Background: Pursuant to Resolution 24-447, the City of Port Arthur City Council authorized a professional service agreement with NewGen Strategies and Solutions, LLC of Orlando, Florida, to develop a Solid Waste Master Plan that reviewed and improved the Solid Waste Division's needs, operations, management practices, and deficiencies. This review will result in a Solid Waste Master Plan that identifies short- and long-term needs, provides key information to stakeholders and City policymakers to inform critical program decisions, and develops a plan that guides the City in successful, long-term solid waste operations. On December 16, 2025, the City Council provided an extension to the current contract. This extension was to address delays in receiving accurate data to produce preliminary reports during the development of the master plan. Pursuant to Resolution 25-535,the contract was extended through September 30,2026. In early 2026,the City experienced staff turnover, resulting in delays in receiving feedback and completing tasks necessary to develop the Solid Waste Master Plan. The proposed resolution requests an extension to the existing contract with NewGen Strategies and Solutions, LLC of Orlando,Florida, through December 31, 2026. The extension would allow the consultant to finalize the draft report, collaborate with the Advisory Committee for comments and input on the final draft, and prepare a presentation for the City Council. This extension is necessary to complete these tasks during October and November, accommodate any final revisions, and enable the delivery and presentation of the final report expected in December. Budget Impact: There is no funding impact for the Professional Service Agreement extension. Recommendation: It is recommended that the City Council approve PR 25070, authorizing the extension of the Professional Service Agreement with NewGen Strategies and Solutions, LLC, of Orlando, Florida, through December 31, 2026, to complete the Solid Waste Master Plan. As noted in Section 4.2 of the Agreement, "In the event Professional's performance of this Agreement is delayed or interfered with by acts of City or others, Professional may request an extension of time for the performance of same ...." NewGen initially requested an extension in November 2025,to extend the agreement through September 30, 2026. The extension was granted in January 2026. Since that time, with some staff turnover at the City that led to worthwhile delays in determining next steps, NewGen is again requesting an extension. This is due to delays in receiving feedback relating to potential strategies to be further evaluated. While we believe the delay was warranted to ensure the final solid waste master plan best reflects the City, it has led to this request for extension. Given the delays in receiving feedback from the City to complete certain tasks imperative for the planning efforts, we are respectfully requesting an extension of the Professional Services Agreement through December 31, 2026.
