Pickleball and Basketball Court
Introduction:
The purpose of this memorandum is to recommend approval of a Resolution authorizing the City Manager to
enter into a contract with Spark Lighting of Houston, Texas, for the removal and replacement of the existing
lighting system at the Babe Zaharias pickleball and basketball courts, located at 3500 Jimmy Johnson
Boulevard.
Background:
The existing lighting serving the pickleball and basketball courts at the Babe Zaharias recreational complex is
in need of replacement. Adequate lighting is necessary to maintain safe, functional recreational facilities and to
allow residents to use the courts in the evening. Spark Lighting has submitted a proposal to provide a turnkey
LED lighting system through BuyBoard Cooperative Purchasing Contract No. 790-26. The proposed
improvements include:
• Removal of six(6) existing wooden light poles;
• Installation of eight (8) new twenty-five-foot (25') above-grade round tapered aluminum direct-bury
light poles;
• Installation of sixteen(16) LED area light fixtures;
• Installation of new underground conduit and wiring;
• Installation of lighting controls; and
• Turnkey installation and commissioning of the LED lighting system.
The proposal further provides for a five-year manufacturer's warranty and a ninety-day labor warranty, subject
to the terms and conditions contained in the proposal attached to the Resolution as Exhibit "A."
Budget Impact:
Funding in the amount of $55,800.00 is available for this purpose in the Parks and Recreation Capital
Improvement Account Number 307-25-067-8525-00-10-000 Project Code PR0011.OTH. The proposed
procurement will be made through the BuyBoard Cooperative Purchasing Program under Contract No. 790-
26. The City previously authorized its participation in the BuyBoard cooperative purchasing program
pursuant to Resolution No. 02-341.
Recommendation:
It is recommended that the City Council approve P.R. No. 25100, authorizing the City Manager to enter into
a contract with Spark Lighting of Houston, Texas, for the installation of LED lighting improvements at the
Babe Zaharias pickleball and basketball courts, located at 3500 Jimmy Johnson Boulevard, in an amount not
to exceed $55,800.00.

BUYBOARD COOPERATIVE PURCHASING CONTRACT NO. 790-26,
IN AN AMOUNT NOT TO EXCEED $55,800.00. FUNDS ARE

WHEREAS, the Babe Zaharias recreational complex, located at 3500 Jimmy Johnson
Boulevard, includes pickleball and basketball courts that provide recreational opportunities for
the residents of the City of Port Arthur; and
WHEREAS, the existing lighting serving the pickleball and basketball courts is in need
of replacement to provide adequate, reliable, and safe illumination for recreational activities
during evening hours; and
WHEREAS, the proposed improvements include the removal of six (6) existing wooden
light poles; installation of eight (8) new twenty-five-foot (25') above-grade round tapered
aluminum direct-bury light poles; installation of sixteen (16) LED area light fixtures; installation
of new underground conduit and wiring; installation of lighting controls; and turnkey installation
of the complete LED lighting system; and
WHEREAS, Spark Lighting of Houston, Texas, is an awarded vendor under BuyBoard
Cooperative Purchasing Contract No. 790-26 and has submitted a proposal for the installation of
the LED lighting improvements at the Babe Zaharias pickleball and basketball courts in the
amount of $55,800.00 as more particularly described in the proposal attached hereto and
incorporated herein as Exhibit"A"; and
WHEREAS, the proposed work includes a five-year manufacturer's warranty and a
ninety-day labor warranty, as set forth in Exhibit"A"; and
WHEREAS, Chapter 271, Subchapter F, of the Texas Local Government Code
authorizes local governments to participate in cooperative purchasing programs and to enter into
cooperative purchasing agreements with other local governments and local cooperative
organizations; and
WHEREAS, pursuant to Resolution No. 02-341, the City of Port Arthur entered into an
interlocal agreement for cooperative purchasing through the Texas BuyBoard Cooperative
Purchasing Program; and
WHEREAS, the City Council finds that utilizing the BuyBoard Cooperative Purchasing
Program for the acquisition and installation of the proposed LED lighting improvements is in the

best interest of the City and will facilitate the timely replacement of the existing lighting
infrastructure; and
WHEREAS, sufficient funds are available for the project in Parks and Recreation
Capital Improvement Account No. 307-25-067-8525-00-10-000, Project Code PR.0011.OTH;
and
WHEREAS, the City Council finds that the authorization granted herein serves a valid
municipal purpose and is necessary and appropriate for the continued maintenance and
improvement of City recreational facilities.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR,TEXAS:
Section 1. That the facts and opinions in the preamble are true and correct.
Section 2. The City Manager is hereby authorized to execute, on behalf of the City of
Port Arthur, a contract with Spark Lighting of Houston, Texas, through BuyBoard Cooperative
Purchasing Contract No. 790-26, for the removal of the existing lighting infrastructure and the
furnishing and installation of a new LED lighting system at the Babe Zaharias pickleball and
basketball courts, located at 3500 Jimmy Johnson Boulevard, in an amount not to exceed
$55,800.00, substantially in accordance with the proposal attached hereto as Exhibit"A."
Section 3. Funding for the contract is available in the Parks and Recreation Capital
Improvement Account No. 307-25-067-8525-00-10-000, Project Code PR.0011.0TH.
Section 4. That a copy of the caption of this Resolution be spread upon the Minutes
of the City Council.

CONTRACT FOR LED LIGHTING SYSTEM IMPROVEMENTS AT BABE
ZAHARIAS PICKLEBALL AND BASKETBALL COURT BETWEEN THE
CITY OF PORT ARTHUR AND SPARK LIGHTING
THIS AGREEMENT, made this day of , 2026 by and between the City of
Port Arthur, a municipal corporation organized under the laws of the State of Texas, hereinafter
called"OWNER" or"CITY" and SPARK LIGHTING,hereinafter called "CONTRACTOR".
WITNESSED: That for and in consideration of the payments,terms, conditions, and agreements
set forth herein, OWNER and CONTRACTOR agree as follows:
1. The term of this Contract shall be from the date stated on the Notice to Proceed until October
31, 2026, unless sooner terminated under the provision hereof. The City can terminate this
contract at its convenience which includes, but not limited to, funding being available in any
budget cycle with thirty (30) days written notice.
2. The CONTRACTOR will perform LED lighting system improvements at the Babe Zaharias
pickleball and basketball courts for the City of Port Arthur as stated in the Contract
Documents.
3. During the term of this Contract, the CONTRACTOR will furnish at his own expense all of
the materials, supplies, tools, equipment, labor and other services necessary to perform the
repairs delineated in the bid specifications.
4. The CONTRACTOR agrees to perform all the work described in the specifications and
contract documents and to comply with the terms therein for a price not to exceed
$55,800.00.
5. The CONTRACTOR will ensure that Babe Zaharias pickleball and basketball courts are free
of all debris and ready for City use once all improvements are complete.
6. The term"Contract Documents"means and includes the following:
1) Agreement
2) Quote/Specifications
3) Notice to Proceed
7. This Agreement shall be binding upon all parties hereto and their respective heirs, executors,
administrators, successors and assigns.
8. IN WITNESS WHEREOF, the parties hereto have executed, or caused to be executed by
their duly authorized officials, this Agreement in(2 copies) each of which shall be deemed an
original on the date first above written.
