City Manager—Operations Development Services Manager RE: P. R. #24981 Introduction: This agenda item seeks the approval of the City Council of P. R. #24981 for Amendment#3 to the contract between the City of Port Arthur and Family Services of Southeast Texas.The amendment will extend the contract expiration date from July 09, 2026, to July 08, 2028. Background: To address the need for homelessness assistance and supportive services, Congress appropriated Rescue Plan funds to be administered through billion in American the Home Investment Partnerships (HOME) program to perform four activities that must primarily benefit qualifying individuals and families who are homeless, at risk of homelessness, or in other vulnerable populations. These activities include: (1) development and support of affordable housing; (2) tenant-based rental assistance (TBRA); (3) provision of supportive services; and (4) acquisition and development of non-congregate shelter units. The Department of Housing and Urban Development states that HOME-ARP funds must be fully expended by September 30, 2030. Unspent funds after this date will be recaptured by the U. S. Treasury. Budget Impact: Resolution # 23-295 approved $60,000.00 of HOME Investment Partnerships American Rescue Plan (HOME-ARP) funding for the Family Services of Southeast Texas. Family Services of Southeast Texas will provide case management and crisis intervention to victims of domestic violence. Family Services has assisted over 400 families and has a HOME-ARP balance of $22,146.89. Account# 108-13-033-5470-00-40-000; Project#HMEARP5.No additional funding is requested or required for completion of the project or administration of the program. Resolution#24-306 approved a budget amendment that eliminated and replaced the travel budget with office supplies. Resolution #25-290, approved the contract expiration date from July 10, 2025,to July 09, 2026. P. R. #24981 05/21/2026 M. Essex RESOLUTION NUMBER A RESOLUTION APPROVING THE HOME INVESTMENT PARTNERSHIPS AMERICAN RESCUE PLAN PROGRAM (HOME-ARP) CONTRACT AMENDMENT #3 BETWEEN THE CITY OF PORT ARTHUR AND FAMILY SERVICES OF SOUTHEAST TEXAS. THE AMENDMENT WILL EXTEND THE CONTRACT EXPIRATION DATE FROM JULY 09, 2026, TO JULY 08, 2028. NO ADDITIONAL FUNDING IS REQUESTED OR REQUIRED FOR COMPLETION OF THE PROJECT OR ADMINISTRATION OF THE PROGRAM. ACCOUNT# 108-13-033-5470-00-40-000; PROJECT #HMEARP5 WHEREAS, Congress appropriated approximately $5,000,000,000.00 through the American Rescue Plan Act ("ARPA") to be administered by the United States Department of Housing and Urban Development ("HUD") through the HOME Investment Partnerships American Rescue Plan Program("HOME-ARP")to address the need for homelessness assistance and supportive services for qualifying individuals and families who are homeless, at risk of homelessness, or otherwise members of vulnerable populations; and, WHEREAS, HOME-ARP funds may be utilized for eligible activities including: (1) development and support of affordable housing; (2)tenant-based rental assistance("TBRA"); (3) provision of supportive services; and (4) acquisition and development of non-congregate shelter units; and, WHEREAS, pursuant to Resolution No. 23-295, the City Council approved a HOME- ARP Agreement between the City of Port Arthur and Family Services of Southeast Texas in the amount of$60,000.00 to provide case management, crisis intervention, and supportive services to victims of domestic violence who qualify under HOME-ARP program guidelines; and WHEREAS, Family Services of Southeast Texas has successfully provided services to more than four hundred (400) families through the program and currently has an unexpended HOME-ARP balance of$22,146.89; and WHEREAS, pursuant to Resolution No. 24-306, the City Council approved budget amendment reallocating funds by eliminating the travel budget category and replacing it with office supplies to better support program operations; and WHEREAS, pursuant to Resolution No. 25-290, the City Council approved Amendment No. 2 to the Agreement, extending the contract expiration date from July 10, 2025, to July 9, 2026; and P. Essex WHEREAS, Amendment No. 3, attached hereto as Exhibit "A," will extend the contract term from July 9, 2026, to July 8, 2028, to allow additional time for completion of required HOME-ARP compliance activities, including participant income verification, collection and review of eligibility documentation, expenditure of remaining grant funds, and completion of all required HUD grant close-out procedures; and WHEREAS, no additional HOME-ARP funding is requested or required to complete the project, administer the program, or fulfill the obligations of the Agreement; and WHEREAS, the City Council finds that approval of Amendment No. 3 is necessary and in the best interests of the City and will facilitate compliance with HOME-ARP program requirements while ensuring the successful completion and close-out of the program. NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1. That, the facts and opinions in the preamble are true and correct. Section 2. That,the City Council of the City of Port Arthur hereby approves the contract amendment#3 between the City of Port Arthur and Family Services of Southeast Texas. Section 3. That, the City Council deems it is in the City's best interest to approve and authorize the City Manager and the Director of Family Services of Southeast Texas to amend the contract to change the contract completion date from July 09, 2026, to July 08, 2028. No additional funding is requested or required for completion of the project or administration of the program. Section 4. That, a copy of the caption of this Resolution be spread upon the minutes of the City Council. READ, ADOPTED, AND APPROVED this day of A.
