No. 24819, authorizing the City Manager to execute the first renewal option of the interlocal agreement between the City of Port Arthur and the Texas Parks and Wildlife Department for a fifty-foot boat slip in the marina on Pleasure Island. Background: The Texas Parks and Wildlife Department currently leases a 50-foot boat slip at the marina on Pleasure Island. The lease is set to expire on April 30, 2026 and they intend to exercise their first one-year renewal option under the lease agreement. Budget Impact: None Recommendation: It is recommended that the City Council approve P.R.No. 24249 authorizing the City Manager to execute the first renewal option of the interlocal agreement between the City of Port Arthur and the Texas Parks and Wildlife Department for a fifty-foot boat slip in the marina on Pleasure Island. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE THE FIRST RENEWAL OPTION WITH THE TEXAS PARKS AND WILDLIFE DEPARTMENT FOR THE STORAGE OF A PATROL BOAT IN A BOAT SLIP AT THE MARINA ON PLEASURE ISLAND WHEREAS, the City of Port Arthur owns and operates a three-hundred-boat slip at the Marina on Pleasure Island; and, WHEREAS, per Resolution 25-136, the City Council approved authorizing the City Manager to execute an interlocal agreement between the City of Port Arthur and the Texas Parks and Wildlife Department for a fifty-foot boat slip in the marina on Pleasure Island for one(1)year, with the option to renew for up to nine (9) additional one (1)year terms; and, WHEREAS, pursuant to Resolution 25-136, the Texas Parks and Wildlife Department currently leases a fifty-foot (50') boat slip at the Marina, with the lease set to expire on April 30, 2026; and, WHEREAS, the Texas Parks and Wildlife Department would like to exercise their first one-year renewal option under the interlocal agreement for the fifty-foot boat slip in the marina on Pleasure Island, as delineated in Exhibit"A". NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR,TEXAS: THAT,the facts and opinions in the preamble are true and correct; and, THAT, the City Council hereby authorizes the City Manager to execute the first renewal option of the interlocal agreement between the City of Port Arthur and the Texas Parks and Wildlife Department for a fifty-foot boat slip in the marina on Pleasure Island, as delineated in Exhibit"A"; and, P. Pursuant to Executive Order GA-48 of the Governor of Texas, Lessor certifies that it, nor its holding companies or subsidiaries, is: (a) Listed in Section 889 of the 2019 National Defense Authorization Act; (b) Listed in Section 1260H of the 2021 National Defense Authorization Act; or (c) Owned by the government of a country on the U.S. Department of Commerce's foreign adversaries list under 15 C.F.R. Section 791.4; or (d) Controlled by any governing or regulatory body located in a country on the U.S. Department of Commerce's foreign adversaries list under 15 C.F.R. Section 791.4. Except as provided herein, all Contract Terms and Conditions remain unchanged and in full force and effect.
