Background: The Public Works Landfill Division maintains a Texas Commission on Environmental Quality (TCEQ)permit to dispose of regional commercial and household waste. To keep this permit in good standing with the Texas Commission on Environmental Quality (TCEQ),the Landfill must have operational dozers onsite to move dirt and cover the trash. The Division's existing Caterpillar D5 Dozer(Unit 2466)undercarriage and tracks have reached the end of their service life due to daily use and require replacement, making repairs necessary and urgent. Mustang Cat of Beaumont, Texas, submitted a quote of $45,034.12 through the Sourcewell Cooperative Purchasing Program to replace the undercarriage and tracks to ensure optimal operation. Budget Impact: Funding is available in the Public Works Landfill Division Equipment Maintenance Account, 403-320-50-5318-00-00-000. A RESOLUTION AUTHORIZING THE REPLACEMENT OF THE UNDERCARRIAGE AND TRACKS ON THE D5 DOZER (UNIT 2466) FOR THE LANDFILL DIVISION BY MUSTANG CAT OF BEAUMONT, TEXAS, THROUGH THE SOURCEWELL COOPERATIVE PURCHASING PROGRAM FOR $45,034.12. FUNDS ARE AVAILABLE IN THE PUBLIC WORKS — LANDFILL DIVISION EQUIPMENT MAINTENANCE ACCOUNT, 403-320-50-5318-00-00-000. WHEREAS,the City of Port Arthur Public Works - Landfill Division maintains a permit issued by the Texas Commission on Environmental Quality(TCEQ)to accept and manage regional and commercial and solid waste; and, WHEREAS, to maintain a permit in good standing with TCEQ, the Landfill must have operational dozers onsite to compact and cover waste in compliance with state regulations; and, WHEREAS,the D5 Dozer(Unit 2466)is essential to comply with these regulations(cover waste); and, WHEREAS,the Divisions's existing Catepillar D5 Dozer's undercarriage and tracks have reached the end of their service life due to daily use and require replacement, making repairs necessary and urgent; and, WHEREAS, Chapter 271, Subchapter D, of the Texas Government Code, allows a city, by resolution of its governing body,to participate in cooperative purchasing programs such as the Sourcewell Cooperative Purchasing Program as an alternative to a formal bid process; and, WHEREAS, per Resolution Number 13-556, the City of Port Arthur is authorized to participate in cooperative purchasing with JCB Sourcewell (formerly National Joint Powers Alliance) Cooperative Purchasing Program; and, PR 25103 8/11/2026 JAM Page 2 of 3 WHEREAS, Mustang Cat of Beaumont, Texas, is part of the Sourcewell Cooperative Purchasing Program under Sourcewell Contract Number 032119-CAT,and submitted a quote for the replacement of the undercarriage and tracks in the amount of $45,034.12 as delineated in Exhibit A. NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR,TEXAS: THAT,the facts and opinions in the preamble are true and correct; and, THAT,the City Council of the City of Port Arthur hereby authorizes the City Manager to enter into a contract with Mustang Cat of Beaumont, Texas, to replace the undercarriage and tracks on the D5 Dozer in the amount of$45,034.12; and, THAT,funding for this repair is available in the Equipment Maintenance Account,number 403-50-320-5318-00-00-000; and, THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
