SUBJECT: A Resolution Approving a Property Loss Settlement in the Amount of $9,661.25 for
Damages to City of Port Arthur Police Vehicle #1656
COMMENTS
RECOMMENDATION:
I recommend approval of Proposed Resolution No. 157135 authorizing the property damage settlement against
Texas Municipal League Intergovernmental Risk Pool (TNIL) for damage sustained to Police Vehicle #1656 (2007
Ford Crown Victoria). It has been determined that the damages sustained by Vehicle #1656 rendered the vehicle a
total loss.
TML has offered to settle the claim for $9,661.25 (fair market value), less the City's Automobile Physical Damage
deductible of $2,500.00, and less the salvage value of $430.00, making the final settlement offer $6,731.25 (Exhibit
"A" attached). The City will retain the vehicle for salvageable parts.
BACKGROUND:
On February 14, 2010, Officer Mouton was enroute to a motor vehicle accident in Police Vehicle #1656 (2007 Ford
Crown Victoria) during rainy, windy weather when his vehiGe hydroplaned striking the concrete divider. The City
has Auto Physical Damage insurance coverage through TNIL with a $2,500.00 deductible.
After review and inspection of Vehicle #1656, it was determined that damages were in excess of the fair market
value of the vehicle. The Police Department has elected too retain salvage. TML has offered to settle the claim for
$9,661.25 I;fair market value), less the City's Automobile IPhysical Damage deductible of $2,500.00, and less the
salvage value of $430.00, making the final settlement offer $6,731.25.
BUDGETARY/FISCAL EFFECT:
The funds received will be deposited in the appropriate account designated by the Finance Director.

No effect on staffing levels

WHEREAS, on February 14, 2010, City of Port Arthwr Police Vehicle #1656 (2007 Ford Crown Victoria) was
damaged when it hydroplaned white enroute to a motor vehicile accident; and,
WHE:RE:AS, as a result of the damage, a claim was filed with Texas Municipal League Intergovernmental Risk
Pool (TML); ;and,
WHEREAS, TML has offered to settle the claim for $9,661.25 less the Automobile Physical Damage
deductible arnount cif $2,500.00, less salvage value of $430.00, making the final settlement $6,731.25, which is
considered a fair and reasonable settlement.
NOV11, THEREFORE, BE IT RESOLVED BY THE: CITY COUNCIL OF THE CITY OF PORT ARTHUR,
TEXAS:
Section 1. That, the facts and opinions in the preamble are true and correct.
Sectian 2. That, the City Manager is hereby authorized to do all things necessary to execute settlement in the
amount of $6, 731.25 for the claim against TML in substantially the same form as delineated in Exhibit "A".
Sectian 3. That, a copy of this Resolution be spread upon the minutes of the City Council.

Per your request I am sending you information concerning the 2007 Ford Crown Victoria,
VIN # 3337. The estimate of damages carne to $13,278.14, the vehicle has frame
damage. The NADA value of the vehicle came to $9,661.25 - $2,500.00 (ded) _
$7,161.25. You inquired into retaining the salvage of the vehicle. If you should choose to
retain the salvage of the vehicle the amount that would be deducted would be $430.00.
The amount that would be paid would be $7,161.25 - $430.00 (salvage value) _
$6,731.25.
Please also note that the vehicle would no IongE~r have any coverage thru TML.
