Background: In March 2026, the City experienced the collapse of a 15-inch sanitary sewer line located at or near 4863 60th Street.The failure obstructed sewer flow,resulting in a continuing sanitary sewer overflow, posing an immediate threat to public health and safety and exposing the City to potential regulatory violations. The collapsed sewer line was located approximately twenty(20) feet below ground surface and required specialized equipment and construction methods not available through City forces.Due to the emergency nature of the situation,City staff issued an Emergency Memorandum on March 6, 2026, and immediately contacted qualified contractors capable of responding to the emergency conditions. After reviewing available pricing and contractor availability, Global Drilling, Inc. of Winnie, Texas, was selected to perform the emergency repairs and promptly mobilized to the site. During excavation and repair activities, significant unforeseen conditions were encountered, substantially expanding the scope of work. These conditions included additional failures within the sewer system, damaged manholes, and obstructions consisting of timber, concrete, and reinforcing steel located within the existing sewer line.As a result,the emergency repair evolved from a localized point repair into a larger rehabilitation project necessary to eliminate the continuing sewer overflow and restore system functionality. The completed emergency work included the installation of approximately 520 linear feet of HDPE sanitary sewer pipe utilizing directional drilling and pipe-bursting methods, repair of multiple manholes, extensive cleaning and clearing operations, and other related repairs necessary to protect public health and prevent further system failure. "Remember,we are here to serve the Citizens of Port Arthur" Legal review: Texas Local Government Code Section 252.022(a)(1) exempts a procurement from competitive bidding requirements when a public calamity requires the immediate expenditure of public funds to relieve the necessity of the municipality's residents or preserve municipal property. Texas Local Government Code Section 252.022(a)(2) further exempts procurements necessary to preserve or protect the public health or safety of municipal residents. Staff has determined that the emergency sewer failure constituted both a public calamity and a threat to public health and safety, thereby qualifying the procurement for the statutory emergency exemptions.The additional work performed by Global Drilling,Inc.was necessitated by conditions discovered only after excavation and was required to eliminate the continuing sanitary sewer overflow, restore sewer service, and prevent potential regulatory violations. Budget Impact: The initial emergency estimate for the repair was$298,000.00.Due to the unforeseen subsurface conditions and additional repairs required to stop the sanitary sewer overflow and restore service, the total project cost increased by$347,400.00,resulting in a final project cost of$645,400.00. Global Drilling, Inc. has completed all emergency repair work and submitted a final invoice in the amount of$645,400.00. Funds are available in CIP Account No. 405-40-000-8516-00-00-000, Project No. WS0032.OTH. Recommendation: Staff recommends that the City Council ratify the emergency procurement and repair services performed by Global Drilling, Inc., and authorize payment of$645,400.00 for the completed emergency sewer repair project at 4863 60th Street. A RESOLUTION RATIFYING THE EMERGENCY SEWER REPAIR PERFORMED AT 4863 60TH STREET; AUTHORIZING PAYMENT TO GLOBAL DRILLING, INC., OF WINNIE, TEXAS, IN THE AMOUNT OF $645,400.00; FINDING THAT THE PROCUREMENT QUALIFIED FOR THE EMERGENCY EXEMPTIONS SET FORTH IN SECTIONS 252.022(a)(1) AND 252.022(a)(2) OF THE TEXAS LOCAL GOVERNMENT CODE; AND PROVIDING FOR FUNDING FROM CIP ACCOUNT NO.405-40-000-8516-00-00- 000,PROJECT NO.WS0032.OTH. WHEREAS,the City of Port Arthur experienced the collapse of a 15-inch sanitary sewer line located near 4863 60th Street, which obstructed sewer flow and resulted in a continuing sanitary sewer overflow that threatened the public health, safety, and welfare of the City's residents; and WHEREAS, the collapsed sewer line was located approximately twenty (20) feet below ground surface and required specialized equipment, expertise, and construction methods not available to the City; and WHEREAS, due to the immediate threat posed by the sewer overflow, City staff determined that emergency action was necessary to restore service, prevent additional damage to public infrastructure, and avoid potential violations of state environmental regulations; and WHEREAS, on March 6, 2026,the City issued an Emergency Memorandum authorizing the immediate procurement of emergency repair services and obtained pricing from three qualified contractors capable of performing the work under emergency conditions, as reflected in Exhibit "A"; and WHEREAS, Global Drilling, Inc., of Winnie, Texas, was engaged to perform the emergency sewer repairs based upon its ability to immediately mobilize and complete the work necessary to alleviate the emergency condition; and(Exhibit"B"); and, WHEREAS, during excavation and repair activities, conditions materially different from those originally observed were encountered,including additional failures within the sewer system, unforeseen obstructions consisting of timber, concrete, and reinforcing steel within the existing line, damaged manholes, and other subsurface conditions requiring additional construction methods and repairs beyond the originally anticipated scope of work; and WHEREAS, in order to eliminate the continuing sanitary sewer overflow and restore the integrity of the collection system, Global Drilling, Inc. installed approximately five hundred twenty (520) linear feet of HDPE sanitary sewer pipe utilizing directional drilling and pipe- bursting methods, repaired multiple manholes, performed additional cleaning and clearing operations, and completed other related emergency work necessary to protect public health and safety; and WHEREAS, the additional emergency work increased the overall cost of the project by approximately $347,400.00 above the original estimated amount of$298,000.00, resulting in a total project cost of$645,400.00; and PR No.24983 3/4/26 cm-tnr WHEREAS, Global Drilling, Inc. has completed the emergency repairs and submitted its final invoice in the amount of$645,400.00, attached hereto as Exhibit"C"; and WHEREAS, the City Council finds that the procurement and performance of the emergency work were necessary to address a public calamity requiring the immediate expenditure of public funds to relieve the necessity of the City's residents and preserve municipal property, as authorized by Section 252.022(a)(1) of the Texas Local Government Code; and WHEREAS, the City Council further finds that the procurement and performance of the emergency work were necessary to preserve and protect the public health and safety of the City's residents, as authorized by Section 252.022(a)(2) of the Texas Local Government Code. NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR,TEXAS: THAT,the facts and opinions in the preamble are true and correct; and THAT,the City Council hereby ratifies the emergency procurement and emergency repair services performed by Global Drilling, Inc., of Winnie, Texas, in connection with the collapsed sanitary sewer line located near 4863 60th Street; and THAT, the City Council hereby authorizes payment to Global Drilling, Inc. in the total amount of$645,400.00 for the completed emergency sewer repair project, as reflected in Exhibit "C". Funding for this expenditure shall be provided from CIP Account 405-40-000-8516-00-00- 000,Project No. WS0032.OTH; and • THAT, a copy of the caption of this Resolution shall be spread upon the Minutes of the Meeting of the City Council. The 15-inch sewer line on 4863 60th Street collapsed,impeding the flow. The sewer line is 20 feet deep, with the nearby manhole damaged. The city doesn't have the proper equipment to repair. The city staff and contractors met on-site immediately to discuss the method for fixing the infrastructure. It causes serious public health and safety issues without repairing the collapsed line. The sewer line needs to be repaired to keep the peak sewer flowing from 46th Street. The site needs to be cleaned out,excavated to the sewer line,and the manholes repaired/replaced.Based on the current situation,the estimated repair expenditure is approximately $300,000.
