Nature of the Request:
The Fire Department, Police Department, and Emergency Management recommend that the
City Council approve Proposed Resolution 24920 authorizing the City Manager to execute a
Memorandum of Understanding (MOU) Between The City Of Port Arthur and the Industrial
Safety Training Council (ISTC) of Jefferson County, Texas to provide services, supplies,
accommodations, or conference rooms in the case of an emergency or disaster with the term
being from June 1, 2026 To May 31, 2028.
Staff Analysis, Considerations:
In 2024, the City Council approved Resolution 24-195, which authorized the City Manager
to enter into a non-exclusive contract (MOU) with the Industrial Safety Training Council
(ISTC) for use of their facility as an alternate shelter location for essential employees if/when
an evacuation has been ordered. The original MOU was for a two-year period from May 1,
2024, to May 1, 2026.
The City desires to enter into a new non-exclusive contract with Industrial Safety Training
Council for the use of its facility for emergency operations and shelter, as it is in the best
interests of the City and its citizens. The term is from June 1, 2026, to May 31, 2028.
This MOU does not stipulate any changes, impose any additional burdens, or alter the City of
Port Arthur's current emergency and disaster response practices.
Recommendations:
The Fire Department, Police Department, and Emergency Management recommend approval
of this resolution.
Budget Considerations:
There are no new costs or budgetary requirements associated with this MOU.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER
INTO A NON-EXCLUSIVE CONTRACT BETWEEN THE CITY OF PORT
ARTHUR AND THE INDUSTRIAL SAFETY TRAINING COUNCIL(ISTC)
OF JEFFERSON COUNTY, TEXAS, TO PROVIDE SERVICES,
SUPPLIES,ACCOMMODATIONS,AND CONFERENCE ROOMS IN THE
CASE OF AN EMERGENCY OR DISASTER, WITH THE TERM BEING
FROM JUNE 1,2026, TO MAY 31,2028.
WHEREAS,the City of Port Arthur desires to enter into a non-exclusive contract with
the Industrial Safety Training Council(ISTC) of Jefferson County,Texas to provide services,
supplies, accommodations, or conference rooms in case of an emergency, as delineated in
Exhibit"A", with the term of the Agreement being from June 1, 2026 to May 31, 2028, with
an option to renew for two additional two-year periods; and
WHEREAS, in the event the City of Port Arthur experiences an imminent threat of
severe damage to property and the Mayor declares a local disaster pursuant to §418 and §433
of the Texas Government Code,the City of Port Arthur may have an urgent need for the use of
a facility to conduct emergency operations; and
WHEREAS, this emergency operations facility may be used as a meeting and/or
temporary sheltering location for essential employees and officials for the provision of service
to the City during the pendency of the disaster; and
WHEREAS,the Industrial Safety Training Council has a facility located at 3749 US-
69, Beaumont, Jefferson County, Texas, which is suitable for these emergency operations
and shelter; and
WHEREAS, the City of Port Arthur previously approved, by resolution 24-195, a non-
exclusive contract with the ISTC of Jefferson County, Texas, to provide the aforementioned
services. The agreement expired May 1, 2026; and
WHEREAS, the City desires to enter into a new non-exclusive contract with Industrial
Safety Training Council for the use of its facility for emergency operations and shelter, as it is
in the best interest of the City and the Citizens of Port Arthur.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR,TEXAS:
Section 1. That the facts and opinions in the preamble are true and correct.
Section 2. That the City Manager is herein authorized to enter into a non-exclusive
contract with the Industrial Safety Training Council of Jefferson County, Texas, as to provide
services, supplies, accommodations, or conference rooms in case of an emergency, in
substantially the same form as delineated in Exhibit "A", with the term being from June 1,
2026 to May 31, 2028, with an option to renew for one additional two-year period.

Section 3. That a copy of the caption of this resolution shall be spread upon the Minutes
of the City Council.

MEMORANDUM OF UNDERSTANDING
FOR USE OF THE INDUSTRIAL SAFETY TRAINING COUNCIL FACILITY
AS AN EMERGENCY OPERATIONS CENTER AND SHELTER
FOR THE CITY OF PORT ARTHUR
WHEREAS, this Memorandum of Understanding is made and entered into
between the Industrial Safety Training Council of Jefferson County, Texas (hereinafter
"ISTC"), and the City of Port Arthur, Jefferson County, Texas (hereinafter"City"); and
WHEREAS, in the event the City of Port Arthur experiences an imminent threat
of severe damage to property and the Mayor declares a local disaster pursuant to §418
and §433 of the Texas Government Code, the City of Port Arthur may have an urgent
need for the use of a facility to conduct emergency operations; and
WHEREAS, this emergency operations facility may be used as a meeting and/or
temporary sheltering location for essential employees and officials for the provision of
service to the City during the pendency of the disaster; and
WHEREAS, the ISTC is the owner of a facility located at 3749 US 69, which is
suitable for these emergency sheltering operations; and
WHEREAS, the City desires to execute an agreement with ISTC for the use of its
facility as an emergency operations center and shelter.
NOW THEREFORE, it is mutually agreed between the parties as follows:
1. That the City and ISTC desire to reach an understanding that will result in
making the facility available to provide shelter and other essentials to
employees, officers, and officials affected by a declared disaster.
2. That the facility shall be used as a shelter and emergency operations center
for the City for use by the emergency management staff along with other
employees, officials, and officers, to help prepare them to quickly respond to
the needs of the City to alleviate the suffering of the victims of the declared
disaster.
3. The City will be responsible for all expenses or damages related to its use of
the facility. The City will maintain all documentation related to the facility's
use and seek reimbursement from the federal government for expenses
incurred by ISTC.
4. That the City will provide security and traffic control at the facility during the
time the facility is being utilized during the declared disaster. The City will also
reimburse ISTC for fuel used in generators during the pendency of the
disaster.

5. This agreement commences on June 1, 2026, through May 31, 2028.
With an option to renew for one additional two-year period. Depending
on the nature of the disaster, the parties agree to further negotiate
additional terms, if necessary, upon mutual agreement.
