Duriso, Chief of Police RE: PR 24925 Authorization for City Manager to negotiate a Contract with Sigma Engineers Inc. of Beaumont, TX RFQ P26-023 for (Design for Renovation and Expansion of Existing Building into a Port Arthur Police Department Field Office at 3535 Gates Blvd) Introduction: The intent of this Agenda Item is to seek the City Council's approval for the City Manager to negotiate a professional services agreement with Sigma Engineers Inc., Beaumont, Texas, for architectural, civil, and structural engineering services related to the renovation of and additions to the existing building located at 3535 Gates Boulevard. The proposed project consists of renovating and modernizing an existing building to serve as a Port Arthur Police Department Field Office to support public safety operations with the City of Port Arthur. This project is intended to improve emergency response capabilities, operational efficiency, interdepartmental coordination, and delivery of public safety services to residents and businesses throughout the community. Background: The City of Port Arthur issued RFQ P26-023 —seeking qualified architectural and engineering firms to provide design services for the renovation and conversion of an existing building into a Port Arthur Police Department Field Office. Statements of qualifications were received. An evaluation committee reviewed and scored each submission based upon the published criteria in the RFQ, including experience with similar public safety facilities, technical competence, project approach, and demonstrated capacity to perform. Based on the evaluation matrix, Sigma Engineers Inc., of Beaumont, Texas, received the highest overall ranking and was determined to be the most qualified firm. The proposed field office is not intended to replace the City's police station. Instead,it will serve as a secondary operational site for specialized activities and support functions currently performed by the Police Department that cannot be adequately accommodated within the existing police headquarters due to departmental growth, increased operational demands, and limited expansion opportunities at the current location. The renovations will allow the Police Department to improve organization, enhance operational capacity,provide secure and centralized storage for records,and create a dedicated training space to better support personnel development and public safety operations throughout the City. The renovation effort will also include interior demolition, replacement, and upgrading of major building systems, site and parking improvements, technology infrastructure enhancements, and modifications necessary to support modern law enforcement and emergency operations. Budget Impact: Funding for professional design services will be allocated from the Capital Improvement Fund Account 307-17-045-8512-00-30-000,upon contract execution. The final contract amount will be negotiated in accordance with the RFQ requirements and the available budget. A RESOLUTION AUTHORIZING THE CITY MANAGER TO NEGOTIATE A PROFESSIONAL SERVICES AGREEMENT WITH SIGMA ENGINEERS INC,OF BEAUMONT,TX,FOR ARCHITECTURAL AND ENGINEERING DESIGN SERVICES RELATED TO THE RENOVATION OF 3535 GATES BOULEVARD INTO A PORT ARTHUR POLICE DEPARTMENT FIELD OFFICE TO SUPPORT PUBLIC SAFETY OPERATIONS WITHIN THE CITY WHEREAS, the City of Port Arthur issued Request for Qualifications ("RFQ")No. P26- 023 on February 28, 2026, and March 7, 2026,in the Port Arthur News, seeking qualified firms to provide professional architectural and engineering services for the renovation of and additions to an existing structure located at 3535 Gates Boulevard to be converted into a Port Arthur Police Department Field Office, as reflected in Exhibit"A" attached hereto; and WHEREAS, statements of qualifications were timely received, reviewed, and evaluated in accordance with the City's procurement policies and procedures and the requirements of the Professional Services Procurement Act, Texas Government Code Chapter 2254, as reflected in Exhibit"B" attached hereto; and WHEREAS, following evaluation and scoring based upon the criteria published in the RFQ, Sigma Engineers, Inc., of Beaumont, Texas, was determined to be the most highly qualified firm and received the highest overall ranking among the respondents, as reflected in Exhibit "C" attached hereto; and WHEREAS, pursuant to Texas Government Code Chapter 2254, contracts for professional architectural and engineering services must be awarded on the basis of demonstrated competence and qualifications and not on competitive bidding, with a fair and reasonable fee to be negotiated following the selection of the most qualified firm; and WHEREAS,the City Council finds that it is in the best interest of the City to authorize the City Manager to enter into negotiations with Sigma Engineers, Inc. for professional architectural and engineering