Introduction:
The intent of this Agenda Item is to seek the City Council's approval of P.R. #24980 for
Amendment#2 the contract between the City of Port Arthur and Tender Loving Care Dba Legacy
Community Development Corporation.
The amendment will extend the contract expiration date from July 09, 2026,to July 08, 2028.
Background:
To address the need for homelessness assistance and supportive services, Congress appropriated
$5 billion in American Rescue Plan funds to be administered through HOME to perform activities
that primarily benefit qualifying individuals and families who are homeless, at risk of
homelessness, or in other vulnerable populations. The HOME-ARP grant will end on September
30, 2030.
Resolution#23-295 approved $260,000.00 of HOME Investment Partnerships American Rescue
Plan (HOME-ARP) funding for Legacy Community Development Corporation to rehabilitate
nineteen rental units for families who qualify under the HOME-ARP program guidelines.
Seventeen of the units are occupied. The grant has a remaining balance of $55,463.80. No
additional funding is requested or required for completion of the project or administration of the
program.
Budget Impact:
The amendment will impact the HOME Investment Partnership American Rescue Plan (HOME-
ARP)budget. Account# 108-13-033-5470-00-40-000; Project#HMEARP3.
Recommendation:
It is recommended that the City Council approve P. R. #24980.

RESOLUTION NUMBER
A RESOLUTION APPROVING THE HOME INVESTMENT
PARTNERSHIPS AMERICAN RESCUE PLAN PROGRAM (HOME-ARP)
CONTRACT AMENDMENT BETWEEN THE CITY OF PORT ARTHUR
AND TENDER LOVING CARE DBA LEGACY COMMUNITY
DEVELOPMENT CORPORATION FOR THE REHABILITATION OF
NINETEEN RENTAL UNITS. AMENDMENT #2 WILL EXTEND THE
CONTRACT EXPIRATION DATE FROM JULY 09, 2026, TO JULY 08,
2028. NO ADDITIONAL FUNDING IS REQUESTED OR REQUIRED FOR
COMPLETION OF THE PROJECT OR ADMINISTRATION OF THE
PROGRAM. ACCOUNT #108-033-5470000-40-000; PROJECT
#HMEARP3.
WHEREAS, Congress appropriated approximately $5,000,000,000.00 through the
American Rescue Plan Act ("ARPA") to be administered by the United States Department of
Housing and Urban Development("HUD")through the HOME Investment Partnerships American
Rescue Plan Program ("HOME-ARP") to address the need for homelessness assistance and
supportive services for qualifying individuals and families who are homeless, at risk of
homelessness, or otherwise members of vulnerable populations; and,
WHEREAS, HOME-ARP funds may be utilized for eligible activities including: (1)
development and support of affordable housing; (2) tenant-based rental assistance("TBRA"); (3)
provision of supportive services; and (4) acquisition and development of non-congregate shelter
units; and,
WHEREAS, pursuant to Resolution No. 23-295, the City Council approved a HOME-
ARP Agreement in the amount of $260,000.00 HOME-ARP contract between the City of Port
Arthur and Tender Loving Care Dba Legacy Community Development Corporation to rehabilitate
nineteen rental units for qualifying participants in the HOME-ARP program; and,
WHEREAS, pursuant to Resolution No. 25-285, the City Council approved Amendment
No. 1 to the Agreement, extending the contract expiration date from July 10,2025,to July 9,2026,
to facilitate continued project implementation; and
WHEREAS, Legacy CDC has substantially completed the project, with seventeen(17) of
the nineteen (19) rehabilitated units currently occupied by eligible tenants, and a remaining grant
balance of$55,463.80 remains available under the Agreement; and

WHEREAS, no additional HOME-ARP funding is requested or required for completion
of the project, administration of the program, or close-out of the Agreement; and
WHEREAS, Amendment No. 2, attached hereto as Exhibit "A," will extend the contract
term from July 9,2026,to July 8,2028,to allow sufficient time for completion of required HOME-
ARP compliance activities, including participant income verification, collection and review of
required eligibility documentation, expenditure of remaining grant funds, and completion of all
HUD-required grant close-out procedures; and
WHEREAS, the City Council finds that approval of Amendment No. 2 is necessary and
in the best interests of the City and will facilitate full compliance with HOME-ARP program
requirements.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR,TEXAS:
Section 1. That, the facts and opinions in the preamble are true and correct.
Section 2. The City Council hereby approves Amendment No. 2 to the HOME-ARP
Agreement between the City of Port Arthur and Tender Loving Care d/b/a Legacy Community
Development Corporation, substantially in the form attached hereto as Exhibit"A."
Section 3. The City Manager is hereby authorized to execute Amendment No. 2 and any
related documents necessary to carry out the intent of this Resolution, extending the Agreement
term from July 9, 2026, through July 8, 2028. No additional funding is requested or required for
completion of the project or administration of the program.
Section 4. That, a copy of the caption of this Resolution be spread upon the minutes of the
City Council.

PROJECT DESCRIPTION: Family Services of Southeast Texas shall provide case management
and crisis intervention to victims of domestic violence. HOME-ARP funding will cover the cost
of salaries and office supplies.
