the OSHA reference method (ORM) as detailed in 29 CFR 1926.1101, Appendix A. Post the results of personnel exposure monitoring at jobsite, upon receipt from laboratory. Any required air sampling of contractor personnel will be conducted by a competent person supplied by the Contractor. Permit no visitors, except for governmental inspectors having jurisdiction, in the work areas after commencement of asbestos disturbance or removal. Provide authorized visitors with suitable respirators and protective equipment. Provide workers with sufficient sets of protective disposable clothing, consisting of full body coveralls, head covers, gloves, and foot covers, of sizes to properly fit individual workers. Provide workers with rubber boots, hard hats, eye protection, hearing protection, and other protective equipment as needed. The Contractor and the Contractor's employees shall indemnify the Consultant and the Owner against any claims relating to respiratory protection. 4 Thoroughly wet to satisfaction of Owner's Representative Asbestos-Containing Materials to be removed prior to disturbance to reduce fiber dispersal into the air. Accomplish wetting by a fine spray(mist)of amended water. Saturate material sufficiently to wet to the substrate without causing excess dripping. ASBESTOS WASTE LOG Contractor shall maintain an asbestos waste log to be completed as asbestos-containing waste is removed from the work areas for transport and disposal. Asbestos waste log shall indicate date; description of waste including: number, size and type of waste containers, as applicable, removed from work areas;time of day; and signature of recorder. FINAL CLEANING AND CLEARANCE The entire work area shall be totally visibly clean. The Contractor shall notify the Consultant of the time the work area will be subject for visual inspection. This inspection shall be certified by the Contractor and will be verified by the Consultant using the"Certification of Visual Inspection". The project manager will be authorized to perform the final visual inspection by the Project Consultant. The work area shall have passed visual inspection. After removal of all equipment and containment materials, the work area shall be inspected by the contractor and the Owner's representative before contractor's demobilization. Visual observations will be made by the Consultant or Project Manager after final clean-up and de- mobilization to determine the presence of visible dust, dirt, debris and abatement refuse indicative of improper cleaning and decontamination procedures. DISPOSAL OF ASBESTOS-CONTAINING WASTE Prepare and sign the Waste Shipment Record (WSR)for each load of asbestos-containing waste transported off site. Ensure that the WSR is completed by the transporter(s) and waste disposal site operator. Mark vehicles used to transport asbestos-containing waste material during the loading and unloading of waste in compliance with 40 CFR 61, Subpart M and during the transport of asbestos- containing waste in compliance with 49 CFR 171 and 172. Storage compartments shall be plasticized and sealed with a minimum of one (1) layer of 6-mil polyethylene on the sides and top and two (2) layers of 6-mil polyethylene on the floor. The compartments shall be thoroughly wet cleaned and/or HEPA vacuumed following the disposal of each load of material at the dump site. At the conclusion of the project(or before transport vehicles are used for other purposes), the polyethylene shall be properly removed and disposed of as contaminated waste. After this is accomplished, compartments shall once again be wet cleaned and/or HEPA vacuumed to eliminate all debris prior to being returned to the rental company. All plastic sheeting,tape,cleaning material, including mops and sponges,clothing,filters,and all other contaminated disposable materials shall be packaged, labeled, and disposed of as asbestos- containing waste. Dispose of materials at an authorized disposal site in accordance with the requirements of federal, state, and local disposal authorities. Asbestos-containing waste material shall be treated, packaged, labeled,transported,and disposed of in accordance with 29 CFR 1926.1101 (OSHA), 40 CFR 61.150 (EPA) and 49 CFR 107 et al., (DOT). Asbestos waste transport shall be limited to approved routes for transport of asbestos materials. Ensure that there are no visible emissions to the outside air from site where materials and waste are deposited. Notify the Consultant or Project Manager immediately of any spill or similar incident involving the transport and disposal of asbestos waste.
