City Manager— Operations Development Services Manager RE: P. R. #24982 Introduction: The intent of this Agenda Item is to seek the City Council's approval of P. R. #24982 for Amendment #3 to the contract between the City of Port Arthur and the Salvation Army. The amendment will extend the contract expiration date from July 09, 2026, to July 08, 2028. Background: To address the need for homelessness assistance and supportive services, Congress appropriated $5 billion in American Rescue Plan funds to be administered through the Home Investment Partnerships (HOME) program to perform four activities that must primarily benefit qualifying individuals and families who are homeless, at risk of homelessness, or in other vulnerable populations. These activities include: (1) development and support of affordable housing; (2) tenant-based rental assistance (TBRA); (3) provision of supportive services; and (4) acquisition and development of non-congregate shelter units. The Department of Housing and Urban Development states that HOME-ARP funds must be fully expended by September 30, 2030. Unspent funds after this date will be recaptured by the U. S. Treasury. Resolution No. 23-295 approved the allocation of$50,000.00 in HOME Investment Partnerships American Rescue Plan ("HOME-ARP") funds to The The Salvation Army for the provision of rental and utility assistance services. The Salvation Army successfully provided assistance to six (6) families and currently maintains an unexpended balance of$3,149.32. No additional funding is requested or required for completion of the project or administration of the program. Resolution # 25-211 approved a budget amendment. Resolution #25-283 approved a contract expiration date from July 09, 2025,to July 08, 2026. Budget Impact: The amendment will not impact the HOME Investment Partnership American Rescue Plan (HOME-ARP)budget. Account#108-13-033-5470-00-40-000; Project#HMEARPI. Recommendation: It is recommended that the City Council approve P. R. #24982. P. R. #24982 06/10/2025 M. Essex-TNR RESOLUTION NUMBER A RESOLUTION APPROVING THE HOME INVESTMENT PARTNERSHIPS AMERICAN RESCUE PLAN PROGRAM (HOME-ARP) CONTRACT AMENDMENT #3 BETWEEN THE CITY OF PORT ARTHUR AND THE SALVATION ARMY. THE AMENDMENT WILL EXTEND THE CONTRACT EXPIRATION DATE FROM JULY 09, 2026, TO JULY 08, 2028. NO ADDITIONAL FUNDING IS REQUESTED OR REQUIRED FOR COMPLETION OF THE PROJECT OR ADMINISTRATION OF THE PROGRAM.ACCOUNT#108-13-033-5470-00- 40-000; PROJECT#HMEARP1. WHEREAS, Congress appropriated approximately $5,000,000,000.00 through the American Rescue Plan Act ("ARPA") to be administered by the United States Department of Housing and Urban Development("HUD")through the HOME Investment Partnerships American Rescue Plan Program ("HOME-ARP") to address the need for homelessness assistance and supportive services for qualifying individuals and families who are homeless, at risk of homelessness, or otherwise members of vulnerable populations; and, WHEREAS, HOME-ARP funds may be utilized for eligible activities including: (1) development and support of affordable housing; (2) tenant-based rental assistance("TBRA"); (3) provision of supportive services; and (4) acquisition and development of non-congregate shelter units; and, WHEREAS, pursuant to Resolution No. 23-295, the City Council approved a HOME- ARP Agreement in the amount of $50,000.00 between the City of Port Arthur and The Salvation Army for the rental and utility assistance to eligible residents; and, WHEREAS, The Salvation Army has successfully provided assistance to six (6) families and currently maintains an unexpended balance of$3,149.32. No additional funding is requested or required for completion of the project or administration of the program; and, WHEREAS, pursuant to Resolution No. 25-211, the City Council approved a related budget amendment for the HOME-ARP program; and, WHEREAS, pursuant to Resolution No. 25-283, the City Council approved Amendment No. 2 to extend the agreement term from July 9, 2025, through July 8, 2026; and, WHEREAS, HUD requires HOME-ARP funds to be fully expended no later than September 30, 2030, and any unexpended funds remaining after such date are subject to recapture by the United States Treasury; and, WHEREAS,Amendment No. 3,attached hereto as Exhibit"A,"will extend the agreement term from July 9, 2026, through July 8, 2028, in order to allow sufficient time for completion of HOME-ARP eligibility determinations, income verification, collection and review of required P. R.#24982 06/10/2025 M. Essex-TNR client documentation, grant administration activities,close-out procedures, and expenditure of the remaining HOME-ARP funds; and, WHEREAS, the City Council finds that approval of Amendment No. 3 is in the best interest of the City of Port Arthur and will further the public purpose of providing homelessness assistance and supportive services to eligible residents. NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR,TEXAS: Section 1. That,the facts and opinions in the preamble are true and correct. Section 2. The City Council hereby approves Amendment No. 3 to the HOME-ARP Agreement between the City of Port Arthur and The Salvation Army, attached hereto as Exhibit Section 3. City interestapprove the Council deems it is in the best of the City to and authorize the City Manager and the Director of the Salvation Army to amend the contract that changes the contract completion date from July 09, 2026,to July 08, 2028. No additional funding is requested or required for completion of the project or administration of the program Section 4.
