NO. 7406 03/11/2026 RPC ORDINANCE No. AN ORDINANCE OF THE CITY OF PORT ARTHUR, TEXAS, AMENDING CHAPTER 78. PERSONNEL, ARTICLE II. PERSONNEL POLICY, DIVISION 3. APPOINTMENT AND SEPARATION, SECTION 78-103 OF THE CODE OF ORDINANCES To ELIMINATE THE NEED FOR A THIRD PARTY ADMINISTRATOR To FACILITATE EACH APPOINTED POSITION'S PERFORMANCE EVALUATION;PROVIDING A SAVINGS AND SEVERABILITY CLAUSE; AND PROVIDING AN EI'FECTIVE DATE. WHEREAS,the City of Port Arthur,Texas,is a home-rule municipality in the State of Texas("City"); and WHEREAS, pursuant to the City's Charter, the City Council appoints the City Manager, City Attorney, City Secretary, and Municipal Court Judge; and WHEREAS,the City Council wants to amend Section 78-103 of its Code of Ordinances to eliminate the need for a third-party administrator to facilitate the performance evaluations of its appointees. WHEREAS, the City Council agrees to conduct performance evaluations in compliance with each appointee's applicable contract, the City Charter, and the City Personnel Policy. Now THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR,TEXAS: SECTION 1. That the facts and recitals above are true and correct. SECTION 2. That Chapter 78. Personnel, Article II. Personnel Policy, Division 3. Appointment and Separation, Section 78-103 of the Code of Ordinances of the City of Port Arthur, Texas, is hereby amended to read as follows: Sec. 78-103. -Evaluating employee performance. (a) At the end of each two-month period during each employee's probationary period, the performance of each probationary employee shall be evaluated,in writing,by the appropriate supervisor, and such rating shall be reviewed by each higher level of authority up to and including the department head.The evaluation shall be filed with the human resources office. Performance evaluations shall be conducted on an annual basis, coincident with the anniversary date, after completion of the probationary period. DRAFT-Subject to City Council Approval on 03/24/2026—Page 1 (b) Performance evaluations of the appointed positions as set forth in article V (city manager), article VI(city attorney),article VII(city secretary),and article VIII(judge of the municipal court),of the City Charter; shall be facilitated by a third party administrator at the direction ef conducted by the city council in compliance with each appointee's applicable contract terms, the City Charter and the City Personnel Policy. Upon completion of the evaluation process, the performance evaluation will be placed in the employee's personnel file. SECTION 3. This Ordinance shall take effect immediately from and after the date of passage and is so resolved. SECTION 4. That a copy of the caption of this Ordinance shall be spread upon the Minutes of the City Council.
