Milo, Senior Planner Development Services RE: P.R. NO. 24927 — A resolution calling for a public hearing to consider a Zoning Map Amendment (Zone Change). Introduction: The Port Arthur City Council is being asked to consider the approval of Proposed Resolution No. 24927, calling for a public hearing to consider granting a Zoning Map Amendment for approximately 35.77 acres of land, Pt of Lts 2, 7, and 8, Blk 16, Rg N & Pt Lts 1 & 2, Blk 17 Rg N & Lt. 2, Tr 2, 1.000, Blk. 16, Range N, PALCO Addition, City of Port Arthur, Jefferson County, Texas. The property is located at south of West Port Arthur Road and north of Kerry Twin Thomas Drive. The request aims to amend the zoning from the Light Industrial District (LI) to a Commercial General District (CG) for the construction & operation of "Amusement, Commercial." Background: On or around April 8, 2026, an application for a Zoning Map Amendment was filed with the Planning & Zoning Division. In accordance with Appendix A, Section 6.03 of the City of Port Arthur Zoning Ordinance, any person or corporation having a proprietary interest in any property may petition the city council for a change or amendment to the provisions of this ordinance. Notification of the hearing date and time will be published in the city's official newspaper and mailed to adjacent property owners within a 200-foot radius at least 15 days before the public hearing. The Planning & Zoning Commission conducted a public hearing on May 4, 2026, at 5:30 P.M. Budget Impact: None Recommendation: It is recommended that the City Council consider the approval of Proposed Resolution No. 24927, calling for a public hearing to consider granting a Zoning Map Amendment for approximately 35.77 acres of land, Pt of Lts 2, 7, and 8, Blk 16, Rg N & Pt Lts 1 & 2, Blk 17 Rg N & Lt. 2, Tr 2, 1 .000, Blk. 16, Range N, PALCO Addition, City of Port Arthur, Jefferson County, Texas The property is located at south of West Port Arthur Road and north of Kerry Twin Thomas Drive. (LOCATED SOUTH OF WEST PORT ARTHUR ROAD AND NORTH OF KERRY TWIN THOMAS DRIVE) Z26-05 HERDZ INVESTMENTS, LLC WHEREAS, it is being requested that the City Council consider a Zoning Map Amendment for 35.77 acres of land, Part of Lots 2, 7, and 8, Blk 16, Rg. "N" & Part of Lots 1 & 2, Block 17, Rg "N" & Lot 2, Tract 2, 1.000, Block 16, Range "N", Port Arthur Land Company, City of Port Arthur, Jefferson County, Texas, as delineated in Exhibit "A"; and, WHEREAS, pursuant to Chapter 211 in the Texas Local Government Code, a public hearing must precede any zoning change. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT the facts and opinions in the preamble are true and correct. THAT the Planning and Zoning Commission held a public hearing for this case on May 4, 2026. THAT the notice of the public hearing for the Planning and Zoning Commission was published in the city's official newspaper and mailed to adjacent property owners within a 200-ft radius of the proposed site on April 14, 2026. THAT a public hearing with the Port Arthur City Council to consider this Zoning Map Amendment for 35.77 acres of land, Part of Lots 2, 7, and 8, Blk 16, Rg. "N" & Part of Lots 1 & 2, Block 17, Rg "N" & Lot 2, Tract 2, 1.000, Bock 16, Range "N", Port Arthur Land Company, City of Port Arthur, Jefferson County, Texas, as delineated in Exhibit "A" shall be held on June 30, 2026, at 6:00 p.m. in the City P.R. NO. 24927 5/13/2026-AM PAGE 2 OF 5 Council Chambers, Fifth Floor, City Hall, 444 4th Street, Port Arthur, Texas, or by telephonic and videoconference. THAT notice of the public hearing shall be published at least fifteen days prior in the City's official newspaper before going to the City Council. THAT a copy of the caption of this Resolution is spread upon the Minutes of the City Council.
