Introduction:
The intent of this agenda item is to authorize the City Manager to accept the close-out documents and release
retainage in the amount of$47,847.20 for the 9th Avenue Pavement Improvement Project most westward lane from
Jimmy Johnson Boulevard to Lake Arthur Drive, Capital Account Nos. 148-00-000-2050-00-00-000 ($45,302.76) and
307-00-000-2050-00-00-000 ($2,544.45). Project No. GM2502.CON. Brystar Contracting, Inc., (Brystar) of Beaumont,
Texas.
Background:
The Engineering Department, along with the City Council Members, assembled a list of streets for repair and/or
reconstruction as part of an overall street improvement plan. 9th Avenue from Jimmy Johnson Boulevard to Lake Arthur
Drive, was listed and subsequently selected for reconstruction. Planning and design of the 9th Avenue Pavement
Improvement Project most westward lane(9th Avenue Project)from Jimmy Johnson Boulevard to Lake Arthur Drive was
done in-house under the direct supervision of Golden Triangle Consulting Engineers of Beaumont, Texas, which also
sealed the drawings.
Pursuant to Resolution No. 25-410, City Council awarded the construction contract to Brystar for a contract amount of
$1,065,472.00 for the 9th Avenue Pavement Improvement Project most westward lane from Jimmy Johnson Boulevard to
Lake Arthur Drive.
Amendment No. I
Pursuant to Resolution No. 26-128, Amendment No. 1 was approved for a 150-calendar day time extension due to the
delay of awaiting a recommendation to add a subgrade improvement task to the project scope to continue construction.

Change Order No. 1
Pursuant to Resolution No. 26-169, City Council approved Change Order No. 1 that removed and replaced 200
feet of roadway, for the appropriated amount of$50,890.00.
Change Order No. 2
Change Order No. 2 is being submitted for various line-item deductions, which decreases the original contract
amount of$1,195,243.25 by$238,299.31, to the new contract amount of$956,943.94.
*Amendment No. 1 added 150-calendar day time extension.
*Change Order No. 1 increased the contract amount by$50,890.00.
*Change Order No. 2 decreased the contract amount by$238,299.31.
Close-Out and Release of Retainage
Public Works-Engineering has received Close Out Documents from Brystar, of Beaumont, Texas, that includes
the Certificate of Substantial Completion establishing completion as of August 17, 2026, the Contractor's
Certificate and Release,the Contractor's Certificate of Warranty,the Contractor's Certificate of Guarantee, and
the Contractor's Affidavit of All Debts Paid. Additionally, Brystar,of Beaumont,Texas, is asking for release of
retainage in the amount of$47,847.21.
Budget Impact:
Capital Account No Nos. 148-00-000-2050-00-00-000 ($45,302.76) and 307-00-000-2050-00-00-000 ($2,544.45).

Recommendation:
It is recommended that the City of Port Arthur's City Council approve PR No. 25143 authorizing the City Manager to
execute Change Order No. 2, accept the Close-out documents, and release the retainage in the amount of
$47,847.21, to Brystar Contracting, Inc., of Beaumont, Texas, for the 9th Avenue Pavement Improvement Project most

AVENUE PAVEMENT IMPROVEMENT PROJECT (MOST
WESTWARD LANE) FROM JIMMY JOHNSON BOULEVARD
TO LAKE ARTHUR DRIVE, DECREASING THE ORIGINAL
CONTRACT PRICE OF $1,195,243.25 TO THE NEW CONTRACT
PRICE OF $956,943.94, ACCEPT THE CLOSE-OUT
DOCUMENTATION, AND AUTHORIZING THE CITY
MANAGER TO RELEASE THE RETAINAGE IN THE AMOUNT

WHEREAS, the City of Port Arthur has developed a comprehensive street rehabilitation
program through the Public Works Engineering Division to address streets that require repair and
reconstruction in order to maintain the safety and functionality of the City's transportation
infrastructure; and,
WHEREAS, City Council Members, in coordination with the Engineering Division, identified
and prioritized various streets within their respective districts for rehabilitation and reconstruction as
part of the City's ongoing Capital Streets improvement program; and,
WHEREAS, 9th Avenue from Jimmy Johnson Boulevard to Lake Arthur Drive was identified
as a roadway requiring reconstruction and was subsequently included in the City's street improvement
program; and,
WHEREAS, the planning and design for the 9th Avenue Pavement Improvement Project,
specifically the most westward lane from Jimmy Johnson Boulevard to Lake Arthur Drive, was
performed by the City's Engineering staff under the supervision of Golden Triangle Consulting
Engineers of Beaumont, Texas, which firm also sealed the project drawings; and,
WHEREAS, the City's Purchasing Department advertised for competitive sealed bids for the
project in accordance with state law and City purchasing policies on April 30, 2025, and May 7, 2025,
under Bid No. P25-052; and,
WHEREAS, on August 1, 2025, the Purchasing Department received and publicly opened two
(2) sealed bids for the project from Brystar Contracting, Inc., of Beaumont, Texas, and Texas Materials,
a CRH Company of Beaumont, Texas; and,
WHEREAS, pursuant to Resolution No. 25-410, the City Council awarded a construction
contract to Brystar Contracting, Inc. in the amount of $1,065,472.00 for the 9th Avenue Pavement
Improvement Project; and,