design services associated with the renovation and expansion of 3535 Gates Boulevard for use as a Port Arthur Police Department Field Office; and WHEREAS, any negotiated professional services agreement shall be presented to the City Council for final consideration and approval prior to execution; and WHEREAS, funding for the project is available in the Capital Improvement Fund, Account No. 307-17-045-8512-00-30-000. The building will be repurposed for Police Department Operations. PROPOSED PROJECT 1.0 General 1.1. The City of Port Arthur herein referred to as "Owner", requests qualifications for Architectural/Civil/Structural Engineering Services necessary to design an existing building located at 3600 Gates Boulevard, Port Arthur, Texas. The Firm herein referred to as "Respondent", shall serve in the capacity of an Architect/Civil/Structural Engineer for the design and repurposing of the existing building. 1.2. Respondents should carefully read the information contained herein and submit a complete response to all requirements and questions as directed. 1.3. Submittals and any other information submitted by Respondents in response to this RFQ shall become the property of the City. 1.4. The City will not provide compensation to Respondents for any expenses incurred by the Respondent(s)for submittal preparation or for any demonstrations that may be made unless otherwise expressly stated or required by law. Respondents submit qualifications at their own risk. 1.5. Each submittal should be prepared simply and economically, providing a straightforward, concise description of your firm's ability to meet the requirements of this RFQ. Emphasis should be on completeness, clarity of content, responsiveness to the requirements, and understanding the City's needs. 1.6. The City makes no guarantee that an award will be made as a result of this RFQ. City reserves the right to accept or reject any or all submittals, with or without cause, waive any formalities or minor technical inconsistencies, or delete any item/requirement from this RFQ or contract when deemed to be in the City's best interest. (This does not preclude an applicant from having consultants). 2.0 Project Description: the project scope includes the Architectural/Civil/Structural Engineering of an existing building located at 3600 Gates Boulevard,Port Arthur,Texas.The total project scope is comprised of the 2 (2)components listed below: The project consists of the renovation of an existing building with unknown conditions, including interior demolition, system replacement, site improvements, and evaluation of the feasibility of adding a second floor. The facility will serve Police Department operations only and may house mission-critical public safety functions. The existing building is to be designed to include but not be limited to Administrative and command offices,Patrol and operational support areas, Dispatch, Crime Intelligence Center, Media Room, Shift Meeting Rooms for FOD and CID Divisions, Training Room, lockers,Interrogation Room, Polygraph Examination Room, both Interrogation and Polygraph Room should be sound proofed, shower, and gym facilities, secure restricted access areas,technology-intensive spaces requiring continuous operation. The current site includes an approximately 22,000-square-foot building constructed in 1981, along with a 40,000- square-foot concrete parking lot,also constructed in 1981. In planning for the future needs of the Police Department,the City anticipates long-term expansion to approximately 60,000 square feet for the building including provisions for an upper-level deck to accommodate future growth and operational planning. 2.1 The building must be designed to be flood proof against 100-year flood events. 3.0 Proposal Concept: The City intends to select one company with Architectural/Civil/Structural Engineering in-house capabilities to design and engineer the repurposing of the existing building. The City may select a firm that best meets the City's interest from any combination of criteria presented. 4.0 Scope of Services: The Respondent shall provide the following scope of services. 4.1 Architectural/Civil/Structural Engineering Services. 4.2 Architectural Programming& Concept Design The scope of the work outlined in this proposal includes the Architectural, Civil and Structural Engineering design and plans of all major building elements, materials and finishes, construction documents and specifications to convey the intent of the design to bidders and contractors, and provisions for construction. Structural evaluation of existing building and foundations,assessment of prior demolition, remediation or vacancy impacts, Code, ADA, and life-safety analysis. In addition,this scope outlines all mechanical,electrical,and plumbing(MEP)and landscaping design by Professional Engineers registered in the State of Texas. 