RE: Proposed Resolution No. 24892
The City Council approved Resolution No. 25-040 in January of 2025 for Phase IV repairs to
Rosehill Manor. The City Council approved Resolution Number 23-133 in March of 2023 for
architectural plans, drawings, and paperwork needed for approval from the Texas Historical
Commission and oversight of correct restoration and repairs.
ANALYSIS/CONSIDERATION:
Phase IV repairs and renovations to Rosehill Manor have been completed by Marsh
Waterproofing, Inc., of Vidor, Texas, in accordance with the contract approved by City Council
pursuant to Resolution No. 25-040.
Previously, the City Council approved Resolution No. 23-133, authorizing LaBiche Architectural
Group to provide architectural plans, construction oversight, and coordination with the Texas
Historical Commission for the restoration and repair work associated with Rosehill Manor.
Thereafter, the City publicly solicited bids for Phase IV repairs and renovations, which were
advertised in The Port Arthur News on July 31, 2024, and August 7, 2024. Marsh Waterproofing,
Inc. submitted the sole responsive bid in the amount of $375,000.00 and was subsequently
awarded the contract.
The contractor has now completed all work required under the contract and has submitted all
required project closeout documentation, including the Certificate of Substantial Completion
dated March 2, 2026, Contractor's Certificate and Release, Contractor's Warranty, Contractor's
Guarantee, Contractor's Certificate of Debts Paid, and Request for Release of Retainage.
City staff and LaBiche Architectural Group have inspected the completed work and determined
that the project has been satisfactorily completed in accordance with the approved plans,
specifications, and contract documents.
RECOMMENDATION
A resolution authorizing the city manager to accept close-out documents submitted by Marsh
Waterproofing, Inc of Vidor, Texas, and approve the release of retainage of$18,750.00 for Phase
IV repairs and renovations to Rosehill Manor.

TO ACCEPT THE CLOSE-OUT DOCUMENTS
SUBMITTED BY MARSH WATERPROOFING, INC. OF
VIDOR, TEXAS, FOR PHASE IV REPAIRS AND

APPROVING THE RELEASE OF RETAINAGE IN THE
AMOUNT OF $18,750.00; FUNDING AVAILABLE IN

WHEREAS, pursuant to Resolution No. 23-133, the City authorized a contract with
LaBiche Architectural Group for the preparation of architectural plans and specifications,
submission of required documentation to the Texas Historical Commission, and construction
oversight for restoration and repair associated with Phase IV renovations to Rosehill Manor; and
WHEREAS, the City of Port Arthur Purchasing Division advertised for bids for Phase
IV repairs and renovations to Rosehill Manor in The Port Arthur News on July 31, 2024, and
August 7, 2024; and
WHEREAS, Marsh Waterproofing, Inc., of Vidor, Texas, submitted the sole responsive
bid in the amount of $375,000.00, after a thorough review, the contract was subsequently
awarded via Resolution No. 25-040, in January 2025, to Marsh Waterproofing, Inc., and
WHEREAS, Marsh Waterproofing, Inc. has completed all work required under the
contract and has submitted all required closeout documents, including the Certificate of
Substantial Completion dated March 2, 2026, attached hereto as (Exhibit"A") together with the
Contractor's Certificate and Release (Exhibit "B"), Contractor's Certificate of Warranty
(Exhibit "C"), Contractor's Certificate of Guarantee (Exhibit "D"), Contractor's Certificate of
Debts Paid(Exhibit"E"), and Release of Retainage Request(Exhibit"F"); and
WHEREAS, the work has been inspected by City staff and LaBiche Architectural Group
and has been found to be complete and satisfactory in accordance with the contract documents;
and
WHEREAS, pursuant to the terms of the contract, five percent (5%) retainage was
withheld from payments made to Marsh Waterproofing, Inc., and the contractor has requested
release of retainage in the amount of Eighteen Thousand Seven Hundred Fifty Dollars
($18,750.00), as reflected in the Release of Retainage request attached hereto as Exhibit"F"; and
WHEREAS, the City staff finds that acceptance of the project close-out documents,
execution of the Certificate of Acceptance, and release of retainage are in the best interests of the
City of Port Arthur.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
