NO. 24966 — A resolution calling for a public hearing to consider a Zoning Map Amendment (Zone Change). Introduction: The Port Arthur City Council is being asked to consider the approval of Proposed Resolution No. 24966, calling for a public hearing to consider granting a Zoning Map Amendment for 0.2987 Acres of Land out of and a part of Lot 1, Block 32, and Lot 17, Block 7, Port Acres Subdivision, Port Arthur, Jefferson County, Texas. The property is located at 2219 Canal Street. The request aims to amend the zoning from Low-Density Residential District (LDR) to a Commercial Retail District (CR) for the re-establishment and operation of a car wash. Background: On or around March 25, 2026, an application for a Zoning Map Amendment was filed with the Planning & Zoning Division. In accordance with Appendix A, Section 6.03 of the City of Port Arthur Zoning Ordinance, any person or corporation having a proprietary interest in any property may petition the city council for a change or amendment to the provisions of this ordinance. The Planning & Zoning Commission may, on its own motion or on request from the City Council, institute a study and proposal for changes and amendments in public interest. The Planning & Zoning Commission conducted a public hearing on April 20, 2026, at 5:30 P.M. Budget Impact: None Recommendation: It is recommended that the City Council consider the approval of Proposed Resolution No. 24966, calling for a public hearing to consider granting a Zoning Map Amendment for approximately 0.2987 Acres of Land out of and a part of Lot 1, Block 32, and Lot 17, Block 7, Port Acres Subdivision, Port Arthur, Jefferson County, Texas. The City Council public hearing shall be held on Tuesday, June 30, 2026, at 6:00 P.M. A RESOLUTION CALLING FOR A PUBLIC HEARING TO CONSIDER A ZONING MAP AMENDMENT FOR 0.2987 ACRES OF LAND BEING 0.2987 ACRES OF LAND OUT OF AND A PART OF LOT 1, BLOCK 32, AND LOT 17, BLOCK 7, PORT ACRES SUBDIVISION, PORT ARTHUR, JEFFERSON COUNTY, TEXAS (LOCATED AT 2219 CANAL STREET) Z26-04 KENNETH RAY RICE, JR. WHEREAS, it is being requested that the City Council consider a Zoning Map Amendment for 0.2987 Acres of Land out of and a part of Lot 1, Block 32, and Lot 17, Block 7, Port Acres Subdivision, Port Arthur, Jefferson County, Texas, as delineated in Exhibit "B"; and, WHEREAS, pursuant to Chapter 211 in the Texas Local Government Code, a public hearing must precede any zoning change. WHEREAS, Section 211.006(a) of the Texas Local Government Code requires notice of the public hearing before the governing body to be published in the official newspaper or a newspaper of general circulation in the municipality before the fifteenth (15th) day before the date of the hearing. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: THAT, the facts and opinions in the preamble are true and correct. THAT, the Planning and Zoning Commission held a public hearing for this case on April 20, 2026. THAT, the notice of the public hearing for the Planning and Zoning Commission was published in the city's official newspaper and mailed to adjacent property owners within a 200-ft radius of the proposed site on March 27, 2026. THAT, a public hearing with the Port Arthur City Council to consider this Zoning Map Amendment for 0.2987 Acres of Land out of and a part of Lot 1, Block 32, and Lot 17, Block 7, Port P.R. NO.24966 5/19/2026-VH/PDL PAGE 2 OF 7 Acres Subdivision, Port Arthur, Jefferson County, Texas, as delineated in Exhibit "B" shall be held on June 30, 2026, at 6:00 p.m. in the City Council Chambers, Fifth Floor, City Hall, 444 4th Street, Port Arthur, Texas, or by telephonic and videoconference. THAT, in accordance with Section 211 .006(a) of the Texas Local Government Code, public notice of the Port Arthur City Council public hearing shall be published in the official newspaper or a newspaper of general circulation in the City before the fifteenth (15th) day before the date of the public hearing, in substantially the same form as delineated in Exhibit "A." THAT a copy of the caption of this Resolution is spread upon the Minutes of the City Council.
