Introduction:
The intent of this Agenda Item is to seek the City Council's approval for the 2026 Community
Development Block Grant and HOME application to the Department of Housing and Urban
Development.
Background:
Pursuant to the Housing and Urban Development Act of 1974, as amended, Public Law 93-383,
the City will submit to the United States Department of Housing and Urban Development(HUD)
the 2026 Consolidated Plan as an application for a grant in the amount of$1,041,727 for
Community Development Block Grant Funds (CDBG) and a grant for$317,919.18 in HOME
funds.
The Consolidated Plan is designed to help states and local jurisdictions assess their affordable
housing and community development needs and market conditions and to make data-driven,
place-based investment decisions. The consolidated planning process serves as the framework
for a community-wide dialogue to identify housing and community development priorities that
align and focus funding from the CPD formula block grant programs: Community Development
Block Grant(CDBG) Program, HOME Investment Partnerships(HOME) Program, Housing
Trust Fund(HTF), Emergency Solutions Grants(ESG) Program, and Housing Opportunities for
Persons With AIDS (HOPWA) Program. The Consolidated Plan is carried out through Annual

Action Plans, which provide a concise summary of the actions, activities, and federal and non-
federal resources used each year to address the priority needs and goals identified in the
Consolidated Plan. Grantees report on accomplishments and progress toward Consolidated Plan
goals in the Consolidated Annual Performance and Evaluation Report(CAPER).
Budget Impact:
Community Development Block Grant and HOME are the funding sources.
Recommendation:
It is recommended that the City Council approve P. R. #25011.

THE APPLICATIONS AND ACCEPTANCE OF SUCH GRANTS,
IF AWARDED.
WHEREAS, pursuant to the Housing and Community Development Act of 1974, as
amended,the United States Department of Housing and Urban Development("HUD") administers
the Community Development Block Grant ("CDBG") Program and the HOME Investment
Partnerships("HOME")Program to assist eligible jurisdictions in meeting affordable housing and
community development needs; and
WHEREAS, as a HUD entitlement community, the City of Port Arthur is required to
prepare and submit an Annual Action Plan as part of HUD's Consolidated Plan process in order to
remain eligible to receive CDBG and HOME Program funding; and
WHEREAS,the City has prepared its 2026 Annual Action Plan,which identifies the City's
priority housing and community development needs,proposed activities,anticipated expenditures,
and required certifications,including the proposed CDBG budget attached hereto as Exhibit "A";
and
WHEREAS, the Consolidated Plan process provides a comprehensive framework for
identifying local housing and community development priorities and allocating federal resources
to address those priorities through the Community Planning and Development formula grant
programs administered by HUD; and
WHEREAS, in accordance with HUD regulations, the City has provided citizens with
meaningful opportunities to participate in the planning process, including public hearings
conducted on April 9, 2026, and June 11, 2026, at 300 4`'' Street at the Development Services
Building, during which public comments and recommendations regarding the proposed use of
CDBG and HOME funds were received and considered; and
WHEREAS, the City desires to submit its 2026 Annual Action Plan to HUD as an
application for Community Development Block Grant funding in the amount of$1,041,727.00 and
HOME Investment Partnerships Program funding in the amount of $317,919.18 for the 2026
Program Year; and
WHEREAS, the City Council finds that it is in the best interest of the City of Port Arthur
to authorize the City Manager to execute and submit the required applications, certifications,
agreements,and all other documents necessary to obtain and administer such federal grant funding.

NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR, TEXAS:
Section 1.The recitals and opinions are hereby true and correct.
Section 2. The City Manager is hereby authorized to submit the City of Port Arthur's
2026 Annual Action Plan to the United States Department of Housing and Urban Development
as required under the Consolidated Plan process.
Section 3. The City Manager is authorized to apply for Community Development Block
Grant(CDBG) funding in the amount of$1,041,727.00 and HOME Investment Partnerships
(HOME) Program funding in the amount of$317,919.18 for the 2026 Program Year.
Section 4. A copy of the Consolidated Annual Plan is attached hereto in substantially the
same form as Exhibit"A"; and,
Section 5. The City Manager is additionally authorized to execute any supplementary
documents necessary for the United States Department of Housing and Urban Development to
implement the objectives of this Resolution and to accept such grants if awarded.
Section 6. A copy of the caption of this Resolution shall be spread upon the minutes of
the City Council.

