BACKGROUND:
The Zoning Board of Adjustment and Appeals is being asked to consider a variance
for the following lot(s)/tract(s) in the City of Port Arthur, Jefferson County, Texas.

This site is located north of Gulfway Drive and west of El Paso Avenue (on
Seventeenth Street). It is also known as North 90 feet of Lot 1, Block 325, Port
Arthur Land Company, A-053400, Port Arthur, TX 77640-3945. The zoning is "SF"
Single Family. Notices were sent out in compliance with the Texas Local
Government Code Section 211 as well as the publication being done on March 21st
for the April 5th meeting more than 15 days prior to the public hearing.

RECOMMENDATION:
Staff has no objections to this request due to the hardship of the family not being
able to afford more land, yet to build a new house in compliance with the Codes. The
house will. fit on the property with the correct setbacks. The previous case was
denied as to issues of easement and request not comparably to publication, as the
side setbacks were also deficient; however, the sides are no longer an issue and only
the depth of the property is a problem to be reconciled.
BUDGETARY/FISCAL EFFECT: None
STAFFING/EMPLOYEE EFFECT: None

SUMMARY:
The previous case was denied as the publication request was not inclusive of side
setbacks and there issue of the water line was not clarified. The Zoning Board of
Adjustment is requested to approve this lot of 4500 square feet to allow for legal
non-compliance in regards to present Codes and Zoning Ordinance. The lot
coverage cannot exceed 35% since the required coverage for 5,000 square
foot housing is 40% and this lot size is 500 square foot less than usual.

This site is located north of Thomas Boulevard and west of Fort Worth Avenue. It is also
known as R i/z of Lot 12, Block 485, Port Arthur Land Company, A-053400, Port Arthur, TX
77640-3945. The zoning is "HC" Heavy Commercial. Notices were sent out in compliance
with the Texas Local Government Code Section 211 as well as the publication being done
on March 21St for the April 5th meeting more than 15 days prior to the public hearing.

RECOMMENDATION:
Staff has no objections to this request due to the hardship of the family not being able to
afford more land and both adjacent properties have houses. The City is looking a worse
scenario cases and in order to have the house facing Dallas the 70 foot width will do,
however, the 50 foot depth will allow for a legally non-conforming structure. The house
will fit on the property with the correct setbacks on the sides.
BUDGETARY/FISCAL EFFECT: None
STAFFING/EMPLOYEE EFFECT: None
SUMMARY:

I. Roll Call -Chairman, John Clayton convened the meeting at 5:30 p.m.
Commissioners present: John Clayton, George Boutte, Jr., Deral Segler, Melinda McNulty and
Eddie Scaggs were present to constitute the necessary quorum.

Melinda McNulty moved to accept the minutes as presented; George Boutte, Jr. seconded the
motion.
