RESOLUTION NO.
A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A
CHAPTER 380 ECONOMIC DEVELOPMENT AGREEMENT WITH
PLEASUREYELAND, LLC FOR THE DEVELOPMENT OF A WATERPARK AND
PUBLIC IMPROVEMENTS ON PLEASURE ISLAND
WHEREAS,Chapter 380 of the Texas Local Government Code authorizes municipalities
to establish and provide economic development programs and to make loans and grants of
public funds for the purpose of promoting local economic development and stimulating
business and commercial activity; and
WHEREAS, PleasurEyeland, LLC, formerly known as Selim Kiralp, LLC, is acquiring
certain real properties located on Pleasure Island,as depicted in Exhibits "A-1" and"A-2", for
the purpose of developing a waterpark and public improvements; and
WHEREAS, PleasurEyeland, LLC intends to develop and construct a waterpark and
public improvements (i.e. water lines, sanitary sewer lines, storm sewers, roads and other
ancillary public improvements) for the purpose of attracting visitors,generating tourism,and
creating employment opportunities for local residents, thereby promoting economic
development and stimulating business and commercial activity within the City; and
WHEREAS,it is deemed in the public's interest that the City Council approve a Chapter
380 Economic Development Agreement with PleasurEyeland, LLC, in substantially the same
form as attached hereto as Exhibit"B".
NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT
ARTHUR,TEXAS:
Section 1. That the facts and opinions in the preamble are true and correct.
Section 2. That the City Council hereby finds that the execution of a Chapter 380
Economic Development Agreement with PleasurEyeland, LLC serves a valid public purpose
and is in the best interest of the City and its citizens; and
Section 3. That the City Manager is hereby authorized to execute a Chapter 380
Economic Development Agreement with PleasurEyeland, LLC for the development of a
waterpark and public improvements on Pleasure Island, in substantially the same form,
attached as Exhibit"B"; and
Section 4. That a copy of the caption of this Resolution be spread upon the Minutes
of the City Council.
