Nature of the Request:
The Housing Division recommends the City Council authorize the adoption of P.O.
No. 7428, for conveying City owned properties located at the following locations,
for new construction projects to Tender Loving Care Center for Children, d/b/a
Legacy Community Development Corporation("Legacy CDC"):
1) PID#88511; Tract 1-A, Replat of Lot 1 and Part of Lot 2, Block 92, City
of Port Arthur Addition;commonly known as 1348 Rev.Ransom Howard
Street;
2) PID#88512; Tract 1-B, Replat of Lot 2 and Part of Lot 3, Block 92, City
of Port Arthur Addition;commonly known as 1332 Rev.Ransom Howard
Street;
3) PID#416320;Tract 1-C,Replat of Lots 3-5,Block 92,City of Port Arthur
Addition; located in the 1300 block of Rev. Ransom Howard Street;
4) PID #88513; Tract 1-D, Replat of Part of Lot 4 and All of Lot 5, Block
92,City of Port Arthur Addition;commonly known as 1310 Rev.Ransom
Howard Street; and
5) PID #412197; Lots 3 and 4, Block 198, City of Port Arthur Addition;

Staff Analysis/Considerations:
These properties are being recommended for conveyance to an eligible Community
Development Housing Corporation (CHDO) who has the capacity and experience
of being capable of assisting the City with carrying out elements of its housing
programs.
Legacy CDC, is a chartered Texas non-profit corporation, and have obligated
themselves to assist with meeting the requirements of the HOME program and all
other Federal Requirements to assist in carrying out the mission of the City of Port
Arthur to eliminate blight and provide decent, safe, sanitary and affordable housing
for low and moderate-income persons/families of the community.
Legacy CDC will construct five (5) new homes to assist the low- and moderate-
income persons and families of Port Arthur in fulfilling the American dream of
homeownership.
Five (5) applicants have been identified and will be screened for certification to
participate in Legacy CDC's new construction program.
Recommendation:
The Housing Division recommends the City Council authorize the adoption of P.O.
No. 7428, for conveying City owned properties located at the following locations
in the City of Port Arthur, Jefferson County, Texas to Tender Loving Care Center
for Children, d/b/a Legacy Community Development Corporation ("Legacy
CDC").

AN ORDINANCE AUTHORIZING THE CONVEYANCE OF FIVE (5)
CITY-OWNED VACANT TRACTS OF LAND BY SPECIAL WARRANTY
DEED(S) TO TENDER LOVING CARE CENTER FOR CHILDREN DB/A
LEGACY COMMUNITY DEVELOPMENT CORPORATION ("LEGACY
CDC") FOR THE PURPOSE OF THE DEVELOPMENT AND
CONSTRUCTION OF NEW HOMES FOR LOW- AND MODERATE-
INCOME PERSONS AND FAMILIES
WHEREAS, Section 272.001(g) of the Texas Local Government Code authorizes a
•
political subdivision to acquire or assemble land or real property interest,except by condemnation,
and sell, exchange, or otherwise convey the land or interests to an entity for the development of
low-income or moderate-income housing. The political subdivision shall determine the terms and
conditions of the transactions so as to effectuate and maintain the public purpose. If conveyance
of land under this subsection serves a public purpose, the land may be conveyed for less than its
fair market value; and
WHEREAS, the City Council wishes to authorize the City Manager to convey the
following five (5) City-owned vacant tracts to Tender Loving Care Center for Children D/B/A
Legacy Community Development Corporation ("Legacy CDC") for the development and
construction of new homes for the low and moderate-income people/families:
1) PID #88511; Tract 1-A, Replat of Lot 1 and Part of Lot 2, Block 92, City of Port Arthur
Addition; commonly known as 1348 Rev. Ransom Howard Street;
2) PID #88512; Tract 1-B, Replat of Lot 2 and Part of Lot 3, Block 92, City of Port Arthur
Addition; commonly known as 1332 Rev.Ransom Howard Street;
3) PID #416320; Tract 1-C, Replat of Lots 3-5, Block 92, City of Port Arthur Addition;
located in the 1300 block of Rev.Ransom Howard Street;
4) PID #88513; Tract 1-D, Replat of Part of Lot 4 and All of Lot 5, Block 92, City of Port
Arthur Addition;commonly known as 1310 Rev. Ransom Howard Street;
5) PID #412197; Lots 3 and 4, Block 198, City of Port Arthur Addition; located in the 600
block of DeQueen Boulevard;and
WHEREAS,these properties are being recommended for conveyance to Legacy CDC who
have the capacity and experience of being capable of assisting the City with carrying out elements
of its housing programs for residential properties in efforts to expand neighborhood revitalization;
and
WHEREAS, the conveyance of these properties will promote public purpose, which
includes, but is not limited to putting vacant property back on the tax roll, maintaining the
revitalization of City neighborhoods.

NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR,TEXAS:
SECTION 1. That the facts and opinions in the preamble are true and correct.
SECTION 2. That the City Council herein authorizes the City Manager to execute Special
Warranty Deed(s)for the conveyance of the following vacant tracts of land to Tender Loving Care
Center for Children D/B/A Legacy CDC, in substantially the same form as:
1) (Exhibit"A")-PID#88511; Tract 1-A, Replat of Lot 1 and Part of Lot 2, Block 92,City
of Port Arthur Addition;commonly known as 1348 Rev.Ransom Howard Street;
2) (Exhibit"B")-PID#88512; Tract 1-B, Replat of Lot 2 and Part of Lot 3, Block 92, City
of Port Arthur Addition;commonly known as 1332 Rev.Ransom Howard Street;
3) (Exhibit"C")-PID#416320;Tract 1-C,Replat of Lots 3-5,Block 92,City of Port Arthur
Addition; located in the 1300 block of Rev. Ransom Howard Street;
4) (Exhibit"D")-PID#88513;Tract 1-D,Replat of Part of Lot 4 and All of Lot 5,Block 92,

SECTION 3.That the conveyance is hereby authorized,subject to the following terms and
conditions:
1. The purchase price for each tract shall be Ten and No/100 Dollars ($10.00).
2. Legacy CDC shall construct a new affordable single-family residential home on
each tract in accordance with the development plan approved by the City.
3. Construction of the home on each tract shall be substantially completed within one
(1) year of the date the tract is conveyed. If construction is not substantially
completed on a particular tract within that time, ownership of that tract shall revert
to the City. Each tract shall be considered separately for purposes of this
requirement.
SECTION 4. That in the event Legacy CDC fails to commence and/or complete
construction within the required period, or abandons construction after commencement, the
property shall revert back to the City and Legacy CDC shall execute any documents necessary to
reconvey the property to the City.
SECTION 5. That a copy of the caption of this Ordinance be spread upon the Minutes of
the City Council.
