ordinance for the 9s' Avenue sanitary sewer project. This ordinance restores the city's participation to $100,000
as originally budgeted.

AN ORDINANCE AMENDING ORDINANCE NO. 10-O1 AS IT
PERTAINS TO THE COST OF VARIOUS SEWER LINE
IMPROVEMENTS ON 9~ AVENUE PURSIIANT TO CHAPTER 402 OF
THE LOCAL GOVERNMENT CODE IN THE CITY OF PORT ARTHUR.
WHEREAS, per Ordinance No. 08-93 on August 26, 2008, the City
assessed the .following property owners along 9"' Avenue for the proposed
sewer improvements as follows:
• Port Arthur Independent School District $ 112,221.00
• United Board of Missions $ 5,302.00
• Frank J. Pritchard $ 3,098.00
• Texas HCP Holdings, LP $ 33,854.00
• Diocese of Beaumont $ 100,756.00
• Sa Van & Kim Ly $ 46,387.00
• C. Doornbos, Jr. $_ 95,027..00
TOTAL $ 396,645.00
CITY SHARE. 100,000.00
PROJECT TOTAL $ 496,645.00; and
WHEREAS, the planned sanitary sewer improvements have been completed
at a cost significantly less than the estimate used in the assessment; and
WHEREAS, on January 5, 2010, the City Council adopted. Ordinance 10-01
amending the assessment to reflect the actual cost of the improvements as
follows;
• Port Arthur Independent School District $ 86.498.09
• United Board of Missions $ 4,086.69
• Frank J. Pritchard $ 2,387.89
• Texas HCP Holdings, LP $ . 26,094.10
• Diocese of Beaumont $ 77,661.06
• Sa Van & Kim Ly $ 35,754.33
• C. Doornbos, Jr. $ _ 73,245.24
TOTAL $ 3.05,727.41
CITY SHARE 77,078.35
PROJECT TOTAL $ 382,805.76; and

WHEREAS, the City had total participation of $100,000 which should
not have been reduced by Ordinance 10-O1; and
WHEREAS, the proposed assessment shall be amended again as to reflect
the actual cost for the improvements, and restore the City share to the
original amount of $1.00,000.
NOW THEREFORE, BE IT ORDAINED BY THE CITY CODNCIL OF THE CITY OF PORT

Section 1. That the facts and opinions in the preamble are
true and correct.
Section 2. That the proposed assessment, as amended in
Ordinance No. 10-D1, is hereby amended as fol-lows:
• Port Arthur Independent School District $ 80,012.97
• United Board of Missions $ 3,780.30
• Frank J. Pritchard $ 2,208.86
• Texas HCP Holdings, LP $ 24,137.72
• Diocese of Beaumont $ 71,838.49
• Sa Van & Kim Ly $ 33,073.68
• C. Doornbos, Jr. $ 67,753.74
TOTAL $ 282,805.76
CITY SHARE. 100,000.00
PROJECT TOTAL $ 382,805.76
Section 3. That the Acting City Attorney is authorized to file
this amended Ordinance assessing the property in the Real Estate
Records of Jefferson County.
Section 4. That a copy of the caption of this Ordinance be
spread upon the Minutes of the City Council.
