Richard, Fire Chief G Re: Proposed Resolution 15782 Date: March 23, 2010 COMMENT RECOMMENDATION The Fire Department recommends that the City Council authorize the City Manager and Fire Chief to execute an Inter-Governmental Agreement with Jefferson County. BACKGROUND The Fire Chief has been notified that the City has been awarded a 2007 Supplemental Port Security Grant Program (SPSGP) Grant. The Fire Department will purchase three SUV type vehicles for the Fire Marshal, Assistant Fire Marshal and Bomb Dog Handler along with related equipment. 'The total cost of this project is $140,587.58 with the federal share being 75% or $105,440.69 and the local share being 25% or $35,146.90. Jefferson County acts as the Fiduciary Agent for the 2007 SPSGP BUDGET/FISCAL EFFECT The local match for this project is estimated to bye $35,146.90. A RESOLIITION AUTHORIZING AN INTER- GOVERNMENTAL AGREEMENT BETWEEN THE CITY OF PORT ARTHUR AND JEFFERSON COUNTY, TEXAS, REGARDING PORT SECURITY' GRANT FUNDING WHEREAS, the City Council approved Resolution Number 07-542 on December 18, 2007 authorizing the City Manager and Fire Chief to apply for the 2007 Supplemental Port Security Grant Program (SPSGP) ; and WHEREAS, the Fire Chief has been notified that the City has'. been awarded the 2007 SPSGP; and WHEREAS, Jefferson County acts as the Fiduciary Agent for the 2007 SPSGP; and WHEREAS, the project will consist of the purchase of three (3) Sports Utility Vehicles, and related equipment to be utilized by the Port Arthur Fire Department for CBRNE response; and WHEREAS, the total project cost is $140,587.58, with 75% fedeY~al funds or $105,440.68 and 25% local funds or $35,146.90. NOW THEREFORE, BE IT RESOLVED BY THE CITY COiTNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1. That the facts and opinions in the preamble s.pr157.62 are true and correct. Section 2. That the City Manager and Fire Chief are hereby authorized to execute an Inter-Governmental Agreement with Jefferson County, Texas, in :substantially the same form as attached ]zereto as Exhibit "A". Section 3. That a copy of the caption of this Resolution be spread upon the Minutes of the City Council. READ, ADOPTED AND APPROVED on this day of ____ _ A.D., :2010, at a Meeting of the City Council of the City of Port Arthur, Texas, by the following vote: AYES: Mayor Cou:ncilmembers NOES: ATTEST: CIT~i' SECRETARY APPROVED~S TO FORM: CITY A'1"~'O]ZN MAYOF: s . prl_°i 7f37 APPROVED FOR ADMINISTRATION: CITY MANAGER FIRE CHIEF APPROVED AS TO THE AVAILABILITY ON' FUNDS: .~ r /~'~~~~ w~'~~. - DIRECTOR (OF FINANCE s.pr157ES2 EXHIBIT "A" INTER-GOVERNMENTAL AGREEMENT BETWEEN JEFFERSON COUNTY ~, AN:D CITY OF PORT ARTHUR, TEXAS STATE OF TEXAS COUNTY OF JEFFERSON This Agreement between Jefferson County Texas, hereinafter referred to as "County" and the City ~of Port Arthur, Texas hereinafter referred to as "City" is as follows: WHEREAS, the County acts as the Fiduciary Agent for the 2007,Supplemental Port Security Grant Program hereinafter referred to as "2007 SPSGP" administered by the Department of Homeland Security and WHEREAS, the City has submitted. and received approval from the Area Maritime Security Cornrnittee, Captain of the Port, and the Department of Homeland Security for the following project, Purchase of Three Sports Utility Vehicles,a.nd related equipment to be utilized by the City of Port Arthur Fire Department for CBRNE response, and WHEREAS, Seventy five percent (75%) of the project cost up to a maximum of $105,440.68 is approved under the 2007 Supplemental Port Security Grant Program and THEREFORE, FOR AND IN (:ONSIDERATICIN of the mutual benefits flowing to the City as well as the County as a result of the project 1. The County acting as Fiduciary Agent will draw down these funds from the 2007 Supplemental Port Security Grant Program and issue payment to the City 2. The City has budgeted~and made available the twenty five percent (25%) cash match as required by the 2007 SPSGP., . 3. The City will ensure that project activities are in accordance with the 2007 SPSGP. 4. Tlhe County shall fully and satisfactorily perform all of the conditions and .obligations as Fiduciary Agent under the terms of the 2007 SPSGP. S. The City will fully and satisfactorily perform all of its obligations under the terms of this agreement. 6. Tlie City hereby agrees to indemnify andl hold harmless the County against any all claims, demands, causes of action of every kind or character which may be asserted by the Area Maritime Security Commil:tee, Captain of the Port, and the Department of l~lomeland Security, occurring or in any way incident to, arising out of, or in connection with the services to be performed by the City under this agreement. 7. ~l'his is a good faith effort between the County and the City to accommodate and assist the citizens of Jefferson County l:-y providing the Sabine Neches Waterway with security improvements and each of the entities hereto pledge their best efforts to fulfill the obligation set forth herein this agreement.
