A RESOLUTION AS IT PERTAINS TO REMEDIATION EFFORTS AS A RESULT OF HURRICANE HUMBERTO WHEREAS, on September 13, 2007, the City was impacted by Hurricane Humberto; and WHEREAS, on September 13, 2007, as authorized by Section 418.108 of the Government Code, and as per Section 15, Article II of the City Charter, denoted in Exhibit "A"; and WHEREAS, on September 13, as a result of Hurricane Humberto, a Galveston, Jefferson, and Orange counties "B"; and the Mayor issued a Declaration of Disaster as 2007, Governor Perry declared that disaster occurred in as denoted in Exhibit WHEREAS, for the retention of generators as per approved by Resolution No. 07-071; and WHEREAS, the City utilized Derrick Oil the City utilized Garner Environmental Services, Inc. the Emergency Contract, for fuel as per the Emergency Contract, approved by Resolution No. 06-293; and WHEREAS, the City utilized DTS Recovery for debris removal as per the contract approved by Resolution No. yard; and WHEREAS, 199 at $8.50 per cubic the City has Emergency Contracts as follows: z.pr14385 COMPANY DATE OF EXECUTED CONTRACT September 1, 2006 Market Basket - Resolution No. 06-250 P.A.I.S.D. - Resolution No. 06-231; 06-385 September 28, 2006 July 6, 2006 Holiday Inn - Resolution No. 06-251 September 7, 2006 J.B.S. STEPHEN FITZGIBBONS, CITY MANAGER The Honorable Rick Perry Governor of Texas c/o State Coordinator Division of Emergency Management P O Box 4087 Austin, TX 78773-0001 Dear Governor Perry: Due to the extreme amount of rainfall and wind damage in the City of Port Arthur during Hurricane Humberto on September 13, 2007, the City of Port Arthur is facing tremendous physical and economic losses. An undetermined number of homes and/or businesses have been damaged and will require individual assistance. Likewise, public utilities have been impacted to the extent that numerous homes/businesses have been left without electricity. It is my belief the damage to homes, businesses, utility systems due to the wind and rain constitutes a public health and safety hazard. I have determined that this incident is of such severity and magnitude that an effective response is beyond the City of Port Arthur's capability to recover without supplementary State and/or Federal assistance. Additionally, I certify that the City of Port Arthur does not have local funding available to make the needed repairs and to provide these citizens with effective relief. Your assistance in this emergency matter, as it affects the safety and health needs of our citizens, would be appreciated. BOX 1089 PORT ARTHUR, TEXAS 77641-1089 AREA CODE 409-983-8600 * FAX # 983-8662 DECLARATION OF DISASTER WHEREAS, the City of Port Arthur on 9/13/07 has suffered widespread or severe damage, injury, or loss of life or property ( I1 ' ' __t I1 I - ) resulting from Hurricane Humberto WHEREAS, the Mayor of the City of Port Arthur has determined that extraordinary measures must be taken to alleviate the suffering of people and to protect or rehabilitate property, NOW, THEREFORE, BE IT PROCLAIMED BY THE MAYOR OF THE CITY OF PORT ARTHUR: 1. That a local state of disaster is hereby declared for the City of Port Arthur pursuant to §418.018 (a) of the Texas Goverarnent Code. 2. Pursuant to §418.018(b) of the Government Code, the state of disaster shall continue for a period of not more than seven days from the date of this declaration unless continued or renewed by the City Council of the City of Port Arthur. 3. Pursuant to §418.018(c) of the Government Code, this declaration of a local state of disaster shall be given prompt and general publicity and shall be filed promptly with the City Secretary. 4. Pursuant to §418.018(d) of the Goverarnent Code, this declaration of a local state or disaster activates the City emergency management plan.
