Re: P.R 24905—A resolution authorizing the City Manager to execute change orders No.3,4
and 5 for Phase II and Phase III reconstruction and drainage repairs at the H.O.Mills
Maintenance Facility
Nature of Request: Authorize the City Manager to execute change orders No. 3,4 and 5 in the amount
of$61,330.37 to Construction Managers of Southeast Texas, LLC. for Phase II and Phase III
reconstruction and drainage repairs at the H.O.Mills Maintenance Facility.
Background: Pursuant to Resolution No. 25-446, City Council awarded a contract to Construction
Managers of Southeast Texas, LLC. for Phase II and Phase III reconstruction and drainage repairs at
the H.O. Mills Maintenance Facility in the amount not to exceed $1,114,939.19. Per Resolution No.
26-102 City Council approved change orders No. 1 and 2,in the amount of$67,002.50,for a new contract
amount of$1,181,941.69.
Upon excavating the project site,contaminated soil was discovered which requires controlled removal and
disposal by the contractor. In addition, a tree abutting the new road needs to be removed to prevent future
damages. In addition,the contractor has been requested to install additional curb to prevent vehicles driving
on the adjacent grass. These items have resulted in change orders No.3,4 and 5 in the amount of$61,330.37,
for a new contract amount of$1,243,272.06. A detailed breakdown of change orders No. 3, 4 and 5 is
provided in the packet
Recommendation: It is recommended that the City Council approve proposed P.R. 24905. This
resolution would authorize the City Manager to execute on behalf of PAT change orders No. 3, 4 and
5.
Budgetary/Fiscal Effect: Funding to pay for the construction services is available in Account Funds
3 07-13-03 7-8 5 25-00-10-000.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE
ORDERS NO. 3, 4 AND 5 FOR THE CONTRACT BETWEEN THE CITY OF PORT
ARTHUR AND CONSTRUCTION MANAGERS OF SOUTHEAST TEXAS OF
BEAUMONT, TEXAS, INCREASING THE CONTRACT AMOUNT BY $61,330.37 TO A
NEW CONTRACT TOTAL OF $1,243,272.06 FOR THE PHASE II AND III ROADWAY
AND DRAINAGE RECONSTRUCTION AT 101 H.O. MILLS BOULEVARD; FUNDS
ARE AVAILABLE IN ACCOUNT 307-13-037-8525-00-10-000.
WHEREAS, pursuant to Resolution No. 25-446, the City Council authorized the City
Manager to enter into a contract with Construction Managers of Southeast Texas,LLC for Phase
II and Phase III reconstruction and drainage repairs at the H.O. Mills Maintenance Facility in an
amount not to exceed$1,114,939.19;and
WHEREAS, pursuant to Resolution No. 26-102, the City Council approved change
orders No. 1 and 2, in the amount of$67,002.50, for a new contract amount of $1,181,941.69;
and
WHEREAS, the need to remove a tree adjacent to the new road and an inspection of the
underground drainage system has resulted in change order No. 3 in the amount not to exceed
$8,300.00 as delineated in Exhibit "A";and
WHEREAS, the need for additional curb has resulted in Change Order No. 4 in the
amount not to exceed $381.20 as delineated in Exhibit"B";and
WHEREAS, the need to remove and dispose of contaminated soil has resulted in Change
Order No. 5 in the amount not to exceed $52,649.17 as delineated in Exhibit "C"; and
WHEREAS, Port Arthur Transit(PAT)is recommending that the City of Port Arthur, by
its City Manager, approve Change Orders No. 3, 4 and 5 for a net project increase of$61,330.37
for a new contract amount not to exceed $1,243,272.06 as delineated in Exhibits "A", `B" and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR, TEXAS:
THAT,the facts and opinions in the preamble are true and correct.
THAT, the City Manager is authorized to execute Change Orders No. 3, 4 and 5
(Exhibits "A", "B" and "C") as delineated and outlined above. Funding shall be provided
through Account No. 307-13-037-8525-00-10-000.
THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City
Council.
