SURVEY N0. 275, ABSTRACT N0. 316, CITY OF PORT ARTHUR, JEFFERSON COUNTY, TEXAS DATE: 12/09/09 BACKGROUND: The Planning and Zoning Commission is being asked to consider acceptance of a final plat for Phase I of the Angel Trace Subdivision located north of 58th Street and west of Ray Avenue near the Palomar area of Port Arthur. There were two changes made to the preliminary plat that consisted of Lots 32, 33, 34, 71, 72 & 73 being combined to make Lot 32A (this area includes a swimming pool and club house) and Lot 25 being omitted to allow the City ingress/egress to the pond. This final plat meets the requirements of the City's Subdivision Ordinance. The City's Engineering department has agreed to access the site to ensure that all requirements are being met. Applicant/agent - Soutex Surveyors, Inc. Owner -Bill Fisher (Odyssey Residential Acquisitions 11, LLC) RECOMMENDATION: The planning staff has no objections to the approval of this final plat. REPEAT OF LOTS 22 & 23 MARINA COLONY SECTION 1 PLEASURE ISLAND CITY OF PORT ARTHUR JEFFERSON COUNTY. TEXAS (PROPERTY LOCATED SOUTH OF T.B. ELLISON PARKWAY AT 831 & 837 NORTHWINDI SPEAKING FOR: Kenneth Wiemers (Soutex Surveyor's, Inc.), 3737 Doctors Drive, Port Arthur, TX 77642 SPEAKING AGAINST: NONE Mr. Burton informed the commissioners that twenty-five (25) notices were mailed out in relation to the above case; none were returned. Mr. Wiemers informed the commissioners that the property owners would like to take their two lots and combine them into one for the purpose of building across the lot lines. Mr. Ramirez asked will the construction of they new dwelling comply with the particular specifications of the Island. Mr. Wiemers stated that the homeowners have not submitted their building plans to his office, but plans would have to be in accordance with flood elevation, as well as any restrictions that the Marina Colony Homeowners Association may have. Mr. Wiemers informed the commissioners that this land had been previously replatted for the construction of asingle-dwelling and property owner would like to change it back to the original three (3) single lots. Mr. Wiemers stated that he was "not sure", however the property is being split into three (3) separate tracts which will make it very difficult to put duplexes on these lots. Calls were received regarding the intension of the applicant for the replat. Mr. Meaut informed the commissioners that the purpose of this replat is for the Sabine Pass Independent School District to construct amulti-purpose facility for their use. Ms. Moore moved to close the public hearing; Ms. LeBlanc seconded the motion. Vote: All Yeas -public hearing closed. V. R09-44 R09-45 & R09-46 -REPEAT APPROVAL REQi~F.STED -MOTION REQUIRED Mr. Burton made a recommendation for approval of replat requests R09-44, R09-45 & R09-46. Fernando Ramirez moved to accept the Planning Department's recommendation to approve all three replat requests; /nell Moore seconded the motion. Vote: All Yeas -Motion passed. VI. MINUTES -NOVEMBER 16, 2009 Fernando Ramirez moved to approve the mimztes as presented; Alma LeBlanc seconded the motion. Vote: All Yeas -motion passed. VII. REPORT FROM DIRECTOR Mr. Burton informed the commissioners that there will be one (1) simple replat cases that will be on the December 215Y agenda. VIII. FUTURE AGENDA ITEMS Mr. Burton informed the commissioners that a representative from Angel Trace has approached the Planning Department prior to this meeting to re-introduce the final plat to the P&Z Commission for approval, contingent upon certain stipulations that must be outlined by the City's Engineering Department A representative from the Engineering Department will go out with a representative from Angel Trace to ensure that all requirements are being met. Page ~ 2 Mr. Ramirez asked, if a meeting is regularly scheduled for December 21St, why is it "prudent" to hold a special meeting for Monday, December 14, 2009. Mr. Burton stated, there are other statutory commitments with the state of Texas were certain amounts of data. must be submitted prior to the 31St of December, 2009. Approval of final plat must be submitted to City Council for December 15tH agenda. Mr. Ramirez asked if the regularly scheduled mE~eting can be moved up to December 14tH. Mr. Burton informed the commissioners that he will research this matter. IX. ADJOURNMENT Ms. Moore moved to adjourn the meeting. Mr. Ramirez seconded the motion, which passed unanimously.
