R. No. 15633-Z09-03-PD-NS #26 (AKA Tract 2A, of the Whittington Place No. 2 Addition and Joseph Grigsby League, City of Port Arthur, Jefferson County, Texas) DATE: 11/20/09 BACKGROUND: Thee City Council is being asked to consider proposed resolution 15633 requesting that a public hearing be set regarding the rezoning of 4400 Atlantic Avenue for January 5, 2010, such that this property may be changed from "SF" (single -family) to PD-NS (planned development for neighborhood services -excluding educational /institutional, amusement, temporary-permit, transportation related, commercial type, special industrial and agricultural uses) in accordance with the Schedule of Uses in the Zoning Ordinance. The; acreage is approximately 3.400 acres anti the property is located north of 39t"Street and east of State Highway 366 (A.K.A. Atlantic Road). The proposed zoning "PD-NS" (planned development for neighborhood services) is to accommodate a private lodge with minimal "NS" uses so as not to infringe on the residential setting of the subdivision. Applicant- Rebecca Bellard Owner- Rebecca Bellard RECOMMENDATION: The; Planning and Zoning Commission recommends approval and requires that the Fire Department, Health Department and Building; Inspections Standards are met prior to the issuance of an occupancy permit. Public facilities and existing utilities shall match occupancy capacity for compliance operations. Off-street parking shall be sufficient for all activities with a minimum of 50 spaces too meet the ordinance requirements and (2) two spaces for handicap parking. BUDGETARY/FISCAL EFFECT: None STAFFING/EMPLOYEE EFFECT: None SUMMARY: The Planning and Zoning Commission considered this rezoning for approval noting the following uses and stipulations: WEDDING RECEPTIONS AND SIMILAR PARTIES, LUNCHEONS, CHARITABLE EVENTS AND GROUP FUNCTIONS. IN ADDITION, CORPORATE RECEPTIONS, DINNERS AND SPECIAL EVENT CELEBRATIONS. THE SCOPE OF THESE EVENTS SHALL BE IN LINE WITH PARKING AS ONLY OFF-STREET PARKING WILL BE ALLOWED; LANDSCAPING, AND THAT THE AESTHETIC NATURE OF THE FACILITY SHALL BE MAINTAINED INLINE WITH SURROUNDING PROPERTIES, SUCH THAT THE VIABLE NATURE OF THE PROPOSED LODGE DOES NOT COMPROMISE THE RESIDENTIAL SETTING. All City Codes and Ordinances, in accordance with Texas Department of Health Standards, International Fire Code and the International Building Codes, shall be met prior to the CO (certificate of occupancy) issued. 2. Relative to the parking spaces, no more than 106 persons shall be allowed in the dining facility or for events (with the exception of the staff) as per occupancy. 3. The hours of operation will be between Saturday to Sunday, excluding Mondays, with luncheons l la.m. to 2 p.m., and dinners 6 p.m.-10 p.m., due to surrounding setting. On Mondays, no public events are expected. 4. The screening (seven-foot wooden-fence with neighboring trees and bamboo plantings) will stay intact as a noise anal light reduction mechanism. In addition to compliance with the noise ordinance, the facility shall also use the first floor of the residence for office space, additional restrooms, and a commercial kitchen shall be in operation. No. 15633 11/15/2009 CWR RESOULUTION NO. __ A RESOLUTION CALLING FOR A PUBLIC HEARING FOR CONSIDERATION OF A ZONING CHANGE FROM "SF" (SINGLE-FAMILY) TO A "PD-NS" (PLANNED DEVELOPMENT FOR NEIGHBORHOOD SERVICES) LOCATED AT 4400 ATLANTIC ROAD AKA PORTIONS OF TRACTS 1,2,3,4, AND 5 OF THE WHITTINGTON PLACE NO. TWO ADDITION AND JOSEPH GRIGSBY LEAGUE A-27, APPROX[MATELY 3.400 ACRES THAT LIES ON THE EASTERN SECTOR OF ATLANTIC ROAD AND NORTH OF 39th STREET, IN PORT ARTHUR, JEFFERSON COUNTY, TEXAS WHEREAS, in keeping with The Schedule of Uses and the Zoning Ordinance, proposed is a zoning change for said property to have a residence and a lodge for dining and meeting events; and WHEREAS, a "PD-NS" (planned development with neighborhood service uses), excluding educational/institutional, amusemer.~t associated, temporary permit or transportation related, commercial, special industry and agricultural uses in nature as referenced in the Schedule of Uses,, will be implemented to allofw for such a private lodge for dining purposes; and WHEREAS, the redevelopment of 4400 Atlantic Road is approximately 3.400 acres composed of Tract 2A out of the Whittington Place No. 2 Addition, as well as the Joseph Grigsby League, Port Arthur, Jefferson County, Texas, as shown in Exhibit "A"; 3 Mayor ATTEST; City Secretary APPROVED AS TO FORM: V Acting City Attorney APPROVED FOR ADMINISTRATION: City Manager Director of Planning P.R. No. 15633 11/15/2009 CWR WHEREAS, in pursuant of Chapter 211 in the Texas Local Government Code, a public hearing must precede any zoning change, NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT a public hearing will be scheduled on January 5, 2010 by the City Council to consider said application for a PD- NS for a lodge for dining purposes, in addition to a residence in Case No. Z09-03-PD -NS#26. THAT notice of the public hearing shall be published at least fifteen days prior to the date of the public hearing in the official newspaper of the City. THAT a copy of the caption of this 1Zesolution be spread upon the Minutes of the Citv Council.
