Project No. ST5106.CON Street Capital Account No. 307-21-053-8517-00-10-000. PaveCon, LTD, of Houston, Texas Introduction: The intent of this memorandum is to request City Council's approval of Amendment No. 1 to the construction agreement with PaveCon, LTD, of Houston, Texas (PaveCon), for the Redbird Street Rehabilitation Project — Green Avenue to Jefferson Drive,for a 100-calendar-day time extension. Background: Due to the large number of streets needing repair, Purchasing has sought additional ways to bring in more contractors to repair them. Purchasing found PaveCon as a contractor on the BuyBoard Cooperative Contract for road repair. Purchasing and Engineering met with the PaveCon representative and requested a quote for the rehabilitation of Redbird Street - Green Avenue to Jefferson Drive. PaveCon also met with Water Utilities { regarding utility work needed on Redbird Street, Green Avenue, and Jefferson Drive. PaveCon submitted a quote of$678,349.66 for this work. Pursuant to Resolution No.25-3654,the City Council awarded the construction contract to PaveCon for a contract amount of$678,349.66 for the rehabilitation of Redbird Street—Green Avenue to Jefferson Drive,extending from Sabine Avenue to Neches Avenue, at either end of the street. Amendment No. 1 is being submitted by PaveCon for a 100-calendar-day extension due to the unknown condition of the existing sewer line,in the event the sewer line needs to be replaced. It is assumed that approximately 650 LF of existing sewer line and 10 sewer taps will need to be replaced between Wignall Avenue and Jefferson Drive. These changes have no impact on the contract price. Budget Impact: Project No. ST5106.CON Street Capital Account No. 307-21-053-8517-00-10-000. Recommendation: It is recommended that the City of Port Arthur's City Council approve PR No. 24826 for Amendment No. 1 to the construction agreement with PaveCon,the Redbird Street Rehabilitation Project—Green Avenue to Jefferson Drive, for a 100-calendar-day time extension. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT NO. 1 TO THE CONSTRUCTION CONTRACT WITH PAVECON, LTD., OF HOUSTON, TEXAS, FOR THE REDBIRD STREET REHABILITATION PROJECT FROM GREEN AVENUE TO JEFFERSON DRIVE; PROVIDING FOR A (100) CALENDAR DAY TIME EXTENSION; PROVIDING FOR FUNDING FROM STREET CAPITAL ACCOUNT NO. 307- 21-053-8517-00-10-000, PROJECT NO. ST5106.CON WHEREAS, the Engineering Department of the City of Port Arthur conducts periodic roadway condition assessments and reviews historical maintenance data to identify streets requiring reconstruction, remediation, or rehabilitation; and WHEREAS,based upon such assessments, Redbird Street between Green Avenue and Jefferson Drive was identified as requiring rehabilitation and was recommended for inclusion in the City's street improvement program; and WHEREAS, due to the significant number of streets in need of repair, the Purchasing Division explored additional procurement methods to increase contractor participation and expedite street rehabilitation projects, including the use of cooperative purchasing programs; and WHEREAS, the Purchasing, Utilities, and Engineering Departments jointly identified PaveCon, Ltd., of Houston, Texas, as a qualified contractor through the BuyBoard Cooperative Purchasing Program; and WHEREAS, the City provided PaveCon, Ltd. with a bid table, project layout, and the City of Port Arthur's applicable standards and specifications for the purpose of obtaining a cost proposal for the rehabilitation of Redbird Street from Green Avenue to Jefferson Drive; and WHEREAS, PaveCon, Ltd. submitted a BuyBoard-compliant proposal in the amount of $678,349.66 for the Redbird Street Rehabilitation Project; and WHEREAS, staff from the Utilities and Engineering Departments reviewed the proposal and determined that the pricing submitted by PaveCon, Ltd. was reasonable and competitive with similar street rehabilitation projects; and WHEREAS, Chapter 271, Subchapter D, of the Texas Local Government Code authorizes municipalities to participate in cooperative purchasing programs through a resolution adopted by the governing body, including programs such as the BuyBoard Cooperative Purchasing Program, as an alternative to traditional competitive bidding; and PR 24826 03/04/2026 RLD WHEREAS, pursuant to Resolution No. 25-365, the City Council authorized a construction contract with PaveCon, Ltd., in the amount of$678,349.66 for the Redbird Street Rehabilitation Project from Green Avenue to Jefferson Drive; and WHEREAS, during the course of project planning and coordination with the Utilities Department, it was determined that the existing sanitary sewer line within the project corridor may require replacement due to unknown field conditions; and WHEREAS, it is anticipated that approximately 650 linear feet of existing sewer line and approximately 10 sewer service taps located between Wignall Avenue and Jefferson Drive may require replacement depending on the condition of the existing infrastructure; and WHEREAS, PaveCon, Ltd. has requested Amendment No. 1 providing for a 100-calendar-day extension of the contract time to accommodate potential utility replacement work and associated delays; and WHEREAS, the proposed amendment does not increase the contract price and is necessary to allow sufficient time to address potential sewer line replacement if field conditions require such work; and WHEREAS, City staff recommends approval of Purchase Requisition No. 24826 and Amendment No. 1 to the construction contract as being in the best interest of the City of Port Arthur. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: THAT, the facts and opinions in the preamble are true and correct; and, THAT, the City Council hereby approves Amendment No. 1 to the construction contract with PaveCon, Ltd., of Houston, Texas, for the Redbird Street Rehabilitation Project from Green Avenue to Jefferson Drive, providing for a (100) calendar day extension of the contract time due to unknown field conditions related to the existing sewer line and the potential replacement of approximately (650) linear feet of sewer line and (10) sewer service taps between Wignall Avenue and Jefferson Drive, as more particularly described in Exhibit "A"; and THAT, funding for the project is available in Street Capital Account No. 307-21-053-8517-00- 10-000, Project No. ST5106.CON. THAT, a copy of the Resolution shall be spread upon the Minutes of the City Council.
