NO. 25127 —A resolution calling for a public hearing to consider an alleyway abandonment Introduction: The Port Arthur City Council is being asked to approve Proposed Resolution No. 25127, calling for a public hearing to consider granting an alleyway abandonment for approximately 0.0670-Acre (20' X 146') portion of dedicated alley right-of-way located between Austin Avenue & Waco Avenue, City of Port Arthur, Jefferson County, Texas. The property is adjacent to lots 4-6, Block 474, City of Port Arthur Addition. The request aims to allow for the abandoning of a dedicated alley right-of-way. Background: On or around July 30, 2026, the property owner of 515 & 523 Gulfway Drive applied for an alleyway abandonment for the construction of a single-family dwelling. In accordance with Appendix A of the City of Port Arthur Zoning Ordinance, requests involving the vacation or abandonment of a street, alley, or other public way are subject to review by the Planning and Zoning Commission and final consideration by the City Council. Section 1.07(G), Street Vacations, provides that whenever a street, alley, or other public way is vacated by official action of the City Council, the City Council shall take action to assign zoning to the vacated area. As part of the abandonment review process, the request is circulated to applicable City departments, utility providers, and other affected entities to determine whether the alleyway is needed for public access, utilities, drainage, infrastructure, or other municipal purposes and to identify any existing easements or facilities that may need to be retained or otherwise addressed prior to final action by the City Council. The requested abandonment is being processed in accordance with the City's adopted regulations and applicable provisions of Chapter 253 of the Texas Local Government Code governing municipal interests in abandoned streets and alleys. Notification of the hearing date and time will be published in the city's official newspaper and mailed to adjacent property owners within a 200-foot radius at least 15 days before the public hearing. The Planning & Zoning Commission will conduct a public hearing on September 21 , 2026, at 5:30 P.M. Budget Impact: None Recommendation: It is recommended that the City Council approve Proposed Resolution No. 25127, calling for a public hearing to consider granting of an Alleyway Abandonment for approximately 0.0670-Acre (20' X 146') portion of dedicated alley right-of-way located between Austin Avenue & Waco Avenue, City of Port Arthur, Jefferson County, Texas. A RESOLUTION CALLING FOR A PUBLIC HEARING TO CONSIDER AN ALLEYWAY ABANDONMENT FOR APPROXIMATELY 0.0670- ACRE (20' X 146') PORTION OF DEDICATED ALLEY RIGHT-OF-WAY LOCATED BETWEEN AUSTIN AVENUE AND WACO AVENUE, PORT ARTHUR, JEFFERSON COUNTY, TEXAS. THE PROPERTY IS ADJACENT TO LOTS 4-6, BLOCK 474, CITY OF PORT ARTHUR ADDITION A26-02 CLARENCE WISE WHEREAS, the City Council of the City of Port Arthur, Texas, is considering an Alleyway Abandonment for a 0.0670 -acre (20' X 146') portion of a dedicated alley right- of-way, more particularly described and depicted in Exhibit "A"; and WHEREAS, in accordance with Chapter 253 of the Texas Local Government Code, a public hearing is required prior to the adoption of any alleyway abandonment, and proper notice of such hearing must be published in the City's official newspaper at least fifteen (15) days prior to the date of the hearing; and WHEREAS, the Planning and Zoning Commission will hold a public hearing regarding the proposed alleyway abandonment on September 21 , 2026, at 5:30 p.m. in the City Council Chambers, located on the Fifth Floor of City Hall at 444 4th Street, Port Arthur, Texas, with the option for participation via telephonic or videoconference means, in accordance with applicable law; and WHEREAS, following the Planning and Zoning Commission's consideration and recommendation, the City Council will hold a public hearing on October 20, 2026, at 6:00 p.m. in the City Council Chambers, Fifth Floor, City Hall, 444 4th Street, Port Arthur, Texas, or via telephonic or videoconference, to receive public comment and consider action on the proposed granting of an alleyway abandonment affecting the 0.0670 -acre (20' X 146') portion of a dedicated alley right-of-way as described in Exhibit "A". NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: 4 THAT the facts and opinions in the preamble are true and correct. I P.R. THAT the City Council shall hold a public hearing to consider an alleyway abandonment request for a 0.0670 -acre (20' X 146') portion of a dedicated alley right- of-way, located between Austin Avenue and Waco Avenue, Port Arthur, Jefferson County, Texas, delineated in Exhibit "A" on October 22, 2026, at 6:00 p.m. in the City Council Chambers, Fifth Floor, City Hall, 444 4th Street, Port Arthur, Texas, or by telephonic and videoconference. THAT notice of the public hearing shall be published at least fifteen days prior in the City's official newspaper before going to the City Council. THAT a copy of the caption of this Resolution is spread upon the Minutes of the City Council.
