Introduction:
The intent of this memorandum is to request City Council's approval of Amendment No. 1 to the
construction agreement with Norman Highway Constructor, Inc., of Orange, Texas, for the Sixty
(60) Storm Sewer Brick Manhole Replacement Project, for a 180-calendar-day time extension.
Background:
The Texas General Land Office (GLO) working with the Department of Housing and Urban
Development's Community Development Block Grant Disaster Recovery (CDBG-DR) has
made available grant funds for disaster relief. This grant is provided for financial assistance for
expenses related to long term recovery,restoration of infrastructure,mitigation,emergency relief
and housing. These funds, under Executive Order 12892, were to be used in areas that were
most impacted and distressed resulting from the 2019 Texas Severe Storms and Flooding or
Tropical Storm Imelda, also referred to,individually and collectively, as the 2019 Disasters.
Pursuant to Resolution No. 22-315, the Port Arthur City Council approved the City's
participation in applying for the CDBG-DR funds. The City's application was successful and
grant monies were awarded under the CDBG-DR Federal Award Number B-19-DF-48-0001 on
March 22, 2021. GLO Contract No. 24-067-034-E222 has since been forwarded to the City
outlining the scope of the project, funds allocated, location of the manholes, reporting,
reimbursement requests, and limitations of grant expenditures, to name a few.
Pursuant to Resolution No. 25-448,the City Council awarded a construction contract to Norman
Highway Constructors, Inc., in the amount of$1,118,00.00 for the Sixty Storm Sewer Brick
Manhole Replacement Project.

During construction, project progress was delayed due to differing site conditions including
significant deterioration and damage of the connecting lines and the rerouting of water lines in the vicinity
which will require additional time and resources to address appropriately, ensuring both the quality and
safety standards expected of the deliverables are maintained. The delay was mutually discussed and
agreed upon by Norman Highway Constructors, Inc. and the City's Engineering Department, and
although the need for such consideration was not anticipated at the outset of the project,the Engineering
Department has since reviewed the circumstances and determined that the requested time extension is
reasonable and necessary for the proper completion of the project.
Amendment No. 1 is being submitted by Norman Constructors, Inc. for a 180-calendar-day time
extension due to delay associated with the emergence of unforeseen site conditions that have significantly
impacted the project schedule.
Budget Impact:
Funds are not impacted at this time. Account No.: 148-00-000-8517-00-10-000. Project No.
GM2402.GRE.DRA
Recommendation:
It is recommended that the City of Port Arthur's City Council approve PR No. 24834 for
Amendment No. 1 to the construction agreement with Norman Highway Constructors, Inc., of
Orange, Texas, for the Sixty (60) Storm Sewer Brick Manhole Replacement Project, for a 180-
calendar-day time extension.

A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE
AMENDMENT NO. 1 TO THE CONSTRUCTION CONTRACT WITH NORMAN
HIGHWAY CONSTRUCTORS, INC., OF ORANGE, TEXAS, FOR THE STORM
SEWER BRICK MANHOLE REPLACEMENT PROJECT, PROVIDING FOR A
ONE HUNDRED EIGHTY (180) CALENDAR DAY TIME EXTENSION;
PROVIDING FOR FUNDING FROM DRAINAGE SYSTEM ACCOUNT NO. 148-
00-000-8515-00-10-000. PROJECT NO. GM2402.GRE.DRA.
WHEREAS, the City of Port Arthur was impacted during the 2019 Disasters that overwhelmed
its sewer systems with flood waters that threatened public health, safety and welfare; and,
WHEREAS, the City of Port Arthur applied for grant funds through the Texas General Land
Office (GLO) for financial assistance with disaster recovery; and,
WHEREAS,the City of Port Arthur was successful in meeting all eligibility requirements,being
a distressed area resulting from the 2019 tropical storms and flooding and pursuant to Resolution No.
22-315, the City of Port Arthur's City Council approved participation in the grant funding program; and,
WHEREAS, the General Land Office (GLO) through Housing and Urban Development (HUD)
awarded Community Development Block Grant — Disaster Recovery (CDBG-DR) funds to the City of
Port Arthur under Award Number B-19-DF-48-0001 on March 22, 2021; and,
WHEREAS, under Proposed Ordinance 7230 the City of Port Arthur's City Council approved
the local match of$10,000.00; and,
WHEREAS, the Public Works Department — Engineering Division has identified sixty (60)
storm sewer manholes in various locations that will be demolished and replaced along with associated
appurtenances; and,
WHEREAS, the Purchasing Department advertised for interested parties to bid on the project on
April 30, 2025 and May 7, 2025, respectively, under Bid No. P25-053; and,
WHEREAS, on July 16, 2025, the City received and opened four (4) sealed bids for the Storm
Sewer Brick Manhole Replacement Project from Norman Highway Constructors, Inc., of Orange,

Texas; Global Drilling, Inc., of Winnie, Texas; Brystar Contracting, Inc., of Beaumont, Texas; and,
SETEX Construction Corp., of Port Arthur, Texas; and,
WHEREAS, pursuant to Resolution No. 25-448, the City Council awarded a construction
contract to Norman Highway Constructors, Inc. in the amount of $1,118,000.00 for the Storm Sewer
Brick Manhole Replacement Project; and,
WHEREAS, during the course of construction, project progress was delayed due to differing
site conditions including significant deterioration and damage of the connecting lines and the rerouting
of water lines in the vicinity which will require additional time and resources to address appropriately,
ensuring both the quality and safety standards expected of the deliverables are maintained; and
WHEREAS,Norman Highway Constructors, Inc. has submitted Amendment No. 1 requesting a
180-calendar-day extension to accommodate the delay associated with the emergence of unforeseen site
conditions that have significantly impacted the project schedule; and
WHEREAS, the Engineering Department has reviewed the request and determined that the
requested time extension is reasonable and necessary for the proper completion of the project; and,
WHEREAS, approval of Purchase Requisition No. 24834 for Amendment No. 1 to the
construction contract is deemed to be in the best interest of the City of Port Arthur.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PORT ARTHUR,TEXAS:
THAT,the facts and opinions in the preamble are true and correct; and,
THAT, the City Council hereby approves Amendment No. 1 to the construction contract with
Norman Highway Constructors, Inc., of Orange, Texas, for the Storm Sewer Brick Manhole Project,
providing for a (180) calendar day extension of the contract time due to differing site conditions
including significant deterioration and damage of the connecting lines and the rerouting of water lines in
the vicinity which will require additional time and resources to address appropriately, ensuring both the

quality and safety standards expected of the deliverables are maintained, as more particularly described
in Exhibit"A"; and
THAT, a copy of the Resolution shall be spread upon the Minutes of the City Council.

I am writing to formally request an extension of 180 additional working days for
the completion of the project. This request is necessitated by the emergence of
unforeseen site conditions that have significantly impacted on our ori inal project
schedule.
These differing site conditions include sign ificant deterioration and damage of the
connecting lines and the rerouting of water lines in the vicinity which will require
additional time and resources to address appropriately, ensuring both the quality
and safety standards expected of our deliverables are maintained.
Because this work was not visible or quantifiable during the original evaluation
and the additional repairs required fall outside the scope of anticipated
conditions, we are making this request. Please let us know if further
documentation or clarification is needed regarding the nature of the site
conditions or the impact on the schedule.
This extension is both reasonable and necessary to ensure the project is
completed correctly and without compromising workmanship or compliance
requirements.
We remain committed to maintaining open communication and to delivering a
successful project outcome.