APPENDIX TO CERTIFICATIONS
INSTRUCTIONS CONCERNING LOBBYING CERTIFICATION:
Lobbying Certification
This certification is a material representation of fact upon which reliance was placed when this
transaction was made or entered into. Submission of this certification is a prerequisite for making or
entering into this transaction imposed by section 1352,title 31,U.S. Code.Any person who fails to file
the required certification shall be subject to a civil penalty of not less than$10,000 and not more than
$100,000 for each such failure.
CERTIFICATIONS
In accordance with the applicable statutes and the regulations governing the consolidated plan
regulations,the jurisdiction certifies that:
Affirmatively Further Fair Housing--The jurisdiction will affirmatively further fair housing.
Uniform Relocation Act and Anti-displacement and Relocation Plan-- It will comply with the
acquisition and relocation requirements of the Uniform Relocation Assistance and Real Property
Acquisition Policies Act of 1970,as amended,(42 U.S.C.4601-4655)and implementing regulations at
49 CFR Part 24.It has in effect and is following a residential anti-displacement and relocation assistance
plan required under 24 CFR Part 42 in connection with any activity assisted with funding under the
CommunityDevelopment Block Grant or HOME programs.

funding, in accordance with applicable HUD regulations.
Consistency with plan--The housing activities to be undertaken with Community Development Block
Grant,HOME, Emergency Solutions Grant,and Housing Opportunities for Persons With AIDS funds are
consistent with the strategic plan in the jurisdiction's consolidated plan.
Section 3--It will comply with section 3 of the Housing and Urban Development Act of 1968 (12
U.S.C. 1701u)and implementing regulations at 24 CFR Part 75.

Title
Specific Community Development Block Grant Certifications
The Entitlement Community certifies that:
Citizen Participation--It is in full compliance and following a detailed citizen participation plan that
satisfies the requirements of 24 CFR 91.105.
Community Development Plan--Its consolidated plan identifies community development and housing
needs and specifies both short-term and long-term community development objectives that that have
been developed in accordance with the primary objective of the CDBG program(i.e.,the development of
viable urban communities,by providing decent housing and expanding economic opportunities,primarily
for persons of low and moderate income)and requirements of 24 CFR Parts 91 and 570.
Following a Plan--It is following a current consolidated plan that has been approved by HUD.
Use of Funds--It has complied with the following criteria:
1. Maximum Feasible Priority. With respect to activities expected to be assisted with
CDBG funds, it has developed its Action Plan so as to give maximum feasible priority to
activities which benefit low-and moderate-income families or aid in the prevention or
elimination of slums or blight. The Action Plan may also include CDBG-assisted activities
which the grantee certifies are designed to meet other community development needs having
particular urgency because existing conditions pose a serious and immediate threat to the health
or welfare of the community,and other financial resources are not available(see Optional
CDBG Certification).
2. Overall Benefit.The aggregate use of CDBG funds, including Section 108 guaranteed
loans, during program year(s)2025,2026,2027 [a period specified by the grantee of one, two,
or three specific consecutive program years], shall principally benefit persons of low and
moderate income in a manner that ensures that at least 70 percent of the amount is expended for
activities that benefit such persons during the designated period.
3. Special Assessments.It will not attempt to recover any capital costs of public
improvements assisted with CDBG funds, including Section 108 loan guaranteed funds,by
assessing any amount against properties owned and occupied by persons of low and moderate
income, including any fee charged or assessment made as a condition of obtaining access to
such public improvements.
However, if CDBG funds are used to pay the proportion of a fee or assessment that relates to the
capital costs of public improvements(assisted in part with CDBG funds)financed from other
revenue sources,an assessment or charge may be made against the property with respect to the
public improvements financed by a source other than CDBG funds.
In addition, in the case of properties owned and occupied by moderate-income(not low-income)
families,an assessment or charge may be made against the property for public improvements
financed by a source other than CDBG funds if the jurisdiction certifies that it lacks CDBG
funds to cover the assessment.
Excessive Force--It has adopted and is enforcing:
1. A policy prohibiting the use of excessive force by law enforcement agencies within its
jurisdiction against any individuals engaged in non-violent civil rights demonstrations;and
2. A policy of enforcing applicable State and local laws against physically barring entrance
to or exit from a facility or location which is the subject of such non-violent civil rights
demonstrations within its jurisdiction.
Compliance with Anti-discrimination laws--The grant will be conducted and administered in
conformity with title VI of the Civil Rights Act of 1964(42 U.S.C.2000d)and the Fair Housing Act(42
U.S.C. 3601-3619)and implementing regulations.
Lead-Based Paint--Its activities concerning lead-based paint will comply with the requirements of 24
CFR Part 35, Subparts A,B,J,K and R.
Compliance with Laws--It will comply with applicable laws.

