RE: P.R. NO. 24985 — A resolution calling for a public hearing to consider a
Zoning Map Amendment (Zone Change).
Introduction:
The Port Arthur City Council is being asked to consider the approval of Proposed
Resolution No. 24985, calling for a public hearing to consider granting a Zoning Map
Amendment for 15.48 Acres of Land out of and a part of 65 Tr 6&7, I W Burton, 12.610
383 Tr 6, R Wilson Labor 2.890, City of Port Arthur, Jefferson County, Texas. The
property is located West of Dowling Road and North of S. 8th Street.
The request aims to amend the zoning from an Agricultural District (AG) to a Heavy
Industrial District (HI) for the development of two (2) Batch Plants.
Background:
On or around April 29, 2026, an application for a Zoning Map Amendment was filed with
the Planning & Zoning Division.
In accordance with Appendix A, Section 6.03 of the City of Port Arthur Zoning
Ordinance, any person or corporation having a proprietary interest in any property may
petition the city council for a change or amendment to the provisions of this ordinance.
The Planning & Zoning Commission may, on its own motion or on request from the City
Council, institute a study and proposal for changes and amendments in public interest.

The Planning & Zoning Department has sent out notification of the hearing date and
time published in the city's official newspaper and mailed to adjacent property owners
within a 200-foot radius at least 15 days before the public hearing.
The Planning & Zoning Commission conducted a public hearing on June 1, 2026, at
5:30 P.M.

Recommendation:
It is recommended that the City Council consider the approval of Proposed Resolution
No. 24985, calling for a public hearing to consider granting a Zoning Map Amendment
for approximately 15.48 Acres of Land out of and a part of 65 Tr 6&7, I W Burton, 12.610
383 Tr 6, R Wilson Labor 2.890, City of Port Arthur, Jefferson County, Texas.
The City Council public hearing shall be held on Tuesday, July 14, 2026, at 10:00 A.M.

WHEREAS, it is being requested that the City Council consider a Zoning Map Amendment for
15.48 Acres of Land out of and a part of 65 Tr 6&7, I W Burton, 12.610 383 Tr 6, R Wilson Labor 2.890,
City of Port Arthur, Jefferson County, Texas, as delineated in Exhibit "B"; and,
WHEREAS, pursuant to Chapter 211 in the Texas Local Government Code, a public hearing
must precede any zoning change; and,
WHEREAS, Section 211.006(a) of the Texas Local Government Code requires notice of the
public hearing before the governing body to be published in the official newspaper or a newspaper of
general circulation in the municipality before the fifteenth (15th) day before the date of the hearing.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT
ARTHUR, TEXAS:
THAT, the facts and opinions in the preamble are true and correct.
THAT, the Planning and Zoning Commission held a public hearing for this case on June 1,
2026.
THAT, the notice of the public hearing for the Planning and Zoning Commission was published
in the city's official newspaper and mailed to adjacent property owners within a 200-ft radius of the
proposed site on May 16, 2026.
THAT, a public hearing with the Port Arthur City Council to consider this Zoning Map
Amendment for 15.48 Acres of Land out of and a part of 65 Tr 6&7, I W Burton, 12.610 383 Tr 6, R

Wilson Labor 2.890, City of Port Arthur, Jefferson County, Texas, as delineated in Exhibit "B" shall be
held on July 14, 2026, at 10:00 a.m. in the City Council Chambers, Fifth Floor, City Hall, 444 4th Street,
Port Arthur, Texas, or by telephonic and videoconference.
THAT, in accordance with Section 211 .006(a) of the Texas Local Government Code, public
notice of the Port Arthur City Council public hearing shall be published in the official newspaper or a
newspaper of general circulation in the City before the fifteenth (15th) day before the date of the public
hearing, in substantially the same form as delineated in Exhibit "A."
THAT a copy of the caption of this Resolution is spread upon the Minutes of the City Council.
READ, ADOPTED, AND APPROVED this day of June, A.D. 2026, at a Regular Meeting
