RE: P.R. NO. 25106 — A proposed resolution appointment/re-appointing
members to the Zoning Board of Adjustment
Introduction:
This agenda item seeks the City Council's approval of Proposed Resolution No.
25106, appointing and/or reappointing three (3) individuals to serve on the City of Port
Arthur Zoning Board of Adjustment, representing Council Districts 1, 2, and 3, pursuant
to Appendix A: Zoning, Section 5.04 of the City of Port Arthur Code of Ordinances.
The appointments are necessary due to the expiration of the terms associated with
these positions. The individuals appointed and/or reappointed by the City Council will
each serve a two (2) year term expiring September 23, 2028.
Background:
The Zoning Board of Adjustment was originally created by Ordinance No. 89-54. The
composition of the Board was subsequently amended by Ordinance No. 15-57, which
eliminated alternate positions and established the current manner of appointment.
In accordance with Appendix A: Zoning, Section 5.04 of the City of Port Arthur
Code of Ordinances, the Zoning Board of Adjustment consists of the same number of
members as the City Council, including its chairperson. The Board, therefore, consists
of seven (7) members. Four (4) Board members, including the chairperson, are
appointed during even-numbered years, while three (3) Board members are appointed
during odd-numbered years. Members serve staggered two (2) year terms, and each
appointment requires approval by a simple majority vote of the governing body.

The Zoning Board of Adjustment performs an important quasi-judicial function in the
administration of the City's zoning regulations. The Board considers matters authorized
under applicable state law and the City's Zoning Ordinance, including requests for
variances and appeals involving decisions made in the administration and enforcement
of the Zoning Ordinance.
Appointments are currently required for the Board positions representing Council
Districts 1, 2, and 3. The respective Councilmembers may recommend the
reappointment of the existing member or the appointment of a new individual to
represent their district. All appointments are subject to approval by a simple majority
vote of the City Council.
Proposed Resolution No. 25106 will appoint and/or reappoint the individuals selected
to represent Council Districts 1, 2, and 3. Upon appointment, each member will serve a
two (2) year term expiring September 23, 2028.
In accordance with Resolution No. 98-157, each appointee must contact the City
Secretary's Office to take the required oath of office, receive the applicable governing
documents, and complete the required orientation.
Budget Impact:
There is no fiscal impact associated with these appointments.
Recommendation:
It is recommended that the City Council approve Proposed Resolution No. 25106,
appointing and/or reappointing three (3) individuals to the City of Port Arthur Zoning
Board of Adjustment to represent Council Districts 1, 2, and 3.
Each appointed and/or reappointed member shall serve a two (2) year term expiring
September 23, 2028, in accordance with Appendix A: Zoning, Section 5.04 of the City
of Port Arthur Code of Ordinances.