WHEREAS, during the course of construction, project progress was delayed while the
contractor awaited direction regarding the potential addition of a subgrade improvement component to
the project scope necessary to proceed with continued construction activities; and,
WHEREAS, pursuant to Resolution No. 26-128, Amendment No. 1 was approved for a 150-
calendar-day extension to accommodate the delay associated with evaluating and determining the
appropriate subgrade improvement measures. The original contract end date April 1, 2026 was extended
to a new contract end date of August 29, 2026; and,
WHEREAS,pursuant to Resolution No. 26-129, approved by City Council, Change Order No. 1
was submitted by Brystar to remove and replace 200 feet of roadway, for the appropriated amount of
$50,890.00; and,
WHEREAS, Change Order No. 2 is being submitted for various line-item deductions, which
decreases the original contract amount of$1,195,243.25 by $238,299.31, to the new contract amount of
$956,943.94 (Exhibit A); and,
WHEREAS, Brystar Contracting, LLC of Beaumont, Texas, has submitted the Certificate of
Substantial Completion dated August 17, 2026 and the work to which the Certificate applies has been
inspected, authorized, and declared to be complete in accordance with the contract documents and made
a part hereof as (Exhibit B); together with the Contractor's Certificate and Release (Exhibit C), the
Contractor's Certificate of Warranty (Exhibit D), the Contractor's Certificate of Guarantee (Exhibit E);
the Contractor's Affidavit of Debts Paid (Exhibit F), and the Engineer's Certificate of Completion
(Exhibit G); and,
WHEREAS,the retainage for the project is 5% of the work completed and billed, the Release of
Retainage has been submitted by Brystar Contracting, LLC of Beaumont, Texas, for the amount of
$47,847.21, see(Exhibit H); and,
WHEREAS, Brystar Contracting, LLC of Beaumont, Texas, has completed the contracted
project to the satisfaction of the City Engineer and the City Engineering staff, see (Exhibit I); and,
WHEREAS, approval of PR 25143 and acceptance of the Close Out Documents and Release of
Retainage is herein deemed an appropriate action.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PORT ARTHUR,TEXAS:
THAT,the facts and opinions in the preamble are true and correct; and,
THAT, the City Council hereby approves Change Order No. 2 to the construction contract with
Brystar Contracting, Inc., of Beaumont, Texas, for the 9th Avenue Pavement Improvement Project(most

westward lane) from Jimmy Johnson Boulevard to Lake Arthur Drive, for various line-item deductions,
which decreases the original contract amount of $1,195,243.25 by $238,299.31, to the new contract
amount of$956,943.94, Project No. GM2502.CON; and,
THAT, the City Council hereby authorizes the City Manager to hereby accept the Certificate of
Substantial Completion dated August 17, 2026 and the work to which the Certificate applies has been
inspected, authorized, and declared to be complete in accordance with the contract documents and made
a part hereof as (Exhibit B); together with the Contractor's Certificate and Release (Exhibit C), the
Contractor's Certificate of Warranty (Exhibit D), the Contractor's Certificate of Guarantee (Exhibit E),
the Contractor's Affidavit of Debts Paid (Exhibit F), and the Engineer's Certificate of Completion
(Exhibit G); and,
THAT, the City Manager of the City of Port Arthur is hereby authorized to execute on behalf of
the City of Port Arthur a Certificate of Acceptance, including project photos (Exhibit I), for the
completion of the 9th Avenue Pavement Improvements Project (most westward lane) from Jimmy
Johnson Boulevard to Lake Arthur Drive; and,
THAT, the release of retainage be paid to Brystar Contracting, LLC, of Beaumont, Texas, for
the retainage account numbers 148-00-000-2050-00-00-000 ($45,302.76) and 307-00-000-2050-00-00-
000 ($2,544.16) in the amount of$47,847.21, Project No. GM2502.CON (Exhibit H).
THAT, a copy of the Resolution shall be spread upon the Minutes of the City Council.
