R09-40 -REPEAT APPROVAL REQUEST FOR -TRACTS 3-A & 3-B 9 994 ACRES OF LAND REPEAT OF PART OF LOTS 3 4 5 & 6 RANGE "D" PORT ARTHUR LAND COMPANY SUBDIVISION CITY OF PORT ARTHUR. TEFFERSON COUNTY TEXAS (PROPERTY LOCATED NORTH OF PROCTER STREET EXTENSION AND EAST OF MAIN AVENUE, SPEAKING FOR: Anthony Leger (Soutex Surveyor's, Inc.), 3737 Doctors Drive, Port Arthur, TX 77642 SPEAKING AGAINST: NONE Mr. Burton informed the commissioners that five (5) notices were mailed out in relation to the above case; one (1) was returned non-deliverable. Mr. Ramirez asked if any protest had been received and what is the purpose of the replat. Mr. Burton stated that no protest had been received and the Surveyor/Representative of the client was present to answer any question regarding the request. Mr. Leger informed the commissioners that the front of the property is currently and will continuously be used by VFW; the property located in the rear will be leased to TEAM Fabricators for alay-down yard (expansion project). The property will be joint usage. Mr. Simon moved to close the public hearing; Mr. Ramirez seconded the motion, Vote: All Yeas -public hearing closed. III. Mr. Ramirez asked about the plat being non-conforming. Mr. Burton explained to the commissioners that the land was sold to the property owner by deed without the benefit of a plat. The Planning Department requested a replat to ensure property lines have been legally established. Mr. Simon moved to close the public hearing; Ms. LeBlanc seconded the motion. Mr. Ramirez inquired about what surrounds the property in question. Ms. Russell stated that there are homes located east and west of the property, both greater than three (3) acres and to the north is water. All other homes that face the property sit at least 30 feet back from the road. Mr. Cox asked Ms. Bellard is she was in agreement with the 90 person limit that was mentioned in the Planning Department's report. Ms. Bellard stated that she was; however Butch Hass, Senior Building Inspector for the City stated that 106 people will be acceptable and meet the City's occupancy requirements. Parking will have to be adjusted to accommodate occupancy. Page ~ 2 Mr. Cox asked if there was a particular reason why services are not to be provided on Mondays. Ms. Russell informed the commissioners that this matter was discussed with Ms. Bellard and decided that Monday's would be the best day to close due to special events, etc being hosted on the weekend (Friday, Saturday and Sunday) and a recovery day for Ms. Bellard. Mr. Ramirez moved to close the public hearing; Ms. LeBlanc seconded the motion. Vote: All Yeas -public hearing closed. REGULAR MEETING VII. R09-40. R09-41. R09-42 & R09-43 -REPEAT APPROVAL REQUESTED -MOTION REQUIRED Mr. Burton made a recommendation for approval of replat requests R09-40, R09-41, R09-42 & R09-43. Norris Simon moved to accept the Planning Department's recommendation to approve all four replat requests; Fernando Ramirez seconded the motion, Vote: All Yeas -Motion passed. VIII. Z09-03 -ZONING DISTRICT CHANGE APPROVAL REQUESTED -MOTION REQUIRED Mr. Burton made a recommendation for approval of zoning district change request Z09-03 based on the stipulations as discussed at the public hearing requiring occupancy to be changed from 90 persons to 106 persons. Fernando Ramirez moved to accept the Planning Department's recommendation to approve the zoning district change request; Norris Simon seconded the motion. Vote: All Yeas -Motion passed. IX. (acquired by E.D.C.) have submitted all relevant drawings to the City's engineering department, and they have been approved. Based on the drawings that have been submitted for approval, both ponds will be fenced by Chain-linked fencing will be done at the required heights as prescribed by the ordinance. Mr. Ramirez asked, "How will the ponds effect surrounding businesses?" Mr. Burton stated that based on his discussion with Ross Blackketter, Director of Public Works/Engineering Department, the ponds will assist tremendously with overall development of the E.D.C. business park. Alma LeBlanc moved to accept the Planning Department's recommendation to approve the excavation request; Norris Simon seconded the motion. Vote: All Yeas -Motion passed. X.