Specific HOME Certifications
The HOME participating jurisdiction certifies that:
Tenant Based Rental Assistance--If it plans to provide tenant-based rental assistance,the tenant-based
rental assistance is an essential element of its consolidated plan.
Eligible Activities and Costs--It is using and will use HOME funds for eligible activities and costs,as
described in 24 CFR§§92.205 through 92.209 and that it is not using and will not use HOME funds for
prohibited activities,as described in §92.214.
Subsidy layering--Before committing any funds to a project, it will evaluate the project in accordance
with the guidelines that it adopts for this purpose and will not invest any more HOME funds in
combination with other Federal assistance than is necessary to provide affordable housing;

Emergency Solutions Grants Certifications
The Emergency Solutions Grants Program recipient certifies that:
Major rehabilitation/conversion/renovation—If an emergency shelter's rehabilitation costs exceed
75 percent of the value of the building before rehabilitation,the recipient will maintain the building as a
shelter for homeless individuals and families for a minimum of 10 years after the date the building is first
occupied by a homeless individual or family after the completed rehabilitation.
If the cost to convert a building into an emergency shelter exceeds 75 percent of the value of the building
after conversion,the recipient will maintain the building as a shelter for homeless individuals and
families for a minimum of 10 years after the date the building is first occupied by a homeless individual
or family after the completed conversion.
In all other cases where ESG funds are used for renovation,the recipient will maintain the building as a
shelter for homeless individuals and families for a minimum of 3 years after the date the building is first
occupied by a homeless individual or family after the completed renovation.
Essential Services and Operating Costs—In the case of assistance involving shelter operations or
essential services related to street outreach or emergency shelter,the recipient will provide services or
shelter to homeless individuals and families for the period during which the ESG assistance is provided,
without regard to a particular site or structure, so long the recipient serves the same type of persons(e.g.,
families with children,unaccompanied youth, disabled individuals,or victims of domestic violence)or
persons in the same geographic area.
Renovation—Any renovation carried out with ESG assistance shall be sufficient to ensure that the
building involved is safe and sanitary.
Supportive Services—The recipient will assist homeless individuals in obtaining permanent housing,
appropriate supportive services(including medical and mental health treatment,victim services,
counseling, supervision,and other services essential for achieving independent living),and other Federal
State, local,and private assistance available for these individuals.
Matching Funds—The recipient will obtain matching amounts required under 24 CFR 576.201.
Confidentiality—The recipient has established and is implementing procedures to ensure the
confidentiality of records pertaining to any individual provided family violence prevention or treatment
services under any project assisted under the ESG program, including protection against the release of
the address or location of any family violence shelter project,except with the written authorization of the
person responsible for the operation of that shelter.
Homeless Persons Involvement—To the maximum extent practicable,the recipient will involve,
through employment,volunteer services,or otherwise,homeless individuals and families in constructing,
renovating,maintaining,and operating facilities assisted under the ESG program, in providing services
assisted under the ESG program,and in providing services for occupants of facilities assisted under the
program.
Consolidated Plan—All activities the recipient undertakes with assistance under ESG are consistent
with its consolidated plan.
Discharge Policy—The recipient will establish and implement,to the maximum extent practicable and
where appropriate,policies and protocols for the discharge of persons from publicly funded institutions
or systems of care(such as health care facilities,mental health facilities,foster care or other youth

facilities,or correction programs and institutions)in order to prevent this discharge from immediately
resulting in homelessness for these persons.

