A RESOLUTION AUTHORIZING THE CITY MANAGER TO
PURCHASE A VACANT TRACT OF LAND LOCATED AT 1140 JAMES
AVENUE (PID #36537) FROM KHANG AND NANCY BUI FOR THE
PURPOSE OF CONSTRUCTING A NEW LIFT STATION, AT THE
PURCHASE PRICE OF $15,000.00,PLUS ESTIMATED CLOSING COSTS
OF $2,500.00, FOR A TOTAL PROJECTED BUDGETARY AMOUNT OF
$17,500.00; FUNDS ARE AVAILABLE IN ACCOUNT NO. 410-00-000-
8511-00-00-000, LAND
WHEREAS, the City has been strategically planning for the replacement of the
dilapidated Lewis Drive Lift Station in order to improve wastewater infrastructure reliability and
ensure continued adequate service to residents in the Lewis Drive and Jefferson Drive area; and
WHEREAS, the City has identified a suitable location at 1140 James Avenue (PID
36537) as depicted in Exhibit"A", for the new lift station improvements; and
WHEREAS, the City has negotiated in good faith with the property owner, Khang and
Nancy Bui, to acquire the vacant tract of land necessary to replace the former Lewis Drive Lift
Station; and
WHEREAS, the City Council finds that acquisition of the property is in the best interest
of the City and its residents and will facilitate the timely development of the new lift station.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR,TEXAS:
Section 1. That the facts and recitals in the preamble are true and correct.
Section 2. That the City Council hereby authorizes the City Manager and City
Attorney to acquire the vacant tract of land located at 1140 James Avenue (PID #36537) from
Khang and Nancy Bui for the purchase price of $15,000.00, plus estimated closing costs of
$2,500.00, for a total projected budgetary amount of$17,500.00.
Section 3. That funding for this property acquisition is available in the Account No.
410-00-000-8511-00-00-000, Land.
Section 4. That the City Manager and the City Attorney shall be authorized to
execute the necessary closing documents and accept the deed for conveying the property to the
City.
Section 5. That a copy of the caption of this Resolution be spread upon the Minutes
of the City Council.
