Approval of Contract Amendment between the City of Port Arthur and
Dr. William D. George to act as the supervising physician of the Employee
Health Services Clinic
RECOMMENDATION:
It is recommended that the City Council approve Proposed Resolution No. 15682, approving an
amendment to the Independent Professional Services Agreement for Dr. William D. George to
act as the supervising physician of the City's Employee Health Services Clinic.
BACKGROUND:
Since 1995, Dr. George has been the Health Authority for the City of Port Arthur. His contract
was renewed in September 2009; however, he has agreed to act as the supervising physician of
the newly created Employee Health Services Clinic. He will sign all protocols and standing
delegation orders, consult with the mid-level provider, review charts, and perform other duties as
required for the effective management and operation of the clinic.
STAFFING/EMPLOYEE EFFECT:
Approval of this contract amendment will allow the health department to proceed with setting up
and hiring of personnel to staff the Employee Health Services Clinic.
BUDGETARY EFFECT:
Dr. George's current contract is $39,600 annually which includes $34,100 paid by the health
department and $5,500 by the Fire Department. The additional $1,000 per month will be paid
from the Employee Health Services Clinic budget, account number 001-1303-541.54-00.
SUMMARY:
It is recommended that the City Council approve Proposed Resolution No. 15682, approving an
amendment to the Independent Professional Services Agreement for Dr. William D. George to
act as the supervising physician of the City's Employee Health Services Clinic.

RESOLUTION NO.
A RESOLUTION AMENDING THE INDEPENDENT PROFESSIONAL
SERVICES AGREEMENT BETWEEN THE CITY OF PORT ARTHUR
AND WILLIAM D GEORGE, MD TO ACT AS THE SUPERVISING
PHYSICIAN OF THE CITY OF PORT ARTHUR'S EMPLOYEE
HEALTH SERVICES CLINIC
WHEREAS, Dr. William D. George has been acting as the Health Authority for the City
of Port Arthur since August 1, 1995; and,
WHEREAS, Dr. George has agreed to amend the existing contract with the City of Port
Arthur in order that he may act as the supervising physician of the City's Employee Health
Services Clinic; and,
WHEREAS, the city will compensate Dr. George at $1,000 per month in addition to the
$3,300 that he now receives; now therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF PORT ARTHUR:
SECTION I. That, the facts and preamble aze true and correct.
SECTION 2. That, the City Council of the City of Port Arthur hereby authorizes the
City Manager and Director of Health to execute said Agreement, a copy of which is attached
hereto as Exhibit "A."
SECTION 3. That, a copy of the caption of this Resolution be spread upon the Minutes
of the City Council

EXHIBIT "A"
AGREEMENT FOR INDEPENDENT PROFESSIONAL SERVICES
This Agreement is made between the City of Port Arthur, Texas hereinafter referred to as
"City" and William D. George, M.D., a person licensed to perform the duties of Health
Authority, herein referred to as "Contractor."
I. TERM OF AGREEMENT
This amended Agreement shall be for a period beginning January 5, 2010 and shall
remain in force through September 30, 2012. Thereafter, this Agreement shall be renewed.

II. PROFESSIONAL SERVICES
As the Health Authority, the Contractor shall:
1) Administer state and.local laws relating to public health within the City's jurisdiction
in accordance with Section 121.021 Texas Health and Safety Code, as amended.
2) Do all things necessary to implement and enforce the law to protect the public health.
3) Perform each duty applicable to the City's jurisdiction as prescribed by the Texas
Department of State Health Services (DSHS).
4) Establish, maintain, and enforce quazantine in the City's jurisdiction.
5) Aid the Texas-Board of Health and other public health officials in relation to local
quazantine, inspection, disease prevention and suppression, birth and death statistics, and- general
sanitation in the City's jurisdiction.
6) Report as necessazy the presence of contagious, infectious and dangerous epidemic
diseases to the Texas Board of Health in the manner and at the times prescribed by said boazd.
7) Perform all acts for the Port Arthur City Health Department which aze required by law
to be performed by a licensed physician or which if provided by a person other than a licensed
physician would constitute the unlicensed or unlawful practice of medicine.
8) Provide consultant services in policy, planning, procedure, administrative and other
matters to the Director of the Health Department as requested by said Director.
9) Provide Medical Director advisory services to the City's Fire Department First
Responders Program registered with the Department of State Health Services.
10) Meet with the City's Fire Department representatives on a monthly basis to review
emergency medical incidents, exposures and debriefings, establish and review medical protocols,
review and make recommendations concerning DSHS certifications and continuing education.
11) Provide professional assistance to the City's Fire Department in administrative
matters before boards, DSHS, and the City Council on an as needed basis.
EMPLOYEE HEALTH SERVICES CLINIC
12) Function as the supervising physician of the City's Employee Health Services Clinic.
13) Review patient charts as needed and required.
14) Review and approve all protocols and standing delegation orders/guidelines for the
effective operation of the Employee Health Services Clinic to include prescriptive authority for
the mid-level provider.
15) Provide consultation as needed to the Employee Health Services Clinic mid-level
provider and staff.
III. COMPENSATION
The Contractor shall be paid One Thousand.Dollazs ($1,000) per month for services
provided for the Employee Health Services Clinic in addition to the. Three Thousand, three
hundred Dollars ($3,300.00) per month for professional services performed as the Health
Authority. The hours of work shall be mutually agreed upon by the Director of Health of the
City of Port Arthur and the City's Fire Chief.
IV. LICENSURE/LIABILITY INSURANCE
1) The Contractor shall provide proof of licensure to practice medicine in the State of
Texas. '
2) The Contractor shall be covered under the City's liability insurance for services
performed as the Health Authority.
IV. TERMINATION
This Agreement can be terminated with sixty (60) days prior written notice by either