Housing Opportunities for Persons With AIDS Certifications
The HOPWA grantee certifies that:
Activities--Activities funded under the program will meet urgent needs that are not being met by
available public and private sources.
Building--Any building or structure assisted under that program shall be operated for the purpose
specified in the consolidated plan:
1. For a period of not less than 10 years in the case of assistance involving new construction,
substantial rehabilitation,or acquisition of a facility,
2. For a period of not less than 3 years in the case of assistance involving non-substantial
rehabilitation or repair of a building or structure.

For instance,while the goal for homeownership assistance was to support 10 households, Port Arthur

resource allocation. However,the city exceeded its goals in other areas,such as homeowner housing
rehabilitation and direct financial assistance to homebuyers.This indicates effective use of allocated
funds and successful project implementation in those categories.

The City of Port Arthur encourages citizens to provide input in the ConPlan and Annual Plan process. Accordingly,the public engagement
meetings on priority needs were held on April 9, 2026,and June 11, 2026. Public notices posted on the Port Arthur News informed the public
about the hearings.Attendees were allowed to provide verbal and written comments.
The Draft Plan of the Annual Consolidated Plan was published in the local newspaper, and the Draft Report was made available for a 30-day

Goal The City of Port Arthur's goal is to preserve and improve the existing affordable housing stock by providing financial

Through this activity,affordable housing is preserved, and the quality and safety of existing housing is improved,the

experiencing severe housing conditions, consistent with the priorities identified in the Consolidated Plan.

There is a great need for Homeowners to be assisted with emergency/minor repairs, including plumbing
repairs(including water/sewer line repairs),electrical repairs, eligible roof repairs,and rental assistance
through the implementation of a Tenant-Based Rental Assistance/Lease Purchase Program.
The City's priorities and objectives will continue to help provide affordable,decent, & safe homes for
citizens.
Fulfilling the American Dream of homeownership for citizens is a priority for the city.The Tenant-Based

The proposed allocation of funds is based on federal funding requirements for each formula-allocated
grant. Areas of low to moderate-income concentration and certain areas of high minority concentration
are targeted. Areas of low homeownership and deteriorating housing conditions were also considered in
the targeting process.
Discussion
The distribution of funds by target area is projected to be primarily citywide, due to the use of funds for

Housing Authority manages the following Project-Based Voucher apartments: Edison Square-a newly
constructed 78-unit Project-Based Voucher elderly site; Park Central apartment-a newly built 186-unit
complex with 46 Project-Based Voucher rental-assisted units and 92 Rental Assistance Demonstration
(RAD) Project-Based units. Under the Veterans Affairs Supportive Housing (VASH) Program, 21 veterans
are being helped. The Port Arthur Housing Authority also serves families in the Section 8 Housing
Choice Voucher program. The Port Arthur Housing Authority also administers a Foster Youth to
Independence (FYI) Program that provides housing assistance for three families.
The Housing Authority will continue to seek avenues to leverage private or other public funds to create
additional housing opportunities and improve collaboration with community and national partners to
assist homeless individuals.

