Fitzgibbons, City Manager FROM: Lisa Cotten, Safety & Risk Management Coordinator DATE: February 18, 2010 SUBJECT: A Resolution Approving a. Property Loss Settlement in the Amount of $15,983.34 for Damages to City of Port Arthur Parks Vehicle #1597 COMMENTS RECOMMENDATION: I recommend approval of Proposed Resolution No. 15760 authorizing the property damage settlement against Texas Municipal League Intergovemmental Risk Pool (TML) for damage sustained to Parks Vehicle #1597 (2006 Ford F-250 Pickup Truck). Settlement in the amount of $15,983.34- has been offered, which represents the total properly loss of $19,333.34, less the City's Automobile Physical Damage deductible of $2,500:00, and less salvage value of $850.00 (Exhibit.°A"). BACKGROUND: On January 8, 2010, City Parks Vehicle #1597 (2006 Ford F-250 Pickup Truck) was involved. in a collision with another vehicle. Police investigation determined that the City truck was at fault. A claim was filed with TML, which deemed the City truck to be a .total loss. The City has elected to retain the truck and repair it. Payment has been offered by TML in the amount of $19,333.34, less the $2,500.00 Automobile Physical Damage deductible, and less salvage value of $850.00, for a final settlement of $15,983.34. This amount is sufficient to cover all property damages for Vehicle #1597. BUDGETARY/FISCAL EFFECT: The funds received will be deposited in the appropriate account designated by the Finance Director. A RESOLUTION AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EXECUTE THE SETTLEMENT OF A CLAIM IN THE AMOUNT OF $15,983.34 MADE AGAINST TEXAS MUNICIPAL. LEAGUE INTERGOVERNMENTAL RISK POOL (TML) AS A RESULT OF THE PROPERTY DAMAGE TO CITY PARKS VEHICLE #1597 WHEREAS, on January 8, 2010, City of Port Arthur Parks Vehicle#1597 (2006 Ford F-250 Pickup Truck) was damaged when it was struck by another vehicle; and, WHEREAS, as a result of the damage, a claim was filed with Texas Municipal League Intergovernmental Risk Pool (TML); and, WHEREAS, TML has offered to settle the claim for $19,333.34, less the Automobile Physical Damage deductible amount of $2,500.00, and less the salvage value of $850.00, making the settlement $15,983.34, which is considered a fair and. reasonable settlement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1. That, the facts and opinions in the preamble are true and correct Section 2. That, the City Manager is hereby authorized ro do all things necessary to execute settlement in'the amount of $15,983.34 for the claim against TML in substantially the same form as delineated in Exhibit "A". Section 3. That, a copy of this Resolution be spread upon the minutes of the City Council.