4.3 Structural Evaluation & Vertical Expansion The proposal should list all specialty consultants such as those used for architects, landscape architects,structural,MEP,and civil.Analysis of feasibility of adding a second floor. Identification of required structural reinforcements, and written findings and design recommendations. 4.4 Engineering Design Services Page 5 of 21 Civil engineering services shall include but are not limited to engineering site plans and final plans that will address water, sewer, drainage, easements, landscaping, etc. in accordance with the City's General Development Ordinance. Structural engineering services shall include but are not limited to Mechanical (HVAC), including redundancy for critical operations, electrical systems and emergency power coordination, plumbing systems, fire protection and life-safety systems, and coordination of data, communications, and security systems. 4.5 Site,Parking and Drainage Parking lot evaluation and design, Drainage and stormwater management, and Coordination with City standards and flood mitigation requirements. Architectural Engineering services shall be performed by a registered professional engineer licensed to perform architectural engineering in the State of Texas to include new building elevations and outside appearance, inside floor plans, ensure ADA compliance, specify materials, colors for finishing products. 4.6 Structural Engineering services shall be performed by a registered professional engineer licensed in the State of Texas to perform structural engineering to analyze the building for structural integrity and compliance with current wind loads, provide designs of necessary improvements and repairs required for the building to meet 2024 International Building Codes load requirements. The structural engineer must be approved by the Texas Department of Insurance to design, inspect and certify buildings for windstorm design. 4.7 Mechanical, Electrical and Plumbing Engineering services shall include but are not limited to load analysis,wire sizing,pipe sizing, internet sizing, etc. 4.8 The proposal shall also include: 4.8.1 A detailed description of the Architect/Civil/Structural Engineer's experience and capabilities to perform the work described. The Architect's experience specifically inside the Port Arthur City limits and for the City of Port Arthur. 4.8.2 A minimum of three (3) client references that demonstrate similar projects within area subject to hurricane storms. Each shall include the client's name, title, address, and current telephone number of the individual directly responsible for the work. 4.8.3 A detailed description of the Structural Engineer's experience in flood proofing existing structures and buildings. 4.8.4 The City reserves the right at any time to obtain an independent cost estimator at the Owner's expense. 4.8.5 The City also reserves the right to visit similar projects before awarding the design/contract. 4.9 Preliminary Design Services Page 6 of 21 4.9.1 Conduct meetings with key City staff to review basic assumptions, ascertain basic functional requirements,and review previously developed documents that detail spatial requirements. 4.9.2 Refine the project based on preliminary input and submit a preliminary report to the Owner. 4.9.3 The Engineer and the Owner shall meet weekly or as needed to discuss and evaluate the project(s) status. 4.10 Design and Engineering Services 4.10.1 The Architect/Engineer and Owner shall meet weekly or as needed to develop and review plans and specifications. 4.10.2 Provide construction cost estimates based on professional experiences. 4.10.3 Provide code review/analysis relative to the space plans. 4.10.4 Develop civil engineering site plans in accordance with City's General Development Ordinance. 4.10.5 Provide a set of construction plans for owner approval. 4.10.6 Develop design of exterior elevations indicating materials,finishes, and profiles of wall planes. 4.10.7 Submit exterior elevations for Owner's approval. 4.10.8 Provide preliminary structural,MEP, and civil engineering design. 4.10.9 Submit design documents to the Chief Building Official of the City. 4.10.10 The Engineer shall provide design updates at the 30%, 50%, 70%, 90%, and 100% design stages. 4.10.1 1 Upon approval by the Owner,the Engineer shall finalize construction documents. 4.10.12The Engineer shall provide final documents to the Owner. 4.10.13Provide architectural drawings and engineering specifications to describe the construction and detailing of the project for bidding,permitting, and construction. 4.10.14Provide MEP, structural, drawings and specifications to describe the construction and detailing of the project for bidding,permitting, and construction. 4.10.15Attend all City Council meetings needed to coordinate the overall process. Page 7 of 21 4.10.16Provide construction management services. 4.10.17Meet with owner's representative to review construction or design issues. 