However,various barriers—such as restrictive land use regulations, high development costs, limited
availability of land and resources, and administrative challenges—continue to impede the production
and preservation of affordable housing.
This Annual Action Plan identifies the key barriers to affordable housing within the City of Port Arthur
and outlines strategic actions to mitigate or eliminate these obstacles.The Plan reflects the community's
commitment to fostering housing opportunities for low- and moderate-income households, consistent
with the goals outlined in the Consolidated.
By addressing these barriers,the City aims to promote fair housing choice,expand the supply of
affordable units, and support sustainable community development under federal regulations under 24
CFR 91.220(j) and related guidelines.

as barriers to affordable housing such as land use controls,tax policies affecting land, zoning

instance, zoning regulations that heavily restrict multi-family housing options can limit the availability of
affordable rental units, and may be amended to remove barriers that would impede the development of
affordable housing.Additionally, amending lengthy permitting processes can discourage developers
from undertaking new construction projects, hindering the growth of affordable housing stock.
Supporting the development of affordable housing would also be considered.
Discussion:
The City of Port Arthur has no policies in place that hinder the availability of affordable housing.
Although no action or reform steps are required,the city will continue to seek resourceful and
innovative ways to make affordable housing available to all residents.

Introduction:
The city currently provides a variety of services to Port Arthur residents, some funded by CDBG
and HOME allocations. Private, State,and City funding brings additional assets to bear on these
problems. Below are some of the actions currently performed by the City or that are under
consideration for the future.

The city will continue to seek new funding sources for programs that address underserved needs.
Funding is the major obstacle to providing the services needed to address the wide variety of issues that
prevent families from breaking out of poverty and living in the best, most affordable housing possible.

The city will consider providing financial assistance for Tax Credit Projects for affordable housing
development to expand multi-family rental development projects and homeownership opportunities
when those projects are presented for review.Additionally, acquisition, soft costs, and site development

of the pre-development phase.

• Continue to meet HUD lead-based paint abatement standards in housing rehabilitation

Introduction:
Pursuant to 24 CFR 91.220(1), the City describes below how it will carry out activities funded under the
Community Development Block Grant(CDBG) and HOME Investment Partnerships (HOME) Programs.
1.Community Development Block Grant(CDBG)—24 CFR 91.220(I)(1)
The City will use CDBG funds primarily to benefit low-and moderate-income persons in accordance with
applicable federal regulations.The City certifies that, over the applicable certification period, not less
than seventy percent (70%)of its CDBG funds will be expended for activities that benefit low-and
moderate-income persons. Planned activities include emergency and minor housing rehabilitation,
eligible public infrastructure improvements, down payment and closing cost assistance, and other
eligible activities that address the priority housing and community development needs identified
through the Consolidated Plan and citizen participation process.
2. HOME Investment Partnerships Program(HOME)—24 CFR 91.220(1)(2)
HOME funds will be used to expand and preserve the supply of safe, decent, sanitary, and affordable
housing for income-eligible households.All HOME-assisted housing will comply with the affordability
requirements set forth in 24 CFR 92.252 and 24 CFR 92.254,as applicable.
Eligible HOME activities may include homebuyer assistance,acquisition of vacant lots for affordable
housing development, housing rehabilitation, new construction of affordable housing, and Tenant-Based
Rental Assistance (TBRA)for eligible households for a period of up to twelve(12) months.TBRA is
intended to provide temporary rental assistance that enables low-income households to obtain and
maintain safe, decent, and affordable housing while working toward long-term housing stability and
self-sufficiency.
The City does not intend to limit or give preference to any particular segment of the low-income
population except where permitted under 24 CFR 92.253(d)(3)and consistent with all applicable fair
housing and nondiscrimination requirements.

The City will continue to support the many efforts of the non-profits and social service provider
agencies in the community in their efforts to obtain funding from various sources for their

Many of these organizations receive private donations to sustain their programs,and most apply for
funding at the federal, state, and local levels.
The availability of federal funds enhances any of the listed programs and would mean that more
services and housing could be provided. Because of the scarcity of any type of funding, the City has
been working with various organizations to try to develop programs that would increase the
leveraging capacity of federal funding mechanisms so that more money would be available for other

needed endeavors. Better use of the existing resources is a main concern for everyone.

