The City Council of the City of Port Arthur met in Special Session on Tuesday, September 4, 2007 at 5:31 p.m. in the City Council Chamber, City Hall, with the following members present: Mayor Deloris "Bobble" Prince; Mayor Pro Tern Michael "Shane" Sinegal; Councilmembers Jack Chatman, Jr., Cai Jones, Thomas J. Henderson, Martin Flood and Robert E. "Bob" Williamson; City Manager Steve Fitzgibbons; City Secretary Evangeline "Van" Green and City Attorney Mark T. Sokolow. Councilmember John Beard, .lr. was absent from the Special Meeting. TT. RESOLUT1'ONS P.R. No. 14343 - A Resolution Setting Public Hearings To Review The Service Plans For The Annexation Of Properties And To Receive Comments From The Public On The Proposed Annexation The Mayor introduced the above-mentioned Proposed Resolution. The motion was made by Councilmember Henderson and seconded by Councilmember Chatman that Proposed Resolution No. 14343 be adopted. City Attorney Mark Sokolow read the following revisions into the record: Section 4. That the public hearings on the service plans and to receive comments from the public on the proposed annexation will be scheduled on November 6, 2007 at 9:00 a.m. and on November 20, 2007 at 7:00 p.m. The projected date for the adoption of the annexation ordinance is December 11, 2007, at 5:30 p.m. The effective date of the annexation, if approved, will be December 31, 2007 at 11:59 p.m. Section 7. That the City Secretary shall post and advertise the required notices for the public hearings at least once on or after the 20th day, but before the tenth day before the hearings, as required by Section 43.0561 of the Local Government Code. The motion was made by Councilmember Henderson and seconded by Councilmember Chatman that Proposed Resolution No. 14343 be amended as stated by the City Attorney. The motion to amend Proposed Resolution No. 14343 was approved by a unanimous vote. Proposed Resolution No. 14343 was adopted as amended, becoming Resolution No. 07-395. Voting Yes: Mayor Prince; Mayor Pro Tem Sinegal; Councilmembers Chatman, Jones, Henderson, Flood and Williamson. Voting No: None. The caption of Resolution No. 07-395 reads as follows: RESOLUTION NO. 07-395 A RESOLUTION SEI'rING PUBLIC HEARINGS TO REVIEW THE SERVICE PLANS FOR THE ANNEXATTON OF PROPERTIES AND TO RECETVE COMMENTS FROM THE PUBLIC ON THE PROPOSED ANNEXATION III. ORDINANCES (1) P.O. No. 5780 - An Ordinance Providing For The Conduct Of A Special Election On November 6, 2007 To Submit Propositions As To Whether Or Not The Existing Section 4A Sales Tax Shall Be Utilized For Various Categories Of Projects As Described In Section 4B Of Article 5190.6, Vernon's Texas Code Annotated, Providing For Publication Of The Election Notice And Calling For An Additional Public Hearing The City Manager introduced the above-mentioned Proposed Ordinance, The motion was made by Councilmember Henderson and seconded by Councilmember Flood that Proposed Ordinance No. 5780 be adopted. Discussion was held concerning the proposal to conduct a special election to use EDC Section 4A sales tax funds for demolition and athletic projects, or to continue the EDC funding allocations as approved by the voters in the May 13, 2006 Special Election. The above-mentioned item was deferred for further discussion at the end of the meeting. (2) P.O. No. 5785 - An Ordinance Of The City Council Of The City Of Port Arthur Calling A Bond Election To Be Held Within Said City; Making Provisions For The Conduct And The Giving Of Notice Of The Election To Be Held On November 6, 2007; And Containing Other Provisions Relating Thereto The City Manager introduced the above-mentioned Proposed Ordinance. The motion was made by Councilmember Henderson and seconded by Councilmember Jones that Proposed Ordinance No. 5785 be adopted. The City Manager explained the intent of the proposed bond election and distributed comparative bond information from other cities. Mr. Fitzgibbons addressed variables of obtaining certificates of obligation and ordering a bond election. The City Manager addressed the Texas Commission on Environmental Quality's court order mandating utility infrastructure improvements. Finance Director Rebecca Underhill appeared before the City Council to note that the proposed bond propositions are classified separately by category. EDC Executive Director Floyd Batiste appeared before the City Council to comment that the completion of infrastructure and road improvements at the Business Park is estimated at $4.8 Million. Proposed Ordinance No. 5785 was adopted becoming Ordinance No. 07-60. Voting Yes: Mayor Prince; Mayor Pro Tem Sinegal; Councilmembers Chatman, Jones, Henderson, Flood and Williamson. Voting No: None. No. 5786 - An Ordinance Pertaining To The Conduct Of The November 6, 2007 Special Election And Approving A 3oint Election Agreement With .lefferson County The City Manager introduced the above-mentioned Proposed Ordinance. The motion was made by Councilmember Henderson and seconded by Councilmember Flood that Proposed Ordinance No. 5786 be adopted. City Secretary Evangeline "Van" Green addressed inquires related to the Joint Election Agreement with Jefferson County Clerk Carolyn Guidry. Proposed Ordinance No. 5786 was adopted becoming Ordinance No. 07-61. Voting Yes: Mayor Prince; Mayor Pro Tem Sinegal; Councilmembers Chatman, Jones, Henderson, Flood and Williamson. Voting No: None. The original motion was made by Councilmember Henderson and seconded by Councilmember Flood that Proposed Ordinance No. 5780 be adopted. Further discussion ensued concerning the proposed ordinance calling for a special election and the time period for calling a special election. The motion was made by Councilmember Henderson and seconded by Councilmember Jones that Proposed Ordinance No. 5780 be removed from the agenda. Voting No: Councilmember Williamson. Proposed Ordinance No. 5780 was removed over the dissenting vote of Councilmember Williamson. ZV. REPORTS AND RECOMMENDATTONS Report As To Westside Revitalization Committee Meeting To Be Held On September 6, 2007 at 6:00 p.m. At Memorial 9th Grade Center. City Manager Fitzgibbons announced the upcoming meeting and highlighted the objectives and initiations to be discussed at the above-mentioned meeting. V. AD3OURNMENT OF MEETING Upon the motion of Councilmember Flood, seconded by Councilmember Chatman and carried unanimously, the City Council adjourned their meeting at 6:31 p.m. An audio-tape of this meeting is on file in the office of the City Secretary and is made a part of the official minutes of this meeting.