5.0 The Engineer shall submit architectural plans and engineering site plans in accordance with the City's General Development Review process. 5.1 Presentations to City Staff to review progress,present issues, and review change orders. 5.2 Provide construction as-built drawings including redlined version for the City Engineering Department including updated final drawing package. 6.0 Proposal Requirements & Selection Criteria. The Engineer shall provide the following information with their proposal. This information will be used in part to evaluate each proposal during the selection process. The information is to be in the following format: 6.1 Qualifications. The Respondent must provide qualifications in providing design services. 6.2 Identify quality control and project management, value engineering, subcontractor management, coordination of multi-bid package procurement, project scheduling, and project reporting, including minutes of meetings and daily progress reports. 6.3 Level of Experience. Identify past projects,including size and scope,budgets,actual building costs, and on-time performance. Identify experience and effectiveness in maintaining the overall design and engineering schedule. Projects shall have been repurposing buildings and design of new buildings in the Gulf of Americas area subject to hurricanes. 6.4 Staff&Key Personnel.Proposed organization structure and capabilities of managing an aggressive multi-bid package construction project. 6.5 Resumes, position description, project responsibilities, existing workload, and project percentage commitment of the key contract person responsible for managing the overall project between the Designer and the Owner. 6.6 Also, provide the methodology used in selecting the proposed project manager and project team members. Resumes shall include education, years of experience, construction management project experience, and current assignments. 6.7 Work Plan&Project Schedule.Provide a detailed work plan of your perception of how this project can be developed, designed, and implemented in a timely and responsible manner. Provide an overall project schedule to include the key phases of the project from program, design, Contractor selection, construction documents review, construction administration and inspection, and final close-out documentation. 6.8 Design Abilities & Communication Skills. The Respondent must demonstrate their ability to programmatically and schematically design this project within the parameters of our environment, location,budget and space requirement. Page 8 of 21 6.9 Demonstrate the communication process and site logistics for this project and the steps the Owner and/or Owner's representative can take if conflicts occurring during any phase of the design/build project. 6.10 Design Supervision. Identify your capacity and work plan to support this project with your office staff. 7.0 Identify your Company's capacity and work plan to support this project in the field 7.1 Owner's Representative. Please provide specific examples of past experience working with an owner's representative on a project. 8.0 Project Documentation. Proposed report documents to be used to manage the project(s). The reports shall address the techniques associated with detailed cost estimating, schedule monitoring, project budgets, weekly project status reporting, including identification of potential problems, impacts and recovery plans. 9.0 Claims, Suits and Resolution(s). Provide complete and accurate responses to the following questions: 9.1 Has your Company ever failed to complete any work awarded to it? 9.2 Are there any judgments, claims, arbitration proceedings or suits pending or outstanding against your Company or its officers? 9.3 Has your Company filed any lawsuits or requested arbitration with regard to construction contracts within the last five years? If yes, please provide details. 9.4 What is your Company's position on dispute avoidance programs? 9.5 Within the last five years, has any officer or principal of your organization ever been an officer or principal of another organization when (i) it failed to complete a design contract or (ii) was terminated for any reason during the performance of a design contract?(If the answer to any of the above is yes,please provide details). 10.0 Qualifying Proposals 10.1 Any special conditions or qualification related to this Request must be noted in your Proposal. 