The HOME Recapture Provisions are established by§92.253(a) (5) (ii)and do not permit the original
homebuyer to sell the property to any willing buyer during the period of affordability. The
repayment conditions for the FTHB assistance stated previously outline the shared market
appreciation,also referred to as the share of net proceeds.
Recapture provisions are in effect for the term identified in the locally adopted term as identified by
HUD, for the years from the date of each settlement. Recapture is enforced through deed
restrictions to ensure that the entire amount of HOME assistance to homebuyers is recouped if the
housing does not continue to be the principal residence of the family for the duration of the period
of affordability.
The Federal funds invested are secured by a Written Loan Agreement and a recorded Second Lien
Deed of Trust, and a Borrower Agreement Note, of which the principal amount of the Note
represents funds advanced by the City to or for the borrower's benefit to assist them in paying part
of the purchase price of the Property and/or the closing costs on the Property or both. On the same
date as the date of the Note, the borrower will have agreed with City that the borrower will,among
other things, continue to use the Property as their principal residence and will use the Property for
low-income housing as defined in such agreement for 5 years, 10 years, or 15 years after the date of
the Note. If for any reason the borrower default under any of the provisions of the Borrower
Agreement,then the City will accelerate the maturity of the Note and recoup all or a portion of the
HOME assistance to the homebuyers if the housing does not continue to be the principal residence
of the family for the duration of the period of affordability in compliance with 24 CFR
92.254(a)(5)(ii). The period of affordability is based on the total amount of HOME funds initially
invested in the housing.
3. A description of the guidelines for resale or recapture that ensures the affordability of units acquired
with HOME funds?See 24 CFR 92.254(a)(4)are as follows:

HOME funds)and any closing costs in compliance with 24 CFR 92.254(a)(5)(ii)(A).
If, on the sale, lease, lease with an option to purchase, transfer or other disposition (excluding any
contract for deed)of all or any interest in the Property,the Borrowers Agreement is still in effect
and the borrower still owe amounts under the Note, Note Holder may require payment in full of
sums owed hereunder as are specifically provided by the Second Lien Deed of Trust (hereinafter
defined) and the date upon which Note Holder requires such payment in full for any reason
hereunder is called the maturity date.
The borrower will make payment in full to the City of Port Arthur as Note Holder at a designated
place or a different place if required by the Note Holder.
The indebtedness evidence by the Note, and any other financial obligation which may hereafter be
imposed on borrower by the Lender, is subordinate to the indebtedness evidence by a note payable
to a senior lender(Senior Lien Holder), which note is secured by a first deed of trust (the First Deed
of Trust) dated of even date therewith encumbering certain real property located in Port Arthur,
Texas.
The period of affordability is based on the total amount of HOME funds initially invested in the
housing.
4. Plans for using HOME funds to refinance existing debt secured by multifamily housing that is
rehabilitated with HOME funds along with a description of the refinancing guidelines required that

The TBRA program will ensure that any such preference is applied in a manner that is consistent
with federal fair housing and civil rights requirements and will not restrict participation solely based
on disability type. Outreach will be conducted in collaboration with service providers and advocacy
organizations that serve persons with disabilities to ensure equitable access and to help identify
eligible households that can benefit from TBRA assistance.
6. If applicable to a planned HOME TBRA activity, a description of how the preference for a specific
category of individuals with disabilities(e.g. persons with HIV/AIDS or chronic mental illness)will
narrow the gap in benefits and the preference is needed to narrow the gap in benefits and services
received by such persons. (See 24 CFR 92.209(c)(2)(ii)and 91.220(I)(2)(vii)).
The preference will be designed in coordination with local service providers, public health agencies,
and advocacy groups to ensure it effectively targets unmet needs. For example, persons with
HIV/AIDS may face heightened risk of housing instability due to discrimination and medical costs,
while persons with chronic mental illness may encounter challenges in securing housing without
supportive services.The TBRA preference will help close these gaps by linking housing assistance
with existing health, case management,and supportive services networks.
All preferences will comply with fair housing, civil rights, and nondiscrimination requirements and
will be based on data and demonstrated community needs.
