NO. 25163 AMENDING RESOLUTION 26-390. . . ,llliii///' City of _ i A I _ art rthu ma INTEROFFICE MEMORANDUM Date: September 14,2026 To: The Honorable Mayor and City Council Through: Ronald Burton, CPM, City Manager From: Suhail Kanwar,P.E.,Director of Public Services/City Engineer RE: PR No. 25163 —Amending Resolution 26-390 Introduction: The intent of this Agenda Item is to seek City Council's approval to amend Resolution No. 26-390 as it pertains to a Temporary Workspace Easement Agreement with Mustang Express Pipeline,LLC Background: Resolution No.26-390,approved by the City Council on September 8,2026,authorized a Temporary Workspace Easement Agreement with Mustang Express, LLC, over approximately 3.94 acres of land within Parcel ID No. 267029. The easement provides temporary workspace and road access needed for the location and construction of a gas utility pipeline and related appurtenant facilities. The compensation amount stated in Resolution No. 26-390 requires correction. The City initially calculated compensation at $197,370.36 based on the understanding that the requested easement would be permanent. The City later confirmed that Mustang Express,LLC is requesting a temporary workspace easement, which resulted in a corrected compensation amount of$39,417.07. Although the Memorandum accompanying Proposed Resolution No.25079(Resolution No.26-390) correctly reflected the revised compensation amount, the Proposed Resolution itself inadvertently showed the incorrect amount. The attached proposed resolution amends Resolution No. 26-390 to reflect the correct compensation amount of$39,417.07 by Mustang Express. All other provisions of Resolution No.26-390 will remain unchanged. Budget Impact: Mustang Express will provide compensation to the City in the total amount of thirty-nine thousand four hundred seventeen dollars and seven cents($39,417.07)for the temporary workspace easement and road access. Recommendation: It is recommended that the City Council approves the amendment to Resolution 26-390 to reflect the correct compensation amount. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: THAT, the facts and opinions in the preamble are true and correct; and THAT, the City Council hereby authorizes the amendment to Resolution No. 26-390 to correct the compensation amount for the Temporary Workspace Easement Agreement with Mustang Express, LLC as follows: "THAT, Mustang Express will provide compensation to the City in the total amount of {$197,370.36) Thirty-nine thousand four hundred seventeen dollars and seven cents ($39,417.07)for the temporary workspace and access road over and across the 3.94-acre portion of city-owned land out of Parcel ID 267029." No. 25097—Temporary Workspace Easement Agreement with Mustang Express Pipeline,LLC Introduction: The intent of this agenda item is to request the City Council's approval to authorize the City Manager to execute a Temporary Workspace Easement Agreement with Mustang Express Pipeline,LLC("Mustang Express")over a portion of City-owned property identified as Parcel ID 267029, located near the City's Landfill on State Highway 73,for a term of 24-months. Background: Mustang Express contacted the City of Port Arthur requesting permission to conduct site surveys and assessments on a parcel of land owned by the City for the purpose of locating and constructing a gas utility pipeline and appurtenant facilities. The proposed pipeline is expected to be installed primarily outside the city limits, with only a small portion entering the city limits to cross State Highway 73,before extending to the Port Arthur LNG facility in Sabine Pass. Because the route is largely outside the city limits and away from residential areas, the project is expected to have minimal impact on the surrounding community. On October 22,2025,Mustang Express was granted permission to conduct civil, environmental, cultural, and geotechnical surveys on the City-owned property identified as Parcel ID 267029, located near the City's Landfill on State Highway 73. Based on the survey and assessment conducted,Mustang Express is now requesting that the City grant a temporary workspace easement over and across a portion of Parcel ID 267029 totaling 3.94 acres. The easement would provide temporary workspace and access road for locating and constructing the proposed gas utility pipeline, together with appurtenant facilities. The temporary workspace easement will be for a period of 24-months from the date the Mustang Express enters the property as provided in the agreement. Budget Impact: Mustang Express will provide compensation to the City in the total amount of thirty-nine thousand four hundred seventeen dollars and seven cents($39,417.07)for the temporary workspace easement and road access. Recommendation: It is recommended that the City Council approve Proposed Resolution No. 25097, authorizing the City Manager to execute a Temporary Workspace Easement Agreement with Mustang Express Pipeline,LLC over and across a 3.94-acre portion of City-owned land out of Parcel ID 267029, located near the City's Landfill on State Highway 73, for a 24-month term, for the purpose of providing temporary workspace and road access for locating and constructing a gas utility pipeline, together with appurtenant facilities. The area to be surveyed will be approximately 300 feet wide generally centered 150 +1-feet either side of the proposed project centerline, or along other areas of interest to the project including proposed access roads, potential compressor station(s),and potential laydown yards. The purpose of this survey is to determine the size and location of wetlands and to evaluate the land for potential habitat of endangered species, including plants and animals. This survey includes using a handheld soil auger to auger holes from 6 to 24-inches in depth. The soil will be placed back in the hole and tamped This crew will also locate springs and/or water wells, erosion prone areas and man-made features that can affect pipeline construction(ponds, improvements, irrigation systems,etc.). Additional surveys may be required in conjunction with an adjustment to the proposed project centerline. ARCHAEOLOGICAL SURVEY A survey crew of approximately 2 to 9 people will survey the right of way.The width of the area to be surveyed will be approximately 300 feet wide generally centered 150+/-feet either side of the proposed project centerline, or along other areas of interest to the project including proposed access roads, potential compressor station(s), and potential laydown yards. This survey includes the taking of shovel tests approximately 18-inches in depth at intervals of approximately 30 to 50 meters. The soil will be sifted through a screen looking for historical remains, potshards, arrowheads, and any other artifacts with historical significance. The soil will be placed back in the holes and tamped.Additional surveys may be required in conjunction with an adjustment to the proposed project centerline. CIVIL SURVEY A survey crew of approximately 3-5 people will locate the proposed centerline of the pipeline and place stakes and flagging to depict the path of the centerline as well as the proposed project workspaces. It may be necessary at times to clear and cut brush, limbs, and small trees(not to exceed 6-inches in diameter at ground level).Later (usually within a matter of weeks),another survey crew returns to record various survey data.Other survey crews may return to mare adjustments to the centerline as may be necessary as a result of adjustments to the centerline and workspaces at other locations and to avoid sensitive areas identified by other surveys.
