RECOMMENDATION
I recommend that the City Council authorize the extension of the contract for AMR meter installation
between the City of Port Arthur and U: S. Bronco Service, Inc.
BACKGROUND
On August 26, 2008 City Council authorized the City Manager to execute an agreement with U. S. Bronco
Services, Ina (contractor) For meter installation. The contract required the project to be completed within
365 days of receiving the "Notice to Proceed". The contractor started working in late January, 2009.
It appears that 365 days was too aggressive and did not allow for delays. There was a one month delay
when we ran out of meters to install, we've had rain delays, and the project in the inner city is going slower
than expected due to alleyway difficulties.
The small meter installation is close to 60% completed. We anticipate completion in another 9 months.
BUDGET/FISCAL EFFECT
Funds for the meter installation are budgeted in account no. 301-1601-591.59-00, Project No. GO-802.
This extension does not increase the amount, $891,582, of the original contract.
STAFF/EMPLOYEE EFFECT
The contractor is responsible for.providing all labor. City staff is overseeing the project.
SUMMARY
I recommend that the City Council approve PR 15688 authorizing an extension of the contract AMR meter
installation to September 30, 2010:

WH>=?REAS, the City Council approved Resolution 08-357 for a contract with U. S. Bronco
Service, Inc. for AMR Meter installation/replacement, acopy of the contract is attached hereto as Exhibit
«A„
WHEREAS, the City wishes to extend the terra of the contract with U. S. Bronco until September
30, 201 C-.
WH>=;REAS, this resolution will amend Section 8 of the contract to allow the extension.
NOV'V THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PORT ARTHUR:
Section 1: The facts and opinions in the preamble are true and correct.
Section 2: That Section 8 of the contract is amended as follows:
The contractor must complete the entire project no later than September 30, 2010.
Section 3:. The City Manager is authorized to extend the contract with U. S. Bronco Services,
Inc. until September 30, 2010.
Section 4: That U. S. Bronco will sign the resolution agreeing to the terms thereof.

EXHIBIT "A"
CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND
U.S. BRONCO SERVICES, INC., FOR THE INSTALLATION
AND REPLACEMENT OF AMR METERS
THIS AGREEMENT, made this y of 2008,
by and between the City of Port Arthur, a municipal corpora on organized under the laws
of the State of Texas, hereinafter called "OWNER" or "CITY" and U.S. Bronco
Services, Inc. a corporation.
WITNESSETH: that for and in consideration of the payment terms, conditions
and agreements set forth herein ,OWNER and CONTRACTOR agree as follows:
1. The purpose of this contract is for the replacement and installation of AMR
Meters in the City of Port Arthur's water distribution system.
2. The Contractor will be responsible for providing all management, installation,
labor coordination, customer scheduling; tools and equipment necessary to
complete the work as stated in the Contract Documents.
3. The City can terminate this contract at its convenience which includes, but is not
limited to, funding not being available in any budget cycle with thirty (30) days
written notice. Any temts and conditions stated in original specifications will
apply to any extended periods.
4. City shall provide materials such as AMR meters & systems, curb stops, and
meter boxes.
5. All water meters shall be installed according to the recommendations set forth in
Chapter Four (4) "Meter Installation" of the AWVJA M6 Manual Water Meters -
Selection, Installation, Testing, & Maintenance, Fourth Edition and to
manufacturer's guidelines.
6. The Contractor shall be responsible for famishing his owri expense all of
supplies, tools, equipment, excepting those supplies specifically not required of
the Contractor,in the specifications, attached hereto.
7. The CONTRACTOR agrees to gerform all the work described in the
specifications and contract documents and to comply with the terms therein for a
total price of $891,582.00.
8. The Contractor must complete the entire project within 365 days of
receiving the "Notice to Proceed".
9. .The term''Contract Documents" means and includes the following documents:
A. Agreement
B. Advertisement for Bids
C. Addenda
D. General Information.
E. Specifications
F. Bid
10. This Agreement shall be binding upon all parties hereto and their respective
heirs, executors, administrators, successors and assigns.
11. IN WITNESS WHEREOF, the parties hereto have executed, or caused to be
executed by their duly authorized officials, this Agreement in (2 copies) each of
which shall be deemed an original on the date first above written.