11.0 Proposal Instructions: 11.1 Information requested herein shall be furnished completely and in compliance with Section 12.0 below. Bidders must complete and sign the AFFIDAVIT included as part of this RFP. OUANTITIES: Quantities shown are estimated, based on projected use. It is specifically understood and agreed that these quantities are approximate and any additional quantities will be paid for at the quoted price. It is further understood that the contractor shall not have any claim against the City of Port Arthur for quantities less than the estimated amount. SHIPPING INFORMATION: All bids are to be F.O.B., City of Port Arthur, Port Arthur, TX 77640 INCORPORATION OF PROVISIONS REOUIRED BY LAW: Each provision and clause required by law to be inserted into the Contract shall be deemed to be enacted herein and the Contract shall be read and enforced as though each were included herein. If, through mistake or otherwise, any such provision is not inserted or is not correctly inserted the Contract shall be amended to make such insertion on application by either party. CONTRACTOR'S OBLIGATIONS: The Contractor shall and will, in good workmanlike manner, perform all work and furnish all supplies and materials, machinery, equipment, facilities and means, except as herein otherwise expressly specified, necessary or proper to perform and complete all the work required by this Contract, in accordance with the provisions of this Contract and said specifications. The apparent silence of these specifications as to any detail or to the apparent omission from it of a detailed description concerning any point shall be regarded as meaning that only the best commercial practices are to prevail. While the purpose of the specifications is to indicate minimum requirements in the way of capability, performance, construction, and other details, its use is not intended to deprive the City of Port Arthur the option of selecting goods which may be considered more suitable for the purpose involved. Under the Title VI of the Civil Rights Act of 1964, no person shall, on the grounds of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance. TER1%'UJNATION FOR CAUSE: If, through any cause, the Contractor shall fail to fulfill in a timely and proper manner his obligations under this contract, or if the Contractor shall violate any of the covenants, agreements or stipulations of this contract, the City shall thereupon have the right to terminate this contract by giving written notice to the Contractor of such termination and specifying the effective date thereof, at least fifteen (15) days before the effective date of such termination. Notwithstanding the above, the Contractor shall not be relieved of liability to the City for damages sustained by the City by Page 18 of 21 virtue of any breach of the contract by the Contractor, and the City may withhold any payments to the Contractor for the purpose of set-off until such time as the exact amount of damages due the City from the Contractor is determined. TERMINATION FOR CONVENIENCE: The City may terminate this contract at any time giving at least thirty (30) days notice in writing to the Contractor. If the Contract is terminated by the City as provided herein, the Contractor will be paid for the service that it has performed up to the termination date. If this contract is terminated due to fault of the Contractor, the previous paragraph hereof relative to termination shall apply. RELEASES AND RECEIPTS: The City of Port Arthur before making payments may require the Contractor to furnish releases or receipts for any or all persons performing work and supplying material or service to the Contractor, or any sub-contractors for work under this contract, if this is deemed necessary to protect its interests. CARE OF WORK: The Contractor shall be responsible for all damages to person or property that occurs as a result of his fault or negligence in connection with the work performed until completion and final acceptance by the City. SUB-CONTRACTS: The Contractor shall not execute an agreement with any sub-contractor or permit any sub-contractor to perform any work included in this Contract until he has received from the City of Port Arthur written approval of such agreement. INSURANCE: All insurance must be written by an insurer licensed to conduct business in the State of Texas, unless otherwise permitted by Owner. The Contract shall, at his own expense, purchase, maintain and keep in force insurance that will protect against injury and/or damages which may arise out of or result from operations under this contract, whether the operations be by himself or by any subcontractor or by anyone directly or indirectly employed by any of them, or by anyone for whose acts any of them may be liable, of the following types and limits 1. Standard Worker's Compensation Insurance: 2. Commercial General Liability occurrence type insurance City of Port Arthur, its officers, agents,and employees must be named as an additional insured): a. Contractor shall cause Contractor's insurance company or insurance agent to fill in all information required (including names of insurance agency, contractor and insurance companies, and policy numbers, effective dates and expiration dates) and to date and sign and do all other things necessary to complete and make into valid certificates of insurance and pertaining to the above listed items, and before commencing any of the work and within the time otherwise specified, Contractor shall file completed certificates of insurance with the Owner. Said CERTIFICATE OF INSURANCE Form should contain a provision that coverage afforded under the policies will not be altered, modified or canceled unless at least fifteen (15)days prior written notice has been given to the City of Port Arthur. Contractor shall also file with the City of Port Arthur valid CERTIFICATE OF INSURANCE on like form from or for all Subcontractors and showing the Subcontractor (s) as the Insured. Said completed CERTIFICATE OF INSURANCE Form (s) shall in any event be filed with the City of Port Arthur not more than ten (10) days after execution of this Contract. NOTICE TO PROCEED: Notice to Proceed shall be issued within ten (10)days of the execution of the Contract by OWNER. Should there be any reasons why Notice to Proceed cannot be issued within such period,the time may be extended by mutual agreement between OWNER and CONTRACTOR. DISCLOSURE OF INTERESTED PARTIES FORM 1295: A person or business, who enters into a contract with the City, meeting the conditions according to Texas Local Government Code Sec. 2252.908, is required to file Form 1295 with Texas Ethics Commission. This form is not required unless there is a contract between the vendor and the City of Port Arthur. Do not submit this form unless you receive an award letter from the City. PUBLIC INSPECTION OF PROPOSALS: The City strictly adheres to the Texas Public Information Act (Texas Government Code Chapter 552.001, et seq.) and all other governing statutes, regulations, and laws regarding the disclosure of RFP information. The U.S. Government and FEMA have several studies explaining different levels and methods of flood resistance or floodproofing. Unfortunately, many advertised gimmicks on the market claim to be solutions to floodproofing a building.They are far from an effective method or remote solution to protecting the building and the assets. Most Recent Experience Sigma Engineers was recently commissioned by KBMT television station to design the floodproofing of their TV studios and corporate offices.The design is completed and will be ready for construction as soon as the budget is approved. Most existing buildings, especially older structures, do not comply with the current building codes and load requirements,windstorm, life safety,and accessibility requirements. Below are some examples similar to this scope that has been successfully completed by Sigma: Crocket Street Complex, Beaumont — Historical structures designed as shops and warehouses which were turned into restaurants, dance clubs,and event centers. The project is a successful marriage of structural and architectural talents. Jean Laffite Hotel, Galveston — Converted a turn-of-the-century hotel into 83 luxury apartments all while maintaining the historical designations. Ruby Fuller Church, Port Arthur-An existing church building with a balcony that was repurposed to a two-story state-of-the-art classroom and meeting facility for Lamar College Port Arthur.The project's flood prevention scope was extremely important. Previously,the church was continuously flooded. Our civil design and the site's re-design alleviated the flooding issues. This project won two state wide awards. Health Department Building, City of Port Arthur—This is an existing 46,000-square-foot building designed for several government-leased offices. Some examples of recent buildings are: Drainage District 7 headquarters in the City of Port Arthur is a building designed so the flooding will not affect it. It includes modern engineering offices, a corporate and conference facility,and a full-size power generation plant. Sabine Pilots corporate offices a 10,000 square-foot modern corporate office for the Sabine pilots with a community room and helipad.This building houses a sophisticated I.T. and communication department, an incident command center, and several sleeping quarters for pilots on call. Creating multiple entrances that are secure,safe, and operationally isolated, while still giving the public a welcoming,community-oriented front door. The key is to treat each entrance as its own security zone with controlled transitions between them. Public Entrance: Open,Visible, and Community Focused. This entrance must feel accessible while still protecting staff and operations. • The Gates building is very visible on the public facing side of the building. Clear signage, lighting, and ADA-compliant access will make it more public friendly. • A secure vestibule with controlled access into the lobby with ballistic rated glazing at reception will be provided in the design. The university recently commissioned us to convert the two existing circa 1950s buildings on the East side of the campus into two new state-of-the-art Workforce Training Buildings